CALIFORNIA 92112 (714) 232-4252 October 1, Mr. Paul Bussey City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 MUC 010 Re: Reapplication for Amendment to San DiegoTJas & Electric Company's Specific Plan (Ordinance No. 9279) Dear Mr. Bussey: On December 4, 1973, the City Council adopted Ordinance No. 9372 amending Ordinance No. 9279 for the purpose of approving the construction of a 400-foot stack at the Encina site. In its amendment, the City Council incorporated, by reference, Planning Commission Resolution No. 986. Planning Commission Resolution No. 986 is, in our opinion, ambiguous in several respects. Ordinance No. 9372 required the commencement of construction within one year of its effective date, in accordance with the interpretation you have placed upon it. This, we were unable to accomplish, since, as you know, we have not as yet received the approval of the California Public Utilities Com- mission and the California Coastal Zone Conservation Commission. It is our understanding that had we applied for an extension of the time period to commence construction prior to the expiration of Ordinance No. 9372, the city would have granted such extension. Additionally, we understand that the city recognizes that a one- year period to commence construction when additional governmental authorizations are required may not be sufficient and has taken action to extend that period in those applications that are presently being processed. The attached reapplication for an amendment to Ordinance No. 9279 is based on the same facts and conditions which were presented in support of the application resulting in the adoption of Ordinance No. 9372. There have been no changes in circumstances other than the passage of time. AN INVESTOR-OWNED CORPORATION SAN DIEGO GAS & ELECTRIC COMPANY Mr. Paul Bussey October 7, 1975 Page 2 As part of its Environmental Impact Report for the con- sideration of Encina Unit 5, the California Public Utilities Com- mission included an analysis of the 400-foot stack addition to the Encina facility. This Environmental Impact Report is supplementary to the one adopted by the city prior to the adoption of the amend- ment to the Specific Plan. All requirements of the California Environmental Quality Act have been satisfied. San Diego Gas & Electric Company anticipates the ob- taining of the approvals of the California Public Utilities Com- mission and the California Coastal Zone Conservation Commission by mid-November, 1975* and would then be ready to commence con- struction. We respectfully request that every effort be made to compress the time required for consideration of this reapplication, since it is based on the same facts and conditions as were before the city in the adoption of Ordinance No. 9372.
