SUBJECT: AV 02-01 - SERA6 RESIDENCE
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Administrative Variance, application no. 02-01, as to its
completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. AI1 list items must be
submitted simultaneously and a copy of this list must be included with your submittals.
No processing of your application can occur until the application is determined to be
complete. The second list is issues of concern to staff. When all required materials are
submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will
be initiated. In addition, please note that you have six months from the date the
application was initially filed, 3/28/02, to either resubmit the application or submit the
required information. Failure to resubmit the application or to submit the materials
necessary to determine your application complete shall be deemed to constitute withdrawal
of the application. If an application is withdrawn or deemed withdrawn, a new application
must be submitted.

Planning:
For reasons explained below, staff will be unable to recommend approval of your variance
request. Should you decide to proceed, the current application submitted for the
administrative variance must be withdrawn and a standard variance application should be
applied for in its place. An administrative variance only allows for a 75% reduction of a.
required yard. The requested variance calls for a reduction greater than 75%.
Fees for a standard variance are $1860, Should you decide to proceed, the following
revisions to your site plan will be required.

Distance between existing detached garage and existing house
Show breezeway connecting existing house to existing garage
Approximate location of adjacent structures on adjacent lots
Show all paved areas on plot plan
Provide a summary table on plot plan showing: site acreage, existing zoning and
land use, building coverage existing and proposed, square footage of all structures,
number of parking spaces
Label property lines and property line dimensions
correctly label detached garage on Carport and Shed Elevation plan, currently it is
identified as " existing house ".
Engineering:
1. Please submit a recent Preliminary Title Report (PR) for the property. The PR
should be dated within 6-months of the project submittal date.
Please show all easements and encumbrances as indicated in Schedule "B" of
the PR. Indicate the future disposition of all easements and encumbrances (i.e.,
"to remain," "quitclaim," etc.) on the site plan.
Please show the bearings and distances of the parcel boundary on the site plan
in accordance with the legal description in the PR.
Please show existing topography and drainage patterns for the site. Show this
information on the site plan for 50-feet around the perimeter of the site. Please
show the locations of any existing slopes or drainage ditches.

Staff has conducted a review of the project for engineering issues of concern. Engineering
issues that must be resolved or adequately addressed prior to staff making a determination on
the proposed project are as follows:
ISSUES OF CONCERN
Planning:
Should you decide to proceed with the standard variance request, you should be aware
that staff will be unable to recommend approval of the variance because the necessary
findings cannot be made.
1. There are not exceptional or extraordinary circumstances or conditions applicable to
the property or intended use that do not apply generally to other properties in the
same vicinity and zone. The subject property has no significant topographical
features which would justify the use of the front yard as a parking/building area,
and the lot is of adequate size and shape to facilitate parking in the areas permitted
by the zoning ordinance. In addition there also exists adequate space for the air
compressorlenclosure within the permitted building envelope.
2. The requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property owners in the same vicinity
because more than adequate parking commensurate with residential use currently
exists on the subject property. The property currently has one two-car garage as
well as a second oversized garage that could house at least two additional vehicles.
Additional paved parking area also exists in the side yard setback. Surrounding
properties have single two car garages and maintain the required front yard setback.
3. The granting of the variance is injurious to the neighboring property because the
carport is being constructed on the front property line and has effectively eliminated
a substantial portion of the required front yard setback. The compressor enclosure
also encroaches into the rear yard setback, Setbacks are designed to maintain
adequate space between buildings and uses to ensure light, health, safety, and
general welfare.
Engineering:
Traffic & Transportation
1. Please show James Drive on the site plan. Show the dimensions and existing
improvements.
Gradina & Drainaae
1. Please be advised, City standard GS-15 requires a minimum 5-foot offset to any
flow line from any structure. The site plan shows less than this 5-foot standard
for both structures.
2. Please label the block walls that are being shown on the site plan as existing or
proposed.
Miscellaneous
1. Please label Section A-A and B-B, and show dimensions and the property line, as
indicated on the redlined check print.

Will the "porch structure" have rain gutters?
Please have the project Civil Engineer and Architect sign and date the site plan.
Please add a Vicinity Map to the site plan.
Please label the site plan as AV 02-01, Sheet's 1 and 2 of 2.
Enclosed for the applicant's use for making the requested revisions is a redlined
check print of the project. This check print must be returned with the revised
plans to facilitate continued staff review.
