Dear Mr. Eching:
This letter is to inform you of the status for the City of Carlsbad, CA with regard to adoption of
the Model Water Efficient Landscape Ordinance (MWELO) as required by Assembly Bill 1881.
The Carlsbad City Council approved and introduced a Water Efficient Landscape Ordinance
(WELO) on April 27, 2010. The Carlsbad ordinance is based on the San Diego regional
MWELO that was developed by the San Diego County Water Authority and stakeholders in the
San Diego region. The Carlsbad ordinance includes findings that the WELO implements the
Water Conservation in Landscaping Act and that the provisions of the ordinance are equivalent
to and at least as effective in conserving water as the State MWELO.
The Carlsbad WELO is scheduled for adoption on May 11, 2010, and will become effective 30
days from its adoption (June 10, 2010). A copy of the approved ordinance is attached for your

Dear Mr. Eching:
This letter is to inform you of the status for the City of Carlsbad, CA with regard to
adoption of the Model Water Efficient Landscape Ordinance (MWELO) as required by
Assembly Bill1881.
The city is in process of preparing an ordinance for adoption by the Carlsbad City
Council. We anticipate that the city's Water Efficient Landscape Ordinance will be
adopted by March 2010.
The City of Carlsbad will implement the updated state MWELO until our new ordinance
takes effect. When adopted, we will forward to you a copy of the city's ordinance along
with the required findings and evidence that the local ordinance is as effective as the
state MWELO.

As the Airport Land Use Commission (ALUC) for San Diego County, the San Diego County
Regional Airport Authority acknowledges receipt of an application for a determination of
consistency for the project described above. Areas affected by this ordinance are located within
the Airport Influence Area (AlA) for the McClellan-Palomar Airport-Airport Land Use Compatibility
Plan (ALUCP), and pursuant to California Public Utilities Code §21676(b), amendments to a
general or specific plan, zoning ordinance, or building code within an Airport Influence Area (AlA)
are subject to review by the local ALUC for a determination of consistency with the applicable
ALUCP.
However, ALUC staff review of the application indicates that this city-wide ordinance would not
involve any change to the permitted height or area of structures nor change permitted land uses
or densities on properties affected by the ordinance. This ordinance merely establishes water-
efficient landscaping standards for land uses to fulfill requirements of State law mandating that
local jurisdictions adopt such requirements. Therefore, a determination of consistency with the
ALUCP by the ALUC is not required.
