I. PROJ ECT DESCRIPTION The applicant is requesting a variance of Section 21.10.080 of the Zoning Ordinance to reduce the required lot width for two 7500 square foot lots from 60' to 58.5' on property located as described above. The applicant's intent is to subdivide a large squarely shaped lot into two lots which would generally conform to the surrounding lots in the vicinity. 11. ANALYSIS Planning Issues 1. Can the four mandatory findings for a variance be made this case? Specifically: Are there exceptional or extraordinary circum- stances or conditions applicable to the property that do not apply generally to other properties in the same vicinity and zone? Is the granting of this variance necessary for the preservation and enjoyment of a substantial prop- erty right possessed by other properties in the same vicinity and zone? Will the granting of this variance be detrimental or injurious to the public's health and welfare? Will the granting of this variance adversely affect the General Plan? I11 . DISCUSSION Exceptional or extraordinary circumstances or conditions appli- cable to the property that do not apply to other properties is the first finding that needs to be dealt with. The lot, being relatively square, has a non-conforming shape as compared to the rectangularly shaped lots in the vicinity; thus, by subdividing, the applicant would create two rectangularly shaped lots, though not 60' in width. These lots would substantially conform with the rest of the lots in the vicinity. The lot in question, therefore appears to be exceptional since all other lots in the block are rectangularly shaped. The second issue is whether the applicant is being denied a prop- erty right possessed by other properties in the vicinity. A check of the vicinity shows that various lots have lot widths that are smaller in width than that asked for by the applicant. This being the case, staff has found that the applicant is being denied a property right possessed by other properties in the vic- inity. By granting this variance, neither the public's health and welfare nor the general plan will be adversely affected. In summary, staff feels that this request has fulfilled the four necessary findings for a variance and, therefore, staff recommends approval of this project. IV. ENVIRONMENTAL REVIEW This project is exempt from environmental review per Section 19.04.070(F)(4)(A) of the Environmental Ordinance. V. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 1936 APPROVING V-335 based on the findings contained therein. ATTACHMENTS 1. PC Resolution No. 1936 2.
