Dear Mr. Grant:
It has been brought to my attention that work currently taking
place on your property is not consistent with Ord. 9298 as adopted
April 18, 1972. Condition No. 8 of the subject ordinance stipu-
lates "Every effort shall be made by the applicant and the ad-
joining property owners to coordinate circulation and architect-
ural theme so as to eliminate conflicting circulation patterns and
architectural treatments".
Parking provisions for both the Standard Oil Service Station and
Sandy's Restaurant were to coordinated as shown on the adopted
Specific Plan. (A portion of the Specific Plan is shown on Exhibit
"A") The coordinated facility is shown on Exhibit "A" and is indi-
cated in black. However, through field inspection of the site,
the actual placement of the parking facility and planter areas is
indicated in red on Exhibit "A".
Prior to the issuance of an occupancy permit, it is mandatory that
you, as representative of Sandy's Restaurant, rectify the situation
as soon as possible. This department will not sign, nor approve,
a request for final inspection until the problem indicated in red on
Exhibit "A" has been corrected.

Uear Mr. Grant:
City of Carlsbad Ordinance -#9298 stipulates the requirement
that landscaping and sprinkler plans shall be submitted to the Parks
and Recreation Director for approval, prior to the issuance of an
Occupancy Permit.
The plans have been submitted to,and approved by the Parks and
Recreation Director, therefore, the Condition of Approval has been
satisfied.
The City will issue the Occupancy Permit for the subject:project,
providing the landscaping program is completed by January 3, 1973.
Confirmation of the completion will be nade by the Planning Department.

agree to do the following work.
1. Change faces on Freeway Sign to read, "Denny's Restaurant".
2. Remove two sets of Sandy's letters from the building and
install one set of standard illuminated "Denny's" letters.
3. Change faces on the Entry Sign.
Prints are enclosed for your approval, indicating these copy
changes.
For your information, the City could grant us a bigger sign
at the Entrance. It would be up to Dennys to make arrangements
as required with the Standard Oil Company. If you could come to
terms a sign such as the one enclosed might be beneficial.

This letter is in reference to the signs for the Denny's
Res-.iaurant at 1048 Elm Avenue, Carlsbad. Based on the
information you gave rr.e when we met last week, the existing,
sigr.s for the Denny's Restaurant have a total area of
approximately 153 square feet. According to our present
sign ordinance the Denny's restaurant would only be allowed
to have a total of 135 square feet. The existing signs
would be considered legal non-conforming uses. The City
cannot approve any acditioncil sign footage on this property
because that would, be a further increase of an existing non-
con fonnance .
If you wish to have a larger directional sign on Elm'Avenue
it vor''.d be necessary that all of the signs be brought into
confora'ance with the existing sign ordinance. This could be
clone by reducing the size of the pylon sign or the signs on
the building itself. ' . .

General Discussion;
The applicants propose to construct a freeway-oriented service
facility at the northwest quadrant of Elm Avenue and Interstate-5.
Existing zoning in the area is R-3 and R-1 to the north, R-3 and
C-2 to the west and the Poinsettia Plaza complex to the south.
The development will consist of a relocation of the existing
Standard 0,il service station and the construction of a new res-
taurant (trade name - Sandy's) located to the north of the
Standard Oil facility and southerly of Grand Avenue.
Mr. Grant oroginally submitted an application for reclassification
in zone from R-1 to C-2 on February 10, 1969. At that time the
parcel that the Standard Oil service facility is located on was
not included as part of the application. The application was
withdrawn January 21, 1970 to allow the applicant to increase
the scope of the development, and indicated that a new applica-
tion with specific plans for development would be submitted
at some future date.
The application being presented at this time is one which includes
the relocation and construction of a new Standard Oil facility.
The proposed development will have access from Elm Avenue, utilizing
two driveway openings, one opening to be utilized jointly by
Standard Oil and Sandy's customers. This opening, approximately
TOO feet from the freeway off-ramp is proposed to be the primary
Ingress and egress for the development. The second driveway,
approximately 200 feet from the freeway off ramp will be located
to the west and serve primarily the Standard Oil customers.

