Per your request, I am providing the following inf creation

1. The Way-ide Inn Restaurant has 6,130 square feet of floor
area v/hicn requires 83 parking spaces for a restaurant.
2. A field check indicated that there are 46 existing parking
spaces in the lot immediately adjacent (south and east) to
the restaurant.
3. The 93' x 70' parcel to the east of the restaurant, which I
understand that Watson is proposing to subdivide, contains 18
parking spaces.
4. The 93' >c 70' parcel is part of a specific plan for the
restaurant (SP-25(A)) and was rezoned to C-2 concurrent with
being added to the specific plan and becoming a part of the
restaurant property. At the same time, the restaurant was
allowed to expand (870 square feet).
5. It appoars that it would require an amendment to SP-25(A) in
order to subdivide all or a portion of the 93' x 70' parcel
from the restaurant property.
G. A field check indicated that there are 45 existing parking
spaces on the Colonial Kail property.

I. REQUEST: The applicant is requesting approval of:
(1) A Zone Change from R-l-7500 to C-2 on a 6,507 sq. ft. piece of
property;
(2) An amendment to existing Specific Plan No. 25 to allow that piece
of property being rezoned to become part of that specific plan
(for additional parking purposes) and also to allow an 870 sq. ft.
addition to the existing restaurant building;
on property located at 3150 Pio Pico Drive, between Elm Avenue and Oak
Avenue.
II. RECOMMENDATIONS:
A. Zone Change 152 - Staff recommends that ZC-152 as shown on the
plot plan labeled Exhibit A, dated 1/31/75, be APPROVED based on
the following justifications:
(1) The zone change complies with the Carlsbad General Plan and
Public Facilities Policy.
(2) The zone change complies with all Municipal Code requirements.
B. Specific Plan 25(A) - Staff recommends that SP-25(A) be APPROVED
based on the following justifications:
(1) The amendment is consistent with the adopted Specific Plan for
the project.
(2) The additional parking will help relieve crowded conditions for
the existing parking.

SUBJECT: SP-25(B) - TIP PEPE'S - Amendment to an existing
specific plan to allow the addition of a 1740 square
foot patio on property generally located on the east
side of Pio Pico Drive, between Elm Avenue and Oak
Avenue.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2248 recommending APPROVAL of SP-25(B)
based on the findings and subject to the conditions contained
therein.
II. PROJECT BACKGROUND AND REQUEST
In May 1975, the City Council approved a zone change and
specific plan amendment to add a 6507 square foot lot to an
existing specific plan and to increase the existing restaurant
by 850 square feet.
In early 1982, the new owner of the restaurant (Tio Pepe's)
increased the square footage of the building by constructing a
1740 square foot patio without applying for a specific plan
amendment. An agreement between the new owner and the City
allowed the restaurant to continue operations on the condition
that the owner close off the second floor of the restaurant and
apply for a specific plan amendment to try to increase the
parking required by the addition of the patio, which is the
purpose of this application.
The applicant is requesting an amendment to an existing specific
plan to allow the addition of a 1740 square foot patio.
III. ANALYSIS
Planning Issues
1} Will parking be adequate to accommodate the
addition of the patio?
2) Will the proposed project have any effect on the
surrounding land uses?
Discussion
Before construction of the patio, 68 parking spaces existed on
the site. After construction of the patio, 8 parking spaces
were deleted, thus reducing the amount of parking spaces
available, with the addition of the patio, a total of 118
parking spaces would be needed on the site. Sixty parking
spaces are currently available on the site; but with a
reciprocal agreement made with the Colonial Mall, 45 extra
spaces can be added at night. The 105 spaces available are not
sufficient enough for the amount of spaces needed (118).
The applicant, in the application, proposes to justify the
addition of the patio by closing off a 650 square foot section
of the existing dining room, thus reducing the amount of
parking spaces needed to 105. Staff has some concerns with this
proposal. With the potential increase in business, the
possibility to open up the closed off section exists, thus
creating a need for more parking spaces. This need could lead
to customers parking at near by business or residential areas.
Staff feels a portion of the patio could be kept open if the
deleted parking spaces were redesigned into the existing parking
lot. Staff has designed two alternatives which would require 95
parking spaces. The first (Exhibit "X") shows the restaurant
with a 600 square foot patio. This proposal reduces the size of
the patio and has better traffic circulation (one-way) around
the restaurant but would only increase the amount of parking
stalls available from 60 to 64. The second proposal (Exhibit
"Y") also reduces the patio to 600 square feet. The circulation
would be the same as exists, but would increase the amount of
parking available from 60 to 73.
Section 21.44.165 of the Municipal Code states the parking
requirements using a common parking facility can be reduced by
15 percent. This being the case, the combined amount of parking
spaces needed for the restaurant and Colonial Mall is 110. When
subtracting the existing 45 spaces at the mall, a total of 65
spaces would be needed at the restaurant site. Proposal "X" (64
spaces) leaves the site one parking space short of the amount
needed, while proposal "Y" (73 spaces) leaves the site eight
spaces more than needed. Staff feels it could support both
alternatives, but that proposal "Y" would be the better
alternative by the fact that the extra eight parking spaces
could alleviate future parking and traffic problems should the
daytime business of the restaurant increase.
Overall, staff feels that the appliant's proposal (Exhibit "A")
could create parking and traffic problems and, therefore,
recommends approval based on staff's alternative "Y" as
discussed above.
