In the August 1972 issue of House & Home Mag.,
which is a building trades journal published by McGraw - Hill, there is an
article called * Impact Zoning ". This article very ably presents a way out of
the housing and land use dilemma which is plaging all communities today.
Impact Zoning, would replace the arbitrary
zoning restrictions with a before - the - fact analysis of the community and
assess how the proposed project would affect it. This is done by correlating
the four following key detenu ining conditions)-
1. The growth rate of the community as it
relates to the present population, the available land and the growth rate of the
surrounding region.
2. The communities infrastructure; sewers,
water, roads, schools,parks, etc.
3. The economic picture - what the project
will cost the community in services vs. what It will return in the form of
revenues.
4. Natural determinants of the project Impact
on the environment and its surrounding areas.
John Rahenkamp and Walter Sachs whose firm of
Rahenkamp, Sachs, Wells & Assoc. of Philadelphia, developed the impact zoning
system; they believe is the only way out of the crisis. We believe it is a
very sound approach to solving the problem.
On October 26-27, a seminar sponsored by
McGraw - Hill and Advanced Management Research International Inc.,will be
held at The Sheraton, Harbor Island. This is one of four seminars to be held
throught the U.S.', New York, Chicago, Dallas and San Diego. Mr Rahenkamp and

Mr Sachs will be among the faculty of this seminar*
We urge you to send two or more representatives to this
conference. One from the Planning Department, one from the Planning Commission,
and one from the Cit Council. We r0*11*® tfta* tne seminar
is designed primairly for the developers, however, we also realize that in order
to preserve the economy and the environment and to provide for homes for all
people from all walks of life; we must devise a more equitable plan for land
use than we have presently. To quote from the seminar brochures n A major reason
why development deals turn sour is that a basic fact is forgotten: The key to
success of any residential development is how the land is used . If it is used
right, the deal is on solid footing; if it is used wrong, it may never yield
its real potential profit, and may prove disastrous for all participants.11
This would include the community and the developer*
We feel that there are two other key factors which should be
added to 4. in the analysis of the environment in San Diego County. The first
is transportation and how it relates to air polution, because of our unique
geographical setting and the way the air circulates in the area. The second is
waste water and pollution of the water table and the water in San Diego Bay.
We feel that Impact Zoning is the most valuable tool for
development that has cone forth in years and that it should be seriously con-
sidered for San Diego County. We hope that you will be the leaders in carrying
this consideration forward to C.P.O., League of California Cities and others*

This is to acknowledge receipt of Specific Plan No. 101 owned by Arthur
Doty.
Review of the plan indicates that we would approve the plan provided
there is compliance with the following:
1. All buildings are connected to the Carlsbad Municipal Water Dis-
trict.
2. All buildings connected to the City of Carlsbad Public Sewer Sys-
tem.
The proposed design of the swimming pool combined with a "Jacuzzi" pool
is not acceptable. The proposed pools must be separated. Details of pool
construction will be reviewed for approval when specific plans are sub-
mitted.

The Governing Board of the school district at a meeting held on
January 22, 1973 reviewed the information presented by your department
on January 4, 1973 concerning a real estate development known as
ECO-West consisting of 20 two-bedroom condominium residential units.
As a result of this review, it is estimated that from the number and
types of residences planned that the anticipated number of school age
children residing therein will be as follows:

This school district is experiencing continued increases in numbers of
students and is studying means by which school buildings and facilities
can be provided. Since three successive school bond elections have
failed, all-year school, double sessions and other plans are either in
effect or under consideration.
The Governing Board requests that your agency withhold approval of this
proposed residential development until the developer meets with school
administrators and your assigned staff members to work out a mutual
agreement to provide for future school requirements that will result

from the construction of these residences. In addition, the agreement
should be approved by the school board and the elected representatives
of the City of Carlsbad prior to final approval of the proposed

developers. The school district administration will be glad to work
with you in establishing the times and dates for these conferences.
Your assistance with this matter, as with similar ones in the past, is
most appreciated.

