NOTICE IS GIVEN that the General Municipal Election is to be held in the
City of Carlsbad on November 8, 1988 at which there will be submitted to the
voters the following measure:
SHALL ORDINANCE NO. NS-29 BE ADOPTED AMENDING CHAPTER 3.12 OF
THE CARLSBAD MUNICIPAL CODE TO INCREASE THE TRANSIENT OCCUPANCY
TAX RATE BY 2% TO PAY FOR A QUALITY REGULATION MUNICIPAL GOLF
COURSE, TENNIS COURTS AND OTHER RECREATIONAL FACILITIES?

NOTICE IS FURTHER GIVEN that pursuant to Article 4, Chapter 3, Division 5
of the Elections Code of the State of California, the legislative body of the
City, or any member or members thereof authorized by the body, or any individual
voter or bona fide association of citizens, or any combination of voters and
associations, may file a written argument, not to exceed 300 words in length,
for or against the City measure. Said arguments shall be accompanied by the
statement required by Elections Code Section 5350. Please call 434-2808 for
information regarding this statement.
NOTICE IS FURTHER GIVEN that, based upon the time reasonably necessary to
prepare and print the arguments and sample ballots and to permit the 10-day
examination period for the election, the arguments must be received in the Office
of the City Clerk, 1200 Elm Avenue, Carlsbad, no later than 5:00 p.m. on August
22, 1988. (Arguments may be changed or withdrawn until and including this date.)
Official election materials will be available for viewing at the City Clerk's
Office in accordance with Elections Code Sections 3795, 5025, 5215 and 5330.

To the Carlsbad, California, City Council:
Notice ii hereby 'given by the persons whose names appear hereon of
their Intention to circulate the petition within the City of Carlsbad for the
purpose of enacting a SAVE OPEN SPACE General Plan Amendment to the
City General Plan and a Zoning Ordinance. A statement of the reasons of the
proposed action as contemplated by the petition is as follows:1. The Citiiera of Carlsbad wish to preserve those areas identified as
prime open space and conservation areas within the Open Space and Con-
servation Element and those areas designated as open space and conserva-tion on the land use map.
2. The pressure to develop these ecologically sensitive areas worthy ofpreservation has and is resulting in the conversion of these areas to devel-
opment3. Careful consideration should be given these areas before conversion tourban uses, with the citizens of Carlsbad being assured of a public discus-
sion of the merits of such a conversion and the opportunity to vote onwhether or not these lands should be converted to urban uses.

NOTICE OF INTENTION TO CIRCULATE
INITIATIVE PETITION
NOTICE IS HEREBY GIVEN by The Committee to Sustain Hosp Grove oftheir intention to circulate an initiatu^netition among the voters of theCity of Carlsbad. The Title of the initiative and a Summary of the proposedmeasure as prepared by the city attorney are recited hereafter. The Com-mittee's measure follows.
• TITLEAn initiative measure by the people of the City of Carlsbad, Californiarequiring the City Council to lease an 11.5 acre .portion of the propertyknown as Hosp Grove generally located at the Southeast and Southwestcorners of Monroe Street and Marron Road for commercial developmentand amending the Carlsbad General Plan and Zoning Map to change theland use designations for said property from Open Space (OS) to GeneralCommercial (C-2) with a Q Qualified Development Overlay Zone.
SUMMARY
The City of Carlsbad owns all of the undeveloped property in what iscommonly known as Hosp Grove, generally located South of Marron Road,East and West of Monroe Street and North of Elm Avenue. The property isdesignated on the Carlsbad General Plan and on the City Zoning Map asOpen Space (OS). The proposed measure would affect about an 11.5 acreportion of this property generally located immediately South of Marron onthe Southeast and Southwest corners of Monroe Street in two ways. First, itwould require the City Council to "actively pursue" leasing the property to"qualified businesses" for a minimum of 30 years for "appropriate qualitycommercial development" The three terms in quotations ace not definedby the measure therefore the extent of the leasing effort required to bemade, the types of business to be solicited, the physical nature of thedevelopment and the terms and conditions for the leases would all besubject to the future discretion of the City Council. Any proceeds from theleases would be general fund revenues and the use of those funds wouldalso be determined by the City Council: Second, it would amend the Gener-al Plan Land Use Designation and the Zoning Map to change the land use
designations from Open Space (OS) to General Commercial (C-2) with a (Q)
Qualified Development Overlay Zone. This designation would permit de-
velopment of a full range of commercial uses subject to approval the Plan-
ning Commission, or the City Council on appeal, of a Site Development Plan
pursuant to Chapter 21.06 of the Carlsbad Municipal Code.
If this measure is approved by a majority vote of the electors voting in theelection then it may not be amended or repealed by the City Council with-out a vote of the people.
This Title and Summary is prepared in compliance with Section 4002.5 of
the California Elections Code.
THE INITIATIVE MEASUREThe people of the City of Carlsbad do ordain as follows: the CKy ofCarlsbad shall lease approximately eleven and one-half acres of land gen-"-' erally located on the West and East sides of Monroe Street immediately
South of Marron Road and rezone the property with the necessary generalplan amendment to allow appropriate quality commercial development ofthe said property described below. If this measure passes, the city shall. actively pursue leasing the property to qualified businesses. r
The revenues from the ground leases shall be used as determined by the
city council to help the city meet the annual approximate payments of
$700,000 or more per year (as will be determined at the time of bond sale) for
the next twenty (20) years as necessary to retire the debt incurred by the
city's 1987 purchase of Hosp Grove, and/or shall provide supplementalfunds to the city's general fund.
The leases shall be a minimum of thirty (30) years and pertain to thoseportions of lots 8-10, 16, 17, 22-25. Canyon Street and Eucalyptus Street inHosp Eucalyptus Forest Company's tract no. 1, in the City of Carlsbad,County of San Diego, according to map thereof #1136, filed in the office ofthe county recorder of San Diego County, June 8, 1908.
The leaseable lands shall be zoned to the designation C-2-Q and the
general plan shall be amended to the classification to accommodate the
qualified businesses seeking and being granted leases.
This action shall not be overriden or substantially changed by the City
Council without the a pproval of the general electorate at a regularly sched-uled election in the city.
If any provision of this initiative measure or any application of such
provision to any person or circumstances shall be adjudged, declared, or ;
held invalid in a court of law, the remaining provisions and applications
shall not be affected thereby, and are therefore severable.
