As per your request on interpretation of condition #2 of
Ordinance 9389 which requires that construction commence
within one year front approval, the following is submitted;
Staff considers construction of one-half of the tennis court
on the subject specific plan as evidence of commencing
construction. However, the development must also be diligently
pursued. Staff considered diligently pursued as the request for
development permits on the remainder or a portion of the specific
plans within one year from the completion of the last develop-
ment permit. Since the tennis courts were completed in December
1974, you will need to request further development permits by
December, 1975. ...

This office has reviewed the subject project and has the
following comments:
1. This project is within the retail service area of the
Carlsbad Municipal Water District.
2. This project appears to be a condominium and as such
the developer will be required to comply with the
rules and regulations of the Carlsbad Municipal Water
District with respect to water service for condominiums
within the Carlsbad Municipal Water District.
3. This project will be subject to all of the rules and
regulations of the Carlsbad Municipal Water District.

Gentlemen:
Reference: SP-157, Altamira No. 4
The Governing Board of the school district at a meeting held on
March 25, 1974 reviewed the information presented by your department
concerning the proposed real estate development known as SP-157,
Altamira No. 4, consisting of 400 adult only residential units.
As a result of this review, it is estimated that from the number and
types of residences planned that there may be from 12 to 15 high
school age children only residing in the project when it is completed
and occupied.
The district does not have facilities to provide for a single-session
educational program for children who will be residing in this proposed
development. In addition, the district does not have any funds to
provide for facilities to house these children.
To date, no agreement has been reached with the developer to provide
financial assistance for school facilities which will be needed if and
when these residences are constructed. It is requested that approval of
this proposed residential development be withheld until a firm agreement
is reached between the developer and the Governing Board of the district
for provision of necessary school facilities.
It will be greatly appreciated if copies of this letter are made avail-
able to members of the City Council and the Planning Commission.
