Dear Mr. Agatep:
Your request for our recommendations concerning a Tentative Map
of a subdivision submitted by Adelson and Associates has been
received and reviewed by this department.
This would be acceptable to the Department of Public Health
provided:
1. All domestic water supplied to this subdivision comes from
the Carlsbad City Water Company.
2. All buildings constructed in this subdivision are connected
to the Carlsbad Public Sewer System.
3. The sewer and water lines are not laid in the same trench in
any part of this subdivision.
k. Proper drainage is maintained throughout the subdivision so
as to prevent ponding and/or storage of surface water.

the 10 story high rise project proposed next door to my home on Ocean
Street.
I had hoped I was being unbiased and objective in ny opposition to the
proposal but all of us are apt to see things in a slanted fashion when
our personal interests are directly involved. Your unanimity was most
encouraging because I am not opposed to orderly growth and progress
either in our fine city or ny immediate neighborhood and hoped I was
being constructive in my attitude and not obstructive.

Section I - General Discussion
The applicant proposes to construct a 10 story, 75 unit
condominium apartment complex on the westerly side of Ocean
Street, between Elm Avenue and Grand Avenue.
The subject property contains 46,900 sq. ft. (1.07 acres)
and has 335 feet of frontage along Ocean Street. The existing
zoning is R-3, as is zoning to the north, south and east.
General Plan Residential Densities amended in 1970 placed
the density between Beech Avenue and Oak Avenue, A.T. & S.F.
Railroad right of way and the Pacific Ocean at 70 d.u./acre.
This is compared to the Tourist Resort Land use indicated in
the master plan prepared by D.M.O.M. in 1966.
Under existing R-3 zoning, the applicant would be allowed
to construct 55 dwe'll ing units and be governed by a 35 foot
height limitation. The 35 feet is measured from the center-
line of Ocean Street. The requested zone change to RD-M
would provide for 75 dwelling units on 1.07 acres and necessi-
tate a specific plan approval for the proposed height of 10
stories which will be approximately 50-55 feet above Ocean Street
The project proposes 75 one and two bedroom units with a
three story parking structure between the residential structure
and Ocean Street. Two levels of the parking structure will be
below the level of Ocean Street. The parking ratio as estab-
lished, will comply with the City of Carlsbad Parking Ordinance.
The water lines in Ocean Street are sufficient to serve
the proposed development. The sewer line can accomodate pro-
jected sewer flows provided the effluent is injected into the
sewer system at low peak flow periods by a mechanical timing
device.

Staff Report
Circulation for the units will be handled by two entry
points along the northerly property line at the Ocean Street,
Grand Avenue intersection. An additional point of ingress
and egress will be provided between the southerly half of the
Ocean Street frontage and Elm Avenue,
Ocean Street has a 40 foot right-of-way with approximately
24 feet of pavement. Grand Avenue has a 100 foot right-of-way
with 30 feet of paving, without curb or gutter. Elm Avenue
has an 80 foot right-of-way with 30 feet of paving and without
curbs, cutters or sidewalks.
Ocean Street is narrow and relatively unimproved at this
point in time, ultimate design and established street grades
have not been set by the City Engineering Department.
Technically, the proposal can be served by existing ser-
vices' and;by improvements required of the developer by the
City.
The issue of building heights in excess of thirty-five
feet doe_s_ not materially affect the proposed development, and
therefore should not be a factor when discussing the ability
of City services to accomodate the subject proposal.
Section II - Recommendations
The Staff recommends approval of the subject applica-
tion for the following reasons and subject to the following
conditions.

tions set in the General Plan.

3. A landscape and sprinkler plan shall be submitted to the
Parks and Recreation Director, and shall be subject to
his approval prior to installation and prior to issuance
of an occupancy permit.
4. Public access as required by State law shall be provided
from Ocean Street to the beach front.
5. All sanitary collection areas shall be so located to
allow easy removal and shall be so indicated on a plot
plan, Exhibit "A".
6. Applicant shall file a subdivision map in accordance with
the Subdivision Map Act.
7. Applicant shall install full street improvements to street
centerline as required by the Subdivision Ordinance.
Improvement plans shall be prepared by a registered Civil
Engineer.
8. Applicant shall install fire hydrants and on site pro-
tection appurtenances as required by the Fire Department.
9. A holding tank for sanitary sewerage, sufficient for 24
hours storage, shall be installed. A timing system sat-
isfactory to the City Engineer shall be provided to limit
operation of tank pumps for discharge to off peak flow
periods;
10. Additional street rights of way up to 10' maximum as may
be required for street widening shall be dedicated to the
City free of all liens and encumberances. The required
dedication will be used for sidewalk and/or landscaped
parking easements.
11. A sidewalk/stairway shall be constructed in Grand Avenue
from Ocean Avenue to the beach. Design shall be subject
to approval of the City Engineer.
