Dear Larry:
This . is a follow up to my letter to you dated June 6, 1977.
Apparently you had made an application for a Specific Plan
(SP 166) for Lot No. 6 of the Papagayo development on January 13,
1975. In reviewing that file it is clear that the Planning
Commission at their meeting of March 25, 1975, approved a
motion to close the file without taking any action. Their action
also stated that if the applicant wished to continue with his
specific plan application, he would have to file a new application
and pay new fees.
Therefore, the conclusion that I made in my letter to you on
June 6, 1977 still holds. That is, development on Parcel No. 6
is not considered as a current application pending City action.

Dear Larry:
I have investigated the question you asked me last week regarding
a pending subdivision application for the Papagayo development.
Through my research, I have determined that the subdivision you
refer to is not considered as a current application pending City
action.
Apparently, the subdivision you refer to was discussed some time
ago with other City officials. It was determined at that time
that an application could not be accepted for the following reasons:
1. The Specific Plan for the area would have to be
amended prior to or concurrent with the tentative map.
2. The pending Agua Hedionda Specific Plan would have
to be completed prior to the approval of any development
plans in the area.
3. After the Agua Hedionda Plan is adopted, an understanding
of the Coastal Commission's position would be needed
before we proceed because of their original denial of
any development in the area.
At this time, I don't know how this determination will affect your
project with regards to sewer capacity allocation since the allocation
program has not been adopted. However, I think the impact will be
minimal because of the need of tentative map approval for either case.
If you have any further questions on this matter, I will be happy
to discuss them with you.

Dear Mr. Agatep:
Reference is made to your conversation with
Ted Richmond regarding the reactivation of that portion
of the Papagayo condominium involving the middle sector
of the Agua Hedionda Lagoon. As you indicated, it would
be appropriate for the City of Carlsbad to be advised
of any change in the Company's position regarding this
matter.
To date, Mr. Hunts, the developer of the
condominium project has not contacted my office since
the area along the north shore of the lagoon was dis-
approved by the Coastal Commission. Our file on the
project was closed following the Coastal Commission
action.
Inasmuch as our position has not changed, we
believe it is important to advise you of previous
correspondence indicating our position. We communicated
to Mr. E. L. Jose, Chairman, City of Carlsbad Planning
Commission by letter dated December 1, 1972 and to Mr.
Larry D. Hunts by letter dated March 26, 1973. Should
you not have copies of these letters we are attaching
copies for your review.
If you have any further questions regarding
this matter, please let me know.

SUBJECT: Papagayo Condominiums, Request to Construct
Building Foundation Prior to Completing Specific
Plan and Tentative Map Conditions
To help facilitate the construction of these condominiums, Planning
Staff does hereby approve the issuance of permits to construct building
foundations. However, it must be clear to all concerned that further
building permits needed to complete the development will not be approved
unless all pertinent conditions imposed upon the development by the
Planning Commission and City Council are satisfactorily met.
If there is any question by the applicant of what these pertinent
conditions are, he should review them with Planning Staff. I suggest
the applicant diligently pursue the completion of these conditions to
reduce further delays in construction.

¥e have reviewed with interest the proposed Papagayo
Condominium development between Interstate 5 and the Atchison,
Topeka & Santa Pe Railway right of way, south of Chinquapin
Avenue, Carlsbad,
We have just a few comments to raaJce in hopes of clarifying
our position, and avoid any misunderstanding by those who will
be analyzing the project.
The development of Papagayo Bay and the adjoining
peninsula into our lagoon will necessitate a substantial amount
of dredging. This will result in an offsetting ownership into
the water area. This is not a desirable situation. To allow for
this development, a legal exchange of property between the developer
and San Diego Gas & Electric Company needs to occur,
The development concept and method of property exchange
has been discussed with the developer and we are in agreement in
principle with the project.
If there is some other way in which we can assist as this
project develops, please let me know.
