(Client), Geocon Environmental Consultants, Inc. (Geocon) has conducted additional limited soil sampling and analysis for the subject site identified as the Buerger Property. The additional sampling and analyses were conducted for the purposes of waste classification of soil which will potentially be exported from the subject property during future development. The approximately 5.05-acre subject site is located north of Aviara Parkway and adjacent to the east of proposed Black Rail Road in Carlsbad, California. The property is currently occupied by two greenhouses utilized primarily for the growing of orchids and ferns. The western-most portion of the property is utilized for the growing of Bird-of-Paradise. The approximate location of the site is depicted on the attached Vicinity Map, Figure 1. A Site Plan, Figure 2, depicting the soil sampling locations and the assumed limits of soil to be exported from the subject site is also attached (map pocket). Geocon's report entitled Limited Soil Sampling and Analysis Report, Buerger Property, Carlsbad, California, dated August 31, 1998, summarized soil sampling and laboratory testing activities conducted to evaluate the potential presence of organochlorine pesticides and herbicides in near- surface soil on-site and their levels vis-a-vis the levels that constitute hazardous waste or pose a significant risk of harm to human health under applicable law. The report concluded that the laboratory test results suggest that near-surface on-site soil is not impacted by organochlorine pesticides or herbicides at concentrations which would likely pose a significant risk to human health or threat to groundwater. The report further concluded that if export or treatment of the upper approximately 3 feet of soil, i.e. pesticide-impacted soil, is contemplated during future development 6970 Flanders Drive • San Diego, California 92121-2974 • Telephone (619) 558-6100 • Fax (619) 558-8437 of the property, additional soil sampling and analyses in accordance with applicable regulations would be required for waste classification purposes. Subsequently, a representative of Geocon collected soil samples from the subject site at 5 random sampling locations on September 3, 1998. The locations were randomly selected from areas of the site where the upper approximately 3 feet of soil may be exported from the property. The soil samples were collected from 0 to 6 inches below the existing ground surface and approximately 2 to 2/4 feet below the existing ground surface at each of the five locations. The samples were analyzed for the presence of organochlorine pesticides following Environmental Protection Agency (EPA) Test Method 8080. A reproduction of the laboratory report and chain-of-custody documentation is attached. The results of the laboratory analyses are also summarized in the attached Table I. The results were compared with the Total Threshold Limit Concentrations (TTLCs) promulgated in the California Code of Regulations (CCR) "Title 22." The TTLC for DDT, DDE, and DDD as a summed concentration is 1,000 micrograms per kilogram (ug/kg). The TTLCs for Dieldrin and Toxaphene are 8,000 and 5,000 ug/kg, respectively. Since the maximum summed concentration of DDE+DDD+DDT is 332 ug/kg (sample BP3-1), the maximum Dieldrin concentration is 31 ug/kg (sample PRF1-2), and the maximum Toxaphene concentration is 1630 ug/kg (sample BP3-1), the surficial soil would not be considered a hazardous waste for export or treatment purposes.
