I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6181 APPROVING SUP 06-10, based upon the findings and subject to the conditions contained therein. II. INTRODUCTION Cabrillo Power I LLC, the owner and operator of the Encina Power Plant, located on the Agua Hedionda Outer Lagoon, has submitted an application for a Floodplain Special Use Permit (SUP) to allow: I) periodic maintenance dredging of the Agua Hedionda Outer Lagoon, and 2) placement of the dredged sand on Carlsbad beaches. The project is consistent with the City's General Plan, as well as all other applicable plans and regulations, and can be supported. III. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of a Floodplain Special Use Permit (SUP) to dredge the "outer" lagoon of the Agua Hedionda Lagoon. The outer lagoon is that portion of the lagoon adjacent to the ocean between Carlsbad Boulevard and the railroad track trestles, including the ocean water intake channel between the northerly set of jetties. The periodic dredging is necessary to ensure that an adequate supply of cooling ocean water is available for the operation of the Encina Power Plant. Agua Hedionda Outer Lagoon is located within Zone A of the Federal Emergency Management Agency's (FEMA) maps denoting areas of special flood hazard. Floodplain Management Regulations (Chapter 21.11 0) of the Carlsbad Municipal Code (CMC) contains regulations applicable to development in or adjacent to areas identified as special flood hazards. Section 21.110.130 of the CMC requires a Special Use Permit be obtained for any development, including maintenance dredging of the lagoon, within a special flood hazard area. The purpose of the regulations is to ensure development activities do not aggravate flood potential. The entire Agua Hedionda Lagoon is located within the Agua Hedionda segment of the City's Local Coastal Program, where the California Coastal Commission has retained permitting 1'\ "'•+' r, -~ SUP 06-10-AGUA HEDION!'r'A OUTER LAGOON MAINTENAN& October 18, 2006 Pa e 2 authority. The applicant will therefore be applying for a Coastal Development Permit (CDP) for the dredging activity and sand placement directly from the California Coastal Commission. Dredging operations in the lagoon have been conducted routinely since 1954 -the year SDG&E built the lagoon and constructed the Encina Power Station facility. The dredging is performed to remove sediment transported into the lagoon through the existing inlet jetty. The dredging allows for the maintenance of the prism design required to provide the Encina Power Station with an adequate volume of seawater for cooling purposes. Dredging of the lagoon has occurred in the past under previously issued City permits (SUP 92-04 and SUP 0 1-02). The dredging operation has historically consisted of removing varying amounts of sand from the intake channel and the outer lagoon, performed at varying frequencies, and the placement of dredged sand on the beach to the north and south of the inlet. Dredging of the lagoon requires a number of permits, beyond those issued by the City, including permits issued by the Army Corps of Engineers, California State Lands Commission, California Regional Water Quality Board, California Department of Parks and Recreation, and as mentioned above, the California Coastal Commission. The term of permits previously issued by these agencies have ranged from one-year (single event) to multi-year (multi event) permits. The prior City permit was issued for multi-events and for a period of five years. The last permit issued by the City expired May 16, 2006. The last dredging of the outer lagoon was completed in Apri12005, which resulted in the removal of 348,151 cubic yards of sand. That dredging activity was authorized by the California Coastal Commission in August of 2004 under CDP 6-04-054. The California Coastal Commission conditionally approved the project consisting of: 1) a single event dredge of up to 500,000 cubic yards of sand from the outer lagoon bottom and intake channel; and 2) the placement of that sand on Carlsbad beaches in a manner consistent with the recommendations of a study regarding beach sand transport. The report, entitled "Study of Sediment Transport Conditions in the Vicinity ofthe Agua Hedionda Lagoon" (October 1999), was prepared by an independent Coastal Engineer in response to a prior California Coastal Commission requirement of the Encina Power Plant owner. The study looks at average historical sedimentation rates and conditions in and around the lagoon and the adjacent beaches. The study concludes, based on a variety of scientific and public benefit considerations, that 30% of the dredged sand be placed on North Beach (i.e. the portion of Carlsbad Beach between Oak and Cherry Streets); and the remaining 70% be divided between Middle Beach (between the intake, northerly jetties and the outfall, southerly jetties) and South Beach (south of the outfall jetties). The dredged material (slurry) would be pumped through a floating 20-inch diameter pipeline. For delivery of dredged material to the North Beach, the pipe would float on the lagoon, under the Carlsbad Boulevard Bridge, and would connect to above ground, temporary pipes, which would be placed along the beach. For South Beach disposal, the pipe would float on the outer lagoon and connect to existing underground piping under Carlsbad Boulevard. The pipes would be extended along the surface of Carlsbad State Beach to reach the south side of the Encina Power Station discharge jetty. Temporary dikes and berms would be used to dewater the slurry. Bulldozers and front-end loaders