CHRONOLOGY OF EVENTS
04/06/71 Ordinance 9268 established the P-U (Public Utility) Zone
with permitted use, Specific Plan and development
regulation requirements.
06/22/71 Planning Commission Resolution No. 711 recommending pre-
annexation change of zone from R-A, R-3 and M zones to P-
U zoning and adoption of Specific Plan for 680 acre SDG&E
ownership.
08/03/71 Ordinance 9279 adopting a Specific Plan (SP-144) and
associated exhibits, an 11 x 19 color graphic and 400-
scale velum drawing dated 1/9/70, for the 680 acre SDG&E
ownership subject to 13 conditions of approval.
08/03/71 Ordinance 9280 approving the rezoning of 680 acre SDG&E
ownership from zones R-A, R-3 and M to P-U zoning and
pre-annexation zoning from country zoning to P-U zoning.
00/00/73 Grading Permit approved for installation of Fuel Oil
Storage Tank No. 6. Approved use consistent with adopted
Specific Plan map 144 (SP-144).
11/13/73 Planning Commission Resolution No. 986 recommending
approval of amendment to SP-144 to permit the construc-
tion of a 400 foot stack to replace the four (4) existing
power plant stacks subject to 11 conditions of approval.
12/04/73 Ordinance 9372 amends Ordinance 9279 to permit the
construction of a 400 foot stack to replace four (4)
existing stacks at the power plant as a method of
dispersing power plant emissions subject to amendment of
Section 2 of Ordinance 9279 as follows:
* Replace SP-144 with SP-144A
4 Add Condition 14 requiring incorporation of Condi-
tions 1-9 and 11 of Planning Commission Resolution
986.

4 Add Condition 15 requiring review of the approval
on a five year basis and providing for SDG&E/City
Council determination of a report describing the
"state of the art" of alternative emission control
systems that could be utilized in lieu of the 400
foot stack is appropriate.
An Environmental Impact Report was prepared and accepted
for the project.
Ordinance 9372 and its amendment of Ordinance 9279 became
null and void on December 4, 1974 because of SDG&E's
inability to commence construction of the project within
one (1) year of the approval of Ordinance 9372 as
required by Condition No. 3 of Planning Commission
Resolution 986.
09/03/75 Grading Permit approval for installation of Fuel Oil
Storage Tank No. 7. Approved use consistent with adopted
SP-144.
10/07/75 CPUC approves Certificate of Public Convenience and
Necessity for Encina Unit 5 including the 400 foot stack
and associated transmission line facilities.
11/10/75 City Council Resolution No. 3780 approving a park site
lease and exhibit dated 11/10/75 and authorizing the
Mayor to execute the lease with SDG&E.
11/18/75 California Coastal Commission approval of Encina Unit 5
including the 400 foot stack and associated transmission
line facilities.
05/04/76 Ordinance 9456 amends Ordinance 9279 to permit construc-
tion of a 400 foot stack to replace four (4) existing
stacks as a method of dispersing power plant emissions
subject to amendment of Section 2 of Ordinance 9279 as
follows:
* Replacement of SP-144 with revised Specific Plan
map SP-144B dated 11/10/75.
+ Add Condition No. 14 incorporating Conditions of
approval A-L.
07/20/76 City Council reaffirms Ordinance 9456, the stack amend-
ment, and declares it reinstated in full force and effect
and not subject to the referendum process.

07/21/76 Grading Permit approval for the construction of Unit 5
and the 400 foot stack.
07/22/76 Building Permit (No. 76-45) approval for the construction
of Unit 5 and the 400 foot stack.
08/17/76 Execution of Carlsbad Boulevard Improvements Agreement as
required by Section 2, Condition 13 (A) of Ordinance
9279.
03/09/77 Planning Commission Resolution No. 1338 recommending
approval of amendment to Specific Plan 144 (SP-144B) to
allow construction of Water Treatment Facilities and a
Maintenance Building subject to Conditions A and B, 1-4.
05/03/77 Ordinance 9481 amends Ordinance Nos. 9279 and 9456 to
permit the construction of Wastewater Treatment Facili-
ties and a Maintenance Building subject to the amendment
of Section 2 of Ordinance 9279 as follows:
* Replace SP-144B with a revised Specific Plan map
SP-144C, dated 4/5/77.
* Add Condition 15 and parts A & B. Condition 15
indicates that construction shall also be in com-
pliance with the project plot plan exhibit dated
1/31/77.
06/00/77 Building Permit approval to allow construction of 50* x
16' Wastewater Treatment Maintenance Building (Control
Room). Use permitted by Ordinance 9481 and SP-144C.
02/07/78 City Council Resolution 5302 finding that the power plant
particulate fallout problem is controlled to the satis-
faction of the City Council and Air Pollution Control
Officer and that Condition No. 14 (H) of Ordinance 9456
has been satisfied contingent upon SDG&E continuing to
pay for property damage resulting from the fallout until
final building permit clearance occurs for Encina Unit 5.
02/28/78 SDG&E requests suspension of proposed Specific Plan
Amendment providing for connection of Unit 5 to the 400
foot stack. Amendment not required because Ordinance
9456 and the CPUC approval of Unit 5 and their respective
environmental impact reports establish the connection of
Unit 5 to the stack.

03/12/79 Building Permit (No. 79-889) approval to allow the
installation of 2930 feet of fencing around the fuel oil
tanks, water treatment facilities, water intake facili-
ties, warm water discharge pond and its associated ocean
jetty.
05/18/82 City Council accepts final report on air quality from
APCD as required by Ordinance 9456, Condition 14 (F).
05/18/82 City Council Resolution 6877 adopting the Land Use
portion of the Agua Hedionda local Coastal Program
including the following findings:
f The Land Use Plan is consistent with existing
Specific Plans in the areas affected by the Agua
Hedionda Land Use Plan, and incorporates by refer-
encing the provisions of Carlsbad Specific Plans
144, 144(A), 144(B), 144(C).
06/23/82 Staff Administrative Determination of consistency with
SP-144C and Planning Commission concurrence to allow
construction of a 138/12kV electrical distribution
substation with an ultimate capacity of 48 megawatts.
10/09/84 Staff Administrative Determination of consistency with
SP-144C to allow construction of a 6,167 square foot
replacement administration building and the conversion/
remodel of an existing building to a storage/repair
maintenance facility.
07/02/85 Building Permit (No. 85-420) approval to allow construc-
tion of crib wall along the bluff adjacent to the outer
Agua Hedionda Lagoon.
07/05/85 Building Permit (No. 85-170) approval to allow the
remodel of the existing power plant electrical shop.
10/16/85 Certificate of Compliance granted by City Engineer to
establish SDG&E property bisected by Interstate 5 as two
(2) legal parcels as described by Exhibits A and B.
01/31/86 Building Permit (No. 85-608A) approval for construction
of 6,168 square foot replacement administration building
consistent with 10/9/84 administrative determination.
01/31/86 Building Permit (No. 85-608B) approval for construction
of remodel of existing power plant lunch room.

01/31/86 Building Permit (No. 85-608C) approval for conversion of
existing building to storeroom/repair facility consistent
with 10/9/84 administrative determination.
04/21/86 Staff Administrative Determination of consistency with
SP-144C for installation of 20' x 40' x 60' storage shed
for gas poly pipe shed on the Northcoast Operations
Center site.
09/16/86 Staff Administrative Determination of consistency with
SP-144C for installation of 20' x 40' x 14' metal paint
shop structure.
10/01/86 Staff Administrative Determination of consistency with
SP-144C and Planning Commission concurrence for the
installation of microwave and mobile radio telecommunica-
tion equipment on the 400 foot stack.
04/09/87 SDG&E withdrawal of February 4, 1986 application to amend
Specific Plan Ordinance 9279 and SP-144C to provide for
the installation of a 50,000 square foot Service Center
office and varied ancillary facilities on the Northcoast
Operations Center site and to revise SP-144C to show
previously approved facilities.
07/15/87 Staff Administrative Determination of consistency with
SP-144C to allow the installation of two (2) temporary
office trailers on the Northcoast Operations Center site.
06/09/89 Building Permit (No. 89-225) approval for construction of
30' x 40' x 14' metal paint shop structure consistent
with 9/16/86 staff administrative determination.
07/19/89 Planning Commission Resolution 2859 approving the minor
amendment of Specific Plan 144C to allow the construction
of six (6) wastewater treatment tanks and accessory
facilities to replace existing wastewater ponds subject
to conditions of approval 1-15.
07/24/89 Planning Director letter informing SDG&E that any future
request for improvement to the Encina Power Plant will
require a major amendment to the adopted Specific Plan.
10/10/89 Grading Permit (No. 2-88-34) approval for installation of
six (6) steel wastewater treatment tanks as approved by
Planning Commission Resolution 2859.
12/11/89 Building Permit (No. 89-1362) approval for construction
of six (6) steel wastewater tanks and concrete founda-
tions approved by Planning Commission Resolution 2859.

01/23/90 Interim Ordinance NS-108 adopted by City Council estab-
lishing an emergency moratorium on SDG&E expansion
activities pending studies and possible changes in the
General Plan, local Coastal Plan and the Zoning Ordi-
nance. Intent and purpose of the Interim Ordinance is to
prohibit the increase in size, location or generating
capacity of the existing power plant.
02/13/90 Ordinance NS-111 extending Interim Ordinance NS-108
prohibiting the expansion of gas and electric utility
facilities within the public utility zone pending studies
and changes in the General Plan and zoning for a period
of 22 months and 15 days. NS-111 also provided clarifi-
cation of the affect of the ordinance upon certain
existing and proposed activities at the power plant.
04/17/90 Staff Administrative Determination of consistency with
adopted Specific Plan 144C to enlarge an existing shift
supervisor's office inside the power plant building to
accommodate increased storage and equipment requirements
and minor convenience improvements.
08/22/90 Building Permit (No. 90-1107) approval for construction
of shift supervisor's office enlargement within the power
plant building consistent with 04/17/90 staff administra-
tive determination.
11/05/90 Staff clarification on the processing of "BLUFFTOP
PROPERTY" adjustment plat with regard to applicable city
land use controls.
12/11/90 Staff Administrative Determination that proposed deminer-
alization regeneration tank is consistent with replace-
ment wastewater treatment improvements (tanks) authorized
by 7/19/89 Planning Commission Resolution 2859 and not
subject to Emergency Moratorium Ordinance NS-111.
Per staff request, replacement exhibit submitted on
12/10/90 showing removal of the wastewater ponds and the
location of the new wastewater tanks and deminerlizer
regeneration tank utilizing exhibit filed for complying
with condition of approval 3 of Planning Commission
Resolution 2859.