The northerly boundary of the site will front on a cul-de-sac
to be created at the easterly terminus of Grand Avenue creating
a secondary access to the development.
The staff is concerned about the functional use of the primary
point of ingress and egress. Property to the west of the pro-
posed project is currently owned by Mr. Grant and commercial
development is contemplated at some future date. It would seem
logical at this time to develop an internal circulation system
that will benefit the subject proposal as well as any future
commercial development between Elm Avenue and Grand Avenue.
The applicants propose to limit all on-site signing to wall
signs, small eye-level trade signs and small directional signs.
There will also be a freeway oriented pole sign as prescribed
by the City of Carlsbad Sign Ordinance No. 9224.
A 12-foot landscaped area will separate the freeway right-of-
way from the development and additional landscaped areas will
be placed throughout the project.
Recommendation:
The staff recommends approval of the subject application for
the following reasons and subject to the following conditions.
Reasons of approval:
1. The subject development will be in conformance with the
City of Carlsbad General Plan.
2. The development is in the best interest of and will be an
asset to the community.
Conditions of approval;
1. A functional internal circulation system that will benefit
both the proposed development and any future commercial develop-
ment to the west shall be submitted to the Planning Commission
for review,and approval by the City Engineer and the Planning
Department.
a. The circulation system shall include but shall not be
restricted to the following:
1. Traffic at the easterly Elm Avenue entrance to the
development shall be restricted to ingress only for
westbound traffic and to right turns only for traffic
exiting the development.
2. Emergency ingress and egress shall be subject to the
approval of the City of Carlsbad Fire Chief,

2. Landscape and sprinkler system plans, including specifications
for their construction shall be submitted to the Parks and Recrea-
tion Director for approval prior to their installation and prior
to the issuance of an occupancy permit.
3. Schedules for maintenance, designating individual respon-
sibilities for same shall also be submitted to the Parks and
Recreation Director for approval prior to the issuance of an
occupancy permit.
4. All fire hydrants and fire prevention devices shall be subject
to the approval of the City of Carlsbad Fire Chief.
5. The applicants shall increase Grand Avenue to a 70-foot
right-of-way with suitable traffic circulation and cul-de-sac
provided.
6. The applicants shall construct full street improvements
including sidewalk, curb, gutter, ornamental street lights and
street trees on those portions of Elm Ayenue and Grand Avenue
that fall within the confines of the subject development.
7. The applicants shall improve Grand Ayenue from the intersection
of Hope Street to the easterly terminus of Grand Avenue by con-
structing a 50-foot standard street section with A.C. berm
and a 50-foot radius cul-de-sac. Those portions of Grand Avenue
that abutt the proposed development shall be permanently improved
as stated in condition #7.

1. Traffic at the easterly Elm Avenue entrance to the
development shall be restricted to ingress only for
westbound traffic-and to right turns only for traffic
exiting the development.
2. Emergency ingress and egress shall be subject to the
approval of .the City of Carlsbad Fire Chief.

2. Landscape and sprinkler system plans, including specifications
for their construction shall be submitted to the Parks and Recrea-
tion Director for approval prior to their installation and prior
to the issuance of an occupancy permit.
3. Schedules for maintenance, designating individual respon-
sibilities for same shall also be submitted to the Parks and
Recreation Director for approval prior to the issuance of an
occupancy permit.
4. The applicant shall provide a 3000 gallon per minute water
flow at the easterly terminus of the Grand Avenue water line.
All fire hydrants and fire prevention devices shall be installed
as required by the City Engineer.
5. The applicant shall enter into a future improvement agreement
for public improvements on Grand Avenue as outlined below.
Access rights to Grand Avenue shall be dedicated to the City
prior to the issuance of any permit for grading, building or
occupancy. At such time as the adjoining properties to the
west and north develop, the applicant may obtain access rights
to Grand Avenue provided the following improvements are accom-
plished:
a. The applicants shall increase Grand Avenue to a 70-foot
nominal right-of-way with suitable traffic circulation
and cul-de-sac provided.
b. The applicants shall construct full street improvements
including sidewalk, curb, gutter, ornamental street
lights and street trees on those portions of Elm Avenue
and Grand Avenue that fall within the confines of the
subject development.
c. The applicants shall improve Grand Avenue from the inter-
section of Hope Street to the easterly terminus of Grand
Ayenue by constructing a 50-foot standard street section
with A.C. berm and a 50-foot radius cul-de-sac, Those
portions of Grand Avenue that abutt the proposed develop-
ment shall be permanently improved as stated in condition
5b.
d. The applicants shall replace the existing 6<-inch sewer
line in Grand Avenue with an 8-inch sewer line.
6. The development shall generally conform to the proposed
Specific Plan, "Exhibit A", any revisions shall be subject to
the review and approval of the Planning Department.
7. The elevations of structures and on-site signing shown on
"Exhibit. B" shall be adopted as a part of the overall specific
plan.

8. Every effort shall be made by the applicant and adjoining
property owners to coordinate circulation and architectural
theme so as to eliminate conflicting circulation patterns and
architectural treatments.
