Pursuant to the provisions of the "Municipal Improvement Act of
1913," being Division'12 of the Streets and Highways Code of the
State of California, and in accordance with the Resolution of
Intention, being Resolution No. 8 2 57, adopted by the CITY
COUNCIL of the CITY OF CARLSBAD, STATE OF CALIFORNIA, in connec-
tion with the proceedings for:

(JAMES DRIVE)
(hereinafter referred to as the "Assessment District"), I,
CHARLES R. BRAS, authorized representative of BSI CONSULTANTS,
INC., the duly appointed ENGINEER OF WORK, submit herewith the
"Report" for the Assessment District, consisting of five (5)
parts as follows:
PART I
Plans and specifications for the proposed improvements are filed
herewith and made a part hereof. Said plans and specifications
are on file in the Office of the City Clerk.
PART II
An estimate of the cost of the proposed improvements, including
incidental costs and expenses in connection therewith, is as set
forth on the lists thereof, attached hereto, and are on file in
the Office of the City Clerk.

PART III
A proposed assessment of-the total amount of the costs and ex-
penses of the proposed impr'ovfements -dpon the several subdivisions
of land within the Assessment District, in proportion to the
estimated benefits to be received by .such subdivisions from said
improvements, is set forth upon the assessment roll filed here-
with and made a part hereof.
PART IV
A diagram showing the Assessment District, the boundaries, and
the dimensions of the subdivisions of land within said Assessment
District as the same as existed at the time of the passage of the
Resolution of Intention, is filed herewith and made a part here-
of, and part of the assessment.
PART V
Description of the work for the proposed improvements and
description of all rights-of-way, easements, and lands to be
acquired, if any.

ASSESSMENT ROLL
WHEREAS, on November 5 , 1985 , the CITY COUNCIL of
the CITY OF CARLSBAD, CALIFORNIA, did, pursuant to the provisions
of the "Municipal Improvement Act of 1913," being Division 12 of
the Streets and Highways Code of the State of California, and as
amended, adopt its Resolution of Intention No. 8257 , for the
construction of certain public improvements, together with
appurtenances and appurtenant work in connection therewith, in a
special assessment district known and designated as:
ASSESSMENT DISTRICT NO. 83-2
(JAMES DRIVE)
(hereinafter referred to as the "Assessment District;) and,
WHEREAS, said Resolution of Intention, as required by law, did
direct the appointed Superintendent of Streets to make and file a
Report consisting of the following:
a. Plans
b. Specifications
c. Cost Estimate
d. Assessment Diagram showing the Assessment District
and the subdivisions of land contained therein
e. A proposed assessment of the costs and expenses of
the works of improvement levied upon the parcels and
lots of land within the boundaries of the Assessment
District.
For particulars, reference is made to the Resolution of Intention
as previously adopted .
NOW, THEREFORE, I, CHARLES R. BRASauthorized representative of
BSI CONSULTANTS, INC., the duly appointed ENGINEER OF WORK,
pursuant to the "Municipal Improvement Act of 1913," do hereby
submit the following:
1. I, pursuant to the provisions of law and the Resolution of
Intention, have assessed the costs and expenses of the works
of improvement to be performed in the Assessment District
upon the parcels of land in the Assessment District benefited
thereby in direct proportion and relation to the estimated
benefits to be received by each of said parcels. For parti-
culars as to the identification of said parcels, reference is
made to the Assessment Diagram, a copy of which is attached
hereto.
2. As required by law, a Diagram is attached hereto showing the
Assessment District, as well as the boundaries and dimensions
of the respective parcels and subdivisions of land within
said District as the same as existed at the time of the
passage of said Resolution of Intention, each of which sub-
divisions of land or parcels or lots respectively have been
given a separate number upon said Diagram and in said Assess-
ment Roll.
3. The subdivisions and parcels of land, the numbers therein as
shown on the respective Assessment Diagram as attached here-
to, correspond wth the numbers as appearing on the Assessment
Roll as contained herein.
4. NOTICE IS HEREBY GIVEN that bonds will be issued to represent
all unpaid assessments and the interest rate on said bonds
will not exceed the current legal maximum rate of 12% per
annum. Said bonds will be issued hereunder in the manner and
form as provided by the "Improvement Act of 1911," being
Division 7 of the Streets and Highways Code of the State of
California. The last installment of bonds shall mature a
period of not-to-exceed fourteen (14) YEARS from the 2nd day
of January next succeeding the next September 1st following
their date.

By virtue of the authority cont,ained in said "Municipal
Improvement Act of llIs," and.Dy further direction and order
of the legislative body, I hereby made the. following Assess-
ment to cover the costs and e.xp.enses of the works of improve-
ment for the Assessment District based on the costs and ex-
penses as set forth below:

EXHIBIT 'A*
METHOD AND FORMULA OF ASSESSMENT SPREAD
The law requires and the statutes provide that assessments, as
levied purusant to the provisions of the "Municipal Improvement
Act of 1913," roust be based on the benefit that the properties
receive from the works of improvement. The statute does not
specify the method or formula that should be used in any special
assessment district proceedings. The responsibility rests with
the Assessment Engineer, who is retained for the purpose of
making an analysis of the facts and determining the correct
apportionment of the assessment obligation. For these proceed-
ings, the City has retained the services of BSI CONSULTANTS, INC