I would request that the hearing be rescheduled at such time all difficulties have been resolved. MEMORANDUM March 19, 1975 TO: CITY MANAGER FROM: DON AGATEP SUBJECT: PAPAGAYO SPECIFIC PLAN 166 Larry Hunts has recently submitted an application to the City of Carlsbad which would involve the construction of additional condominium units at the Papagayo development. The proposed boundaries of the specific plan encompass that area south of the existing sewer line. It is this specific area which the City previously adopted a specific plan which stated "not a part". It is the same piece of property which the Coastal Commission previously excluded from the Papagayo approval. Mr. Hunts' application for Papagayo additionally involves the 3.2 acres which was offered to the City for dedication as open space. The old Papagayo plan included shoreline modification which would necessitate property exchange with San Diego Gas and Electric. Mr. Hunts, by implication, has stated that all necessary agreements have been reached between San Diego Gas and Electric and other affected agencies. We have a letter on file dated March 10, 1975 from F. W. DeVore, Manager, Engineering Land Department, San Diego Gas and Electric Company, which states that no agreement on property exchange or on mutual use of the water body has been reached. In addition to San Diego Gas and Electric, it would seem that additional correspondence and/or permits as necessary should be received from the State Commission of Bays and Harbors, State Fish and Game Commission, Army Corps of Engineers. Notwithstanding the City's propriety in processing the current specific plan request, the Coastal Commission action which granted Mr. Hunts' project for approval to build north of the sewer line contained two additional provisions: first that the 3.2 acre site be dedicated to the City of Carlsbad and secondly that any project which may be proposed for the area south of the sewer line should be withheld until adoption of the proposed State Coastal Conservation plan. As you know, the preliminary plan is in my office for review. It is anticipated that regional hearings will begin in May. Mr. Hunts, in his offered dedication of the 3.2 acres for open space, indicated that a future option might be to take 3.2 acres of open space/recreational area in a future location. This is not necessarily part of the coastal permit, discussions with the state staff indicate that the 3.2 acres is the minimum dedication for the area north of the sewer line and that additional properties may be required for open space and recreational purposes at such time as develop- ment permits are applied for on property south of the sewer line. -2- At this point, it would seem the City has two options: one is to deny the current specific plan application pending resolution of the issues raised by the Coastal Commission permits, specifically, adoption of the state plan. The other option would be for the City to formally request California Coastal Commission to hear the application and the proposed development prior to the time the City makes any attempt to process the specific plan. Paragraph D, Section 13210 of the California Administrative Code (regulations of the California Coastal Zone Conservation Commission) provides for state or local agencies to specifically request that the Coastal Commission consider the application before it makes a decision. I would suggest that the City request California Regional Coastal Commission, San Diego, hear Mr. Hunts' new proposal prior to the time the City processes the new specific plan for the area south of the sewer line.
