The open space areas on the north side ofCannon Road provide spectacular views of the Agua Hedionda Lagoon and containenvironmentally-sensitive natural habitat areas that need to be permanentlyprotected.The existing Flower Fields and the Strawberry Fields as open space uses provide forproductive use of portions of the area that enhance the cultural heritage and historyof the City. The City also has a comprehensive Growth Managithat sets limits on the amount of residential development and that requires public facprovided concurrent with growth. £118 This initiative shall be subject to amendment by the City Council without the required voteof the People of Carlsbad upon a showing of substantial evidence on the record thatimplementation or operation of this initiative will frustrate City functions in any of thefollowing circumstances:,-
iri (a.) To affect City compliance with any State mandated programs, including but notlimited to: housing requirements; density bonuses; development agreements;certified redevelopment plans; vesting tentative maps; or other matters otherwiserequired by State law;(b.) To deprive any person, organization or entity of their Constitutional rights,including property rights, and no takings shall be allowed through the construction• or implementation of this initiative;(c.) To affect any development project that has obtained as of the effective date of theinitiative a vested right pursuant to State or local law.Upon such a showing the City Council may amend this Initiative in manner that mostnarrowly construes the City's compliance obligations, or liability, as the case may be, yetat the same time balances the broadest possible construction and implementation of theintentions of this Initiative. Any such amendments allowable to the City Council shall notimpair the right of the People of Carlsbad to subsequently seek a Referendum overturningsuch actions if they so choose.The City, through its City Council may amend this initiative without a vote of the People toengage in any agricultural conservation act consistent with the intentions of this initiative,including, but not limited to, Williamson Act activities or the creation of, or implementationof, any other City sponsored agricultural program or activity designed to enhance,promote, or conserve agricultural opportunities within the City and specifically within thecoastal agricultural areas established by this initiative._6. SEVERABILITY AND INTERPRETATION.This measure shall be interpreted so as to be consistent with all federal and state andmunicipal laws, rules, and regulations. If 'any section, sub-section, sentence, clause,phrase, part, or portion of this measure is held to be invalid or unconstitutional by a finaljudgment of a court of competent jurisdiction, such decision shall not affect the validity ofthe remaining portions of this measure. The voters and People of Carlsbad herebydeclare that this measure, and each section, sub-section, sentence, clause, phrase, part,or portion thereof would have been adopted or passed even if one or more sections, sub-sections, sentences, clauses, phrases, parts, or portions are declared invalid orunconstitutional.