Mr. Lance and I have had conferences with three developers since our
meeting with you and representatives of Pacesetter Homes. They are as
follows:
William A. Zongker—Hedionda Point Development
Jaime A. Pero--South Bay Engineering representing
Mr. Ayers
Mr. Duncan—Representing the condominium development
on Harrison Street
Mr. Zongker expressed a willingness to contribute in-lieu funds for pupils
in the Hedionda Point Development. We will recheck our figures and submit
an updated estimate of pupils expected. We explained to him the arrangement
whereby the city will collect the fees, purchase sites and lease them to the
district.
Mr. Pero expressed his opinion that the requirements for school sites
appeared reasonable but did not commit himself because of the need to have
clearance from Mr. Ayers . Further discussions will be necessary with him as
development plans unfold.
^Mr. Duncan Was perfectly agreeable to donation of in-lieu fees.

When sites can be donated directly by the developer to the school district,
as apparently will be the case with the Ayers development, it would seem
appropriate for a three-way agreement between city, school district and
developer for purposes of master planning.
When in-lieu fees are to be paid, the city will need to collect the money.

SUBJECT: ADDENDUM TO STAFF REPORT FOR A REQUEST FOR SPECIFIC PLAN ADOPTION,
WEST SIDE OF HARRISON STREET.

The Planning Commission heard the subject application on March 27, 1973 and
continued action until the April 10, 1973 meeting.
The Commission was concerned about the ability of the existing circulation
system to handle projected traffic counts which can be attributed to
potential development.
Development potentials are based on the zoning as it exists. Property
adjoining the subject property is R-l-7,500 which will have a potential
unit yield of approximately 4-5 dwelling units per acre. The property
known as "Fox's Snug Harbor" is zoned R-T which has the capacity to yield
approximately 47 d.u./acre. Assuming that maximum d.u. yields are going
to occur, Harrison Street will have an average daily traffic (ADT) requirement
of 5000-6000 trips per day. Harrison Street and Locust Street have existing
R/W's of 40 feet. A circulation system on the existing right-of-way would
be satisfactory if on-street parking were prohibited and sidewalks occur
on both sides. However, the projected minimum widths on residential streets
is 60 feet. The applicant and all other properties wishing to develop will
be required to dedicate an additional 10 feet which will allow for a fully
improved street, including parking, two (2) travel lanes, sidewalks and
landscaping. In either case, Harrison Street has the ability to handle
projected traffic if maximum densities are achieved as property is currently
zoned.
Therefore, the Specific Plan, as requested by the applicant, will not affect
the circulation system as it presently exists.

DESCRIPTION OF APPLICATION - The applicant (Arthur Doty, Eco-West) is requesting
approval of a specific plan to allow development of an apartment complex con-
sisting of twenty (20) two-bedroom units.
DESCRIPTION OF PROPERTY - The property under consideration is located on the
west side of Harrison Street, southerly of Chinquapin Avenue. Said parcel
contains approximately 39,500 square feet of land area which abutts the. westerly
right-of-way line of Interstate 5. The property presently has one single-family
dwelling built upon it, however, the structure will be removed or raised to
facilitate the development of the apartment units. Said property has 250'
of street frontage, and an approximate lot depth of 155 feet. The terrain is
basically flat and will not require any significant grading.
DESCRIPTION OF SURROUNDING LAND USE AND ZONING
1. Land Use - The surrounding property to the south, east and north is
currently developed as single-family residential, the property to the west
is Interstate 5.
2-' Zoning - The surrounding property to the south, east and north is zoned
R-l(7500), the property to the west is publicly owned land.
SPECIFIC PLAN REV IEN - Upon review of the submitted plans, the Planning Department
finds that the proposed development substantially complies with the R-3 de-
velopment standards.
ZONING REVIEW - Upon review of the applicable zoning regulations, the
Planning Department finds that the proposed development substantially con-.
forms with all requirements.
REV I EH OF PREVIOUS ACTION - The subject property has been granted a Specific
Plan by Ordinance Number 9233, which passed second reading the 17th day of
June, 1969. The conditions contained therein are still applicable and are
further made a condition of this approval.

