SECTION I. RECOMMENDATION It is recommended that ZC-194 be APPROVED for the following reasons: 1. General Plan Consistency: The proposed zone change is consistent with the general plan because: a. The Land Use Plan Map designates this area as Travel Service. b. The zone change will have no adverse affect on any element of_the general plan. 2. Environment: The proposed zone change is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because a Negative Declaration has been issued for the following reasons: a. The zone change is mandatory under the provisions of Section 65860 of the government code. b. The zone changes will not effect the existing environment. 3. Public Facilities: The proposed zone change is consistent with applicable City public facility policies and ordinances because the subject change will not result in impacts on City Public Facility availability. SECTION II. BACKGROUND . 1. Location and Description of Property: (See Exhibit A & B) The area of the proposed zone is made up of 15 parcels just west of I-5 between Elm and Grand. The area is generally flat but slopes slightly at the east end. The area contains a number of structures both residential and commercial. 2. Existing Zoning: Subject Property: North: C-7 R~3 & I-~ Freeway South: C-2 East: West: I-5 Freeway C-2 & R-P 3. Related Cases: The City has been pursuing G~neral Plan con- sistency by r~zoning as an on-going program since the adoption of the Land Use Element in 1974 (ZC-155, 156, 160, 161, 162, 167, 168 and 191). 4. Environmental Impact Information: issued because the zone change is the government code and will have environment. A Negative Declaration was mandated by Section 65860 of no effect on the existing 5. General Plan Information: The zone change will bring this area ~nto conformance with the general plan. A number of uses which are non-conforming in the current zone will remain non-conforming in the proposed zone. 6. Travel Service Commercial: The general Plan Land Use Element contains a Travel Service Commercial category (TS), which is a relatively specific land use, intended to serve tourists and the traveling public. Travel Service areas, including motels, highway oriented service stations, and restaurants, serve businesses and industrial areas as well as the traveling pu~lic. 7. Commercial Tourist Zone: This zone was adopted early in 1977 to implement the Travel Service category of the General Plan tand Use Elements. The purpose of this zone is to provide for the development and use by certain types of commercial businesses near transportation centers, recreation areas or in close prox- imity to highways and freeways used by interregional traffic. Three basic uses are permitted in the CT Zone; hotel; motels and restaurants. A number of accessory uses are also permitted in- cluding the following businesses: apparel, bakery, beauty and barber shops, dry cleaning, florist, health clubs, novelty shops, stationery, and travel agencies. Five other uses are permitted by CUP which include service stations, bus terminals, produce stoves, recreation facilities, and take-out food restaurants. 8. The area is cur- rently zoned C-2 and contains a variety of uses both commercial and residential. '!he locations of the uses in this area is such that the block can be divided into two subareas. Section "A" is cx::>rrprised of strictly cornrercial uses and except for I '"" a small real estate office current uses are ccxrpatible with the Corrrrercial Tourist Zone. Section "B" is residential and contains a number of single-family residences, a duplex, and a small apart:Irent cx::>rrplex. This section poses a nurriber of problems from a planning standpoint. Since zoning is C-2, Section "B" contains non-conform- ing residential uses which may make it difficult for this section to ever becorre a well developed co111rercial area unless the property is purchased and developed as a single unit. Another problem is the poor access this section has fran Elm Avenue. Good vehicular access would be essential if it is to be developed as a commercial area. To ensure cohesive develo:prent of this section and the entire block the rom- mission should consider the use of the Q-Overlay· Zone. This would provide a compre- hensive develo:Pnent scheme for the entire area including Im.ltuhl parking, driveway$ and proper building locations. BACKGROUND ZC-194, 195 & 196 are City initiated zone change resulting from the City Council's recent adoption of ZCA-83 1 a zone code amendment creating the Commercial Tburist (CT). The new zone is intended to provide consistency between the Zoning Ordinance and the Land Use Element of the General Plan which designates a number of locations in the C'ity as Travel Service. These areas \vill provide for certain types of ccmrercb.l businesses to service transportation centers 1 recreation areas or travellers on highways and freeways used by interregional traffic. The General Plan designates 16 acreas as Travel Service. Staff is requesting that only three of these areas be considered for rezoning at this time. The areas not considered are either in the County, less than 3 acres, zoned P-C, or presently have specific plans which should be reviewed and possibly deleted before rezoning. It is the responsibility of the applicant to make the initial contact for such meeting. 2) Submittal: Application will be accepted only if the applica- tion, plans and other pertinent materials are complete~ Generally, the date application will be heard will be deter- mined by the submittal date as indicated within the approved Planning Commission calendar. 3) Planning Commission Calendar: The Planning Commission adopts an·annual calendar that indicates application closing dates, staff review dates, staff report completion dates, and Plan- ning Commission hearing dates. You may acquire this calendar at the Planning Commission Department. 4) Staff Review:· On the date as indicated on the Planning Commission Calendar, City Staff conducts a review meeting on all items on the Planning Commission agenda.