would then be used to spread the sand on the beach. Equipment and material staging would occur on the north and west shores of the outer lagoon along the shore. SUP 06-10-AGUA HEDION~A OUTER LAGOON MAINTENANg October 18, 2006 Pa e 3 In addition, a public trail will be constructed on the northern portion of the bank of the outer lagoon, where an existing access road is, as a condition of approval for the construction of HUBBS Sea World Research Institute (CDP 6-93-113 issued by the California Coastal Commission April 1994) and the previous dredging permits (SUP 92-04 & SUP 01-02 issued by the City of Carlsbad). The trail will run from Carlsbad Boulevard to the railroad trestles. Attached is a time line for the completion of the trail. The current proposal is a request for a five year, multiple event permit, to dredge up to 500,000 cubic yards in any single event within the existing dredge limits, and to place the dredged sand on the North, Middle, and South Carlsbad beaches adjacent to Agua Hedionda Outer Lagoon. Consistent with the prior City issued permits, and given the unpredictability of beach sand movement and accumulation resulting from El Nino weather patterns, staff recommends the term of the permit be for five years. Also, because of the previously mentioned circumstances, a specific sand quantity to be dredged cannot be identified since historically the average daily sand influx rate is calculated at 400+ cubic yards per day, but can range up to 800+ cubic yards per day based on background conditions and storm and wave energies. Specific quantities will be evaluated in conjunction with specific dredge event requests by the other permitting agencies, the City's Engineering Department and the City's Beach Preservation Committee (BPC). This is consistent with past practices. With regard to the placement of sand on the beach, the applicant has agreed to continue to implement the recommendations of the sediment transport study including the specified percentages for the three beach areas. A condition of approval has been included accordingly. Other conditions of approval represent an update of the previous SUP conditions of approval. Included in these conditions is the requirement for the installation of trail improvements along the north shore of the Agua Hedionda Outer Lagoon. This project was reviewed by the City's BPC for consideration on September 12, 2006, where it was recommended that the project be conditionally approved. This project is subject to the following plans and regulations: A. City of Carlsbad General Plan and Open Space Zone (Chapter 21.33); B. Floodplain Management Regulations (Chapter 21.110) and Special Use Permit Procedures (Section 21.11 0 .130); C. Local Coastal Program and Coastal Resource Protection Overlay Zone (Chapter 21.203). IV. ANALYSIS Staff developed its approval recommendation after analyzing the project's consistency with the applicable City plans and regulations listed above. A discussion on compliance with each follows. A. City of Carlsbad General Plan and Open Space Zone The project is consistent with the City's General Plan and the project site's Open Space Zoning. A number of goals, policies, and objectives are identified in the Land Use, Parks and Recreation, Open Space and Conservation, and the Public Safety elements of the General Plan which call for SUP 06-10-AGUA HEDIO~A OUTER LAGOON MAINTENAN9 October 18, 2006 Pa e 4 the preservation and enhancement of the Carlsbad beach and the lagoons. General Plan and Zoning consistency findings can be made for the project as follows: 1. The project is consistent with the Parks and Recreation Element (i.e. Goals, Objectives and Policies B.6 and C.ll) of the General Plan in that the placement of dredged sand on the beach, and the construction of trail improvements along the north shore of the outer lagoon, will enhance public recreation opportunities by increasing the size (square footage area) of useable public beach and by formalizing a public trail along the north shore of the outer lagoon. 2. The project is consistent with the Open Space and Conservation Element (i.e. Goals, Objectives, and policies A.1, A.2 A.3 and A.4) of the General Plan in that dredging the outer lagoon and the intake channel, in particular, will allow for the continued flow of fresh, nutrient-rich ocean waters into the lagoon thereby maintaining/improving the overall health of the lagoon; and the placement of dredged sand on the beach will enhance and protect important City open space resources by assisting in the build up of a deteriorating beach profile and by creating a wider beach which will assist in the protection of coastal bluffs from erosion caused by ocean wave action. 3. The project is consistent with the Public Safety Element (Goal A) of the General Plan in that the placement of dredged sand on the beach will increase beach width which will assist in the protection of coastal bluffs from erosion caused by ocean wave action, thereby protecting private and public property in the vicinity of the beach. 