ENVIRONMENTAL IMPACT CONSIDERATION - The applicant has submitted the required
Environmental Impact Assessment which has been reviewed by the Planning
Department. The project has been declared to have a "non-significant" impact
on the environment for the following reasons:
1. The project is consistant with the goals and provisions of the
General Plan.
2. The project does not significantly intensify the land use of the
surrounding established neighborhood.
3. The proposed project is situated on a slope bank above the major
noise corridor of the adjacent freeway.
4. Albeit, the proposed project is within the Coastal Permit Zone,
it does not impair public use or access to this resource.
5. The most environmentally significant aspect of this development
is the projected increase of vehicle trips per day, added to the traffic
volume on Harrison Street, however, a ten (10) foot wide strip of land
shall be dedicated to the City and shall be fully improved so as to
reasonably mitigate this impact.
RECOMMENDATION - The Planning Department would recommend that the Planning
Commission consider granting approval of this Specific Plan, subject to
the execution and/or fulfillment of the following conditions:
1. The City Council ordinance which approves this Specific Plan, labeled
Exhibit "A" & "B", supercedes Ordinance No. 9233.
2. All public improvements shall be made in conformity with the
Subdivision Ordinance, and other City standards, to the satisfaction of
the City Engineer, without cost to the City of Carlsbad and free of all
liens and encumbrances.
3. All land and/or easements required by this Ordinance shall be granted
to the City of Carlsbad without cost to the City, and free of all liens
and encumbrances.
4. The project shall be constructed with the density shown on the
Specific Plan, and shall be constructed in no less a manner than shown
on the exhibits labeled "A" and "B".

5. Final elevation and plot plans shall be reviewed by the Director of
Planning to ensure conformity with the intent of this Specific Plan.
6. The off-street parking facilities shall be constructed in accordance
with Chapter 21.44 of the Carlsbad Municipal Code.
7. Side and rear yards shall be fenced with a six foot high solid
fence or equal, and in compatible materials with those used in the main
structure.
8. Exterior lighting shall be provided in the off-street parking areas,
and shall be shielded so as not to shine or glare on adjacent properties.
9. A Parcel Map shall be prepared, filed with the City of Carlsbad and
recorded prior to the issuance of any building permit whatsoever.
10. A strip of land ten (10) feet wide shall be granted to the City for
street purposes along Harrison Street.
11. Full subdivision improvements shall be constructed to include the
underground!'ng of all utilities.
12. An approved Fire Hydrant shall be installed on the west side of
Harrison Street, at the intersection of Locust Ave., type and installation
to the satisfaction of the Fire Chief.
13. On-site fire protection appurtenances shall be constructed in
accordance with Fire Department requirements to the satisfaction of
the Fire Chief. Said fire protection appurtenances shall be installed and
functioning prior to framing construction.
14. All buildings shall be connected to the facilities of the City of
Carlsbad Water Department.
15. All buildings shall be connected to the City of Carlsbad Public Sewer
System.
16. The proposed design of the swimming pool and Jacuzzi shall be revised
to the satisfaction of the City's Health Officer.
17. A landscape plan shall be submitted to, and approved by, the
Director of Planning:prior to the issuance of a building permit. Landscape
Plan shall include provisions for a landscape screen adjacent to the 1-5 freeway
right-of-way.
18. Provisions will be made for Cable Television.

19. The applicant shall obtain a mutual agreement with the Carlsbad Unified
School District to provide for future school requirements that will result
from the construction of these residences. Said agreement shall be secured
prior to obtaining building permits for the herein described project.
