PLANNING COMMISSION RESOLUTION NO. 1680
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A VARIANCE
TO ALLOW A REDUCTION OF THE FRONT YARD SETBACK TO
TN FEET GENERALLY LOCATED ON THE SOUTHWEST
CORNER OF GARFIELD STREET AND MAPLE AVENUE IN THE
R-3 ZONE.
APPLICANT: GROSSE
CASE NO: V-305
WHEREAS, a verified application for certain property, to wit:
Lots 15, 16, & 17 in Block fDT! of Palisades in the
City of Carlsbad, County of San Diego, according to
the Map Thereof No. 1747, filed in the Office of the
County Recorder February 5, 1923
jhas been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 2Iof the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 13th day of
'August, 1980, hold a duly noticed public hearing as prescribed
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to V-305.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows: -
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends DENIAL of V-305, based on the
following findings:
Findings
1) There are no exceptional or extraordinary circumstances
applicable to the property that do not apply to other
property in the same vicinity and zone since the property is
very similar to the majority of lots in the area being
relatively flat and regular in' its rectangular shape and size.

2) Other properties in the same vicinity and zone do not share
a property right denied to this property since approval of
the variance is not necessary to develop the lot at the
requested density and designs It appears that all other
development in the area complies with setback requirements.
3) Approval of the variance could set a precedent in a high
density, sensitive beach area which could then adversely
affect the General Plan and be detrimental to the public
welfare.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 13th day of August, 1980, by the following vote, to wit:
AYES: Schick, Friestedt, Rorubotis, Marcus, Leeds and Jose
NOES: None
ABSENT: Larson