4. The project is an allowable activity/use in the Open Space Zone and complies with all its standards in that the dredge activity, placement of sand on the beach, and trail improvements along the north shore of the outer lagoon will maintain/improve the overall health of the lagoon by dredging the intake channel and ensuring the continued flow of fresh, nutrient-rich ocean waters into the lagoon; enhance the quality of the beach by placing dredged sand on the beach, thereby assisting in the build up of a deteriorating beach profile; and by formalizing public access to open space areas through installation of trail improvements. B. Floodplain Management Regulations and Special Use Permit Procedures The project complies with the requirements of the Floodplain Management Regulations and Special Use permitting procedures as demonstrated in the following finding: 1. The proposed lagoon dredge will not create a hazard or adversely impact development, or adjacent and upstream properties and structures; and the cumulative effect of this project and the adjacent approved projects will not significantly raise the level of the 100 year flood plain (base flood elevation) in that the dredge activity will increase the physical capacity of the lagoon and therefore the ability of the lagoon to accommodate flood waters. C. Local Coastal Plan and Coastal Resource Protection Overlay Zone , CJ SUP 06-10-AGUA HEDION'rr'A OUTER LAGOON MAINTENANC1: October 18, 2006 Pa e 5 Although the required CDP will be processed through the California Coastal Commission, staff has analyzed the project for compliance with pertinent regulations. The project complies with the Local Coastal Program and Coastal Resource Protection Overlay Zone requirements as discussed below: 1. The project is in conformance with the Certified Local Coastal Program and all applicable policies in that dredging the outer lagoon and the intake channel, in particular, will allow for the continued flow of fresh, nutrient-rich ocean waters into the lagoon, thereby maintaining/improving the overall health of the lagoon; and the placement of dredged sand on the beach will enhance and protect coastal resources by assisting the build up of a deteriorating beach profile and by creating a wider beach, which will assist in the protection of coastal bluffs from erosion caused by ocean wave action. 2. The project is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act in that the placement of dredged sand on the beach, and the construction of trail improvements along the north shore of the Agua Hedionda Outer Lagoon, will enhance public recreation opportunities by increasing the size (square footage area) of useable beach and by formalizing public access to coastal resources by installing trail improvements along the north shore of the outer lagoon. V. ENVIRONMENTAL REVIEW Pursuant to Section 15304 of the California Environmental Quality Act (CEQA) Guidelines, the project is categorically exempt from the provisions of CEQA. Section 15304(g) specifically exempts "maintenance dredging where the spoil is deposited in a spoil area authorized by all applicable state and federal regulatory agencies." ATTACHMENTS: 1. This trail is a condition of the Hubbs-Sea World Research Institute (HWSRI) California Coastal Corrunission (CCC) Coastal Development Permit (CDP) number 6-93-113. .AB such the trail also became conditions of the City of Carlsbad (C of C) Special Use Permits (SUP) 92-04 and 01-02 obtained to dredge the outer Agua Hedionda Lagoon (AHL). SUP 92-04 was obtained by San Diego Gas and Electric (SDG&E). SUP 01-02 was obtained byCabrillo Power I LLC (Cabrillo) subsequent to the sale of the Encina Power Station to Cabrillo by SDG&E. This trait will also be a condition of the pending C of C SUP 06-10 . .AB a condition of the HWSRI CCC permit referenced above, a dedication of land for the use of the public was required. This Offer to Dedicate (Dedication) was obtained from the CCC by SDG&E on June 30, 1994. The Dedication requires a mWlicipality or non-profit organization to accept the Dedication and the requirements delineated therein. To date no qualifying entity has accepted the Dedication. The documents referenced above collectively describe specific requirements for the trail development. The trail must be consistent with the C of C Open Space and Ccmservation R{eyource Management Plan dated June 1992. The trail must also be consistent with the Public Access Plan, a condition of the SUP 92-10. The trail must consist of a twenty-five (25) foot easement as described in the Dedication, with a ten (10) foot wide improvement within the easement. This improvement must include two benches, two bike racks, pertinent interpretive signage, and be paved or covered with decomposed granite. The COP 6-93-113 specifically states that the trail improvements will be complete within one hundred and twenty (120) days of acceptance of the Dedication. PROJECT PLAN As represented in the enclosed project schedule, many milestones must be met in order to meet the CDP 6-93-113 time line. An outline of these milestones and tasks will be delineated. Cabrillo is working with the C of C, a municipality to enable the C of C to accept the Dedication. The C ofC documents will be filed with the CCC to show the C ofC's acceptance of the Dedication. Whether the CCC will require public meeting approval of the Dedication is unknown at this time. In parallel with the Dedication process, Cabrillo will develop the documented construction package necessary to construct the improvement. These documents include, but are not limited to, engineering construction drawings, procurement and construction specifications, and an approved bidder's list(s). The goal is to have this package complete at the same time as the Dedication to ensure timely project completion. A C ofC construction pennit will not be required as this project is covered under SUP 06-10. After construction package approval, the package will be bid and an approved contractor awarded. Construction and improvement may begin at this time. The final construction will be complete within the time frame delineated in the CCC CDP 6-93-113. S. Henika.
