1. Does public necessity require the proposed change? Is there a real need
in the community for mere of the types of uses permitted by the Zone
requested than can be accommodated in the areas already zoned for such uses?
It is our opinion that the public and the community will be better served
as a result of this change.
2. Is the property involved in the proposed reclassification more suitable for
'the purposes permitted in the proposed zone than for the purposes permitted
in the present' classification?
-Yes, our restaurant faciti-ity is primarily a family type establishment with
the convenience of a cocktail lounge. As we have a banquet room for service -
clubs & civic groups this would not be permitted in the present zone.
Would the uses permitt'—7 by the proposed zone be Detrimental in any way
to surrounding propert^
No, in our opinion, our proposed development will greatly improve the
area and be a credit to the community.

This letter is to inform you that your restaurant is covered
under Specific Plan 27. The ordinance approving this action
stipulates that, "no other use shall be allowed upon said
property until Specific Plans for it have been submitted and
approved by the City Planning Commission and the City Council."
This means that you would have to submit an application to amend
Specific Plan 27 to include dancing as a permitted use. This
application and the necessary paperwork may be obtained at the
Development Processing Counter. We will be happy to assist you
in any way we can.

AND ADOPTION OF A SPECIFIC PLAN FOR THE CONSTRUCTION
OF A RESTAURANT ON PROPERTY LOCATED AT 850 TAMARACK
AVENUE
APPLICANT: JOHN C. MABEE
Report submitted by: City Manager, Engineering, Fire, Building,
Parks & Recreation and Planning
General Discussion
The property is located at the northwest quadrant of Interstate-5
and Tamarack Avenue.
The property is presently zoned C-l with a Specific Plan adopted
on the property for a restaurant facility.
The proposed facility is primarily a family-type establishment
with the convenience of a cocktail lounge, which would not be
permitted in the present zone.
Recommendations
It is the recommendation of the staff that the proposed reclas-
sification from C-l to C-2 and adoption of a specific plan be
approved for the following reasons and subject to the following
conditions:
Reasons of Approval
1. This proposal would be a welcomed asset to the City of
Carlsbad.
2. It is of the best interest of the citizens of Carlsbad.
Conditions of Approval
1. The development of subject property shall conform to all
ordinances of the City of Carlsbad unless the Specific Plan
Exhibit "A" and/or the following conditions are more restrictive.
2. A complete landscape plan shall be submitted to the Planning
Department for approval prior to the issuance Qf any building
permit.

3. Freeway service signs shall be limited to one(l) freestanding
pole sign to be used by both the service station and the
restaurant facilities, and shall comply with the City of
Carlsbad sign ordinance.
4. A grading plan showing drainage provisions shall be approved
by the City Engineer prior to construction.
5. The parcel shall be monumented by a registered engineer or
land surveyor.
6. Vehicular access to this parcel shall be limited to
Tamarack Avenue. The existing driveway approach shall be
utilized for access to the property.
7. A five foot pedestrian walk shall be provided on Sandra
Place for emergency fire access.
8. One(l) parking space shall be provided for every one
hundred(lOO) square foot of gross floor area.

Subject: Daisey's Restaurant, Landscaping
Dear Mr. Mabee:
City of Carlsbad Ordinance #9300 stipulates the requirement
that landscaping and sprinkler plans shall be submitted to the Parks
and Recreation Director for approval, prior to the issuance of an
Occupancy Permit.
The plans have been submitted to, and approved by the Parks and
Recreation Director, therefore, the Condition of Approval has been
satisfied.
The City will issue a temporary Occupancy Permit for the subject
project, providing the landscaping program is completed by flprjl 15 ^ 1973
1973. Confirmation of the completion will be made by the Planning
Department, and at that time an Occupancy Permit issued.
