*• REQUEST: The appli-cant is requesting an amendment to an ;approved Specific Plan which would allow an additional one-
year extension for the temporary use of a Bank of America
Facility on the East side of El Camino Real. This ex-
tension would allow the use of the facility until November
17, 1975.
II. RECOMMENDATION: That the Planning Commission move to
recommend APPROVAL of SP-156 to the City Council. Justi-
fication is based on:
1. The proposed time extension would not be
materially detrimental to the general plan.
2. The time extension will not adversely effect
the approved Specific Plan.
CONDITION OF APPROVAL:
Any further request for a time^extension for this use shall
be processed according to the (Conditional use permit procedures
for mobile home facilities as denoted in Section 21.42.06 of
the Municipal Code.
III. BACKGROUND
A. Local Description: A portion of Northwesterly one-
fourth of Fractional Section 32, Township 11, South,
Range West, S...B;.M. City of Carlsbad.
B- Location: On the east side of El Camino Real, 200 ft.
south of the intersection of Haymar Drive and El Camino
Real.
C. Type of Structure; Temporary bank facility with alumi-
nium and stained wood exterior.
D. Size: 1988 SF floor area; Site Area .50 acres.

E. Coverage: 9%
F. E.I.R. Finding: The project is exempt from
the requirements of the City's Environmental
Protection Ordinance , for reason of prior
--- compliance.

designation for the subject property.

IV. DISCUSSION OF SPECIFIC ITEM
A- Hi story: There was some concern at the time the
ori gi nal Specific Plan was approved by the Planning
•Commission (October 1970) as to the duration of the
temporary use. The 'applicants' representative, Mr.
Crowe!!,; indicated at that time that other temporary
banks (such as ones in Vista and Laguna Niguel) were
requiring one to two years to move into permanent
facilities. This period, he explained, was necessary
for determining banking needs and establishing services
relative to demand.
It has been nearly 3 1/2 years since the original
Specific Plan was approved. The applicant requested
and was granted on November 17, 1972, an amendment
to the Specific Plan which allows the temporary bank
structure and use to continue until November 17, 1974.
B. Temporary Use of Mobile Homes for Commercial Office
Purposes:
The temporary bank facility in question is registered
by the state as a mobile home. Since the time of
the original specific plan approval, the City has
approved a zone code amendment #49 which would allow
such uses only by conditional use permit for a period
of one year. An extension of that C.U.P. could be
granted only if construction has commenced and
reasonable progress toward completion is being made.
Because the applicant does have an approved Specific
Plan under which the temporary use was granted, staff
believes that the C.U.P. procedures do not apply in
.. . this instance. However it is our recommendation that
any further requests for a continuance (which, barring

any unforseen difficulties wi11 not occur) be
processed according the C.U.P. procedures outlined
in Section 21.42.010(5)(S) of Title 21 of the
Municipal Code.
