SUBJECT: V-350 - DECKELMAN - Request for a variance to permit a
216 foot driveway for two panhandle lots at 1448 Forest
Avenue.
I. RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolution
No. 2219 APPROVING V-350.
11. PROJECT DESCRIPTION
The applicant is requesting a variance to permit a 216 foot
driveway so that a panhandle lot can be created on property
located at 1448 Forest Avenue (see location map). The property is approximately -89 acres in size and has a frontage of 138 feet. The property is zoned R-1-7500 and this zone permits a maximum 150 foot long driveway off a panhandle lot. The location of the existing house and garage prohibit a driveway of lesser length.
There are three panhandle lots already existing in the block of Forest between Highland Drive and Pi0 Pic0 Drive. A variance was approved at 1355 Forest Avenue reducing a side yard setback to allow the creation of a panhandle lot.
111. ANALYSIS
Plannina Issues
1) Can the four mandatory findings for a variance be made as
they relate to this case? Specifically:
(a) Are there exceptional or extraordinary circumstances or
conditions applicable to the property that do not apply
generally to other property in the same vicinity and
zone?
(b) Is the granting of this variance necessary for the
preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone?
(c) Will the granting of this variance be detrimental to the
public welfare?
(d) Will the granting of this variance adversely affect the General Plan?
Discussion
Staff feels that all four findings for a variance can be made for
the subject property. Extraordinary circumstances exist in that
the panhandle lot cannot meet ordinance requirements because of the location of the existing house and garage. The house and garage were built sometime around the turn of the century and are listed in the city's Historical Survey.
Staff also feels that a variance is necessary so that the
applicant can enjoy a property right possessed by others in the same area. There are currently three other panhandle lots within the applicant's block. One of those lots has a driveway in excess of 200 feet.
Finally, staff does not feel that the granting of the variance will be detrimental to surrounding properties and will not
adversely affect the general plan. For these reasons, staff is recommending approval of V-350.
IV. ENVIRONMENTAL REVIEW
This project is exempt from environmental review per Section
19.04.070(6)(D)(i) of the Environmental Ordinance.
