HomeMy WebLinkAboutSP 159; La Costa Vale No. 2; Specific Plan (SP)5 CITY OF CARLSBAD PLANNING DEPARTMENT STAFF REPORT AUGUST 13, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT REPORT ON: CONSIDERATION OF A TENTATIVE MAP CONSIDERATION OF A SPECIFIC PLAN CASES NO: CT 74-11 SP-159 APPLICANT: LA COSTA PACIFIC DEVELOPMENT II (O'Brien) 9215 Spring St., Suite 320 La Mesa, Ca. 92041 At the July 23, 1974 meeting, the Planning Commission moved to continue the subject application because it did not meet the 66-2/3% Open Space requirement of the Planned Community zone. The applicant has made several revisions to the project and it now complies with the Planning Commission Ordinance. RECOMMENDATIONS: A. SP-159 - Staff recommends approval subject to the following conditions: (1) The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A. The location of all buildings, fences, signs, roadways, parking areas, landscaping, and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. (2) Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Commission. (3) All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. (4) All areas shown as parking areas shall be surfaced with asphaltic concrete and shall be visibly marked outlining individual parking spaces and traffic flow. Said surfacing and marking shall be com- pensated prior to final inspection of the structure or structures by the Building Department. The surface shall be kept in a reasonably good state of repair at all times. (5) Prior to obtaining a building permit and within 30 days hereof, the applicant shall file with the Secretary of the Planning Commission written acceptance of the conditions stated herein. (6) A detailed landscape and sprinkler plan preoared by a landscape archi- tect, shall be submitted to the Planning Director for consideration and approval . Ui) JUSTIFICATION (1) The project meets all applicable requirements of the Municipal Code. (2) The project conforms to the adopted General Plan. B. CT 74411- Staff recommends approval subject to the following conditions: (1) The development of the property described herein shall be subject to the restriction and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties. (2) The C.C. & R.'s for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. (3) In order to provide for reasonable fire protection during the con- struction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. (4) All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Sub- division Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. (5) All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. (6) The improvement plans shall include a report of a geological in- vestigation and a complete grading plan of the entire site when required by the City Engineer. The report and plan shall be prepared by civil engineers licensed by the State of California, and experienced in erosion control who shall be acceptable to the City Engineer and they shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties and conform to the standards of the Geological Safety Element of the General Plan. (7) The existing 10' sewer easement shall be abandoned and new sewer arrangements shall be made as required by the Leucadia County Water District. JUSTIFICATION (1) The project meets all applicable requirements of the Municipal Code. (2) The project conforms to the State of California Subdivision Map Act. (3) The project conforms to the adopted General Plan. REQUEST: The applicant is requesting approval of a Specific Plan and Tentative Map to allow 48 Condominium Units on 4.44 acres located at the end of Velero Court, described as lots 261 and 262 of La Costa Vale Unit #Z. II. RECOMMENDATIONS: Staff recommends that the proposed Specific Plan and Tentative Map BE DENIED J-/ITHOUT PREJUDICE because the project does not meet the 66-2/3% Open Space requirement of the P-C Zone. A. Recommended Conditionsof Approval for the Tentative Map - Should the Planning Commission determine to approve 1 the Tentative Map the following conditions are recommended: | (1) The development of the property described herein shall be subject to the restriction and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential character- istics of adjacent properties. Parks Ordinance Compliance: The La Costa Land Company has completed a parks agreement for the entire Vale Unit #2 project. This agreement covers the parks obligation for the subject application. Public Facilities Policy: The applicant has obtained letters from the Encinitas Union and San Dieguito High School Districts stating that facilities will be available to serve the project.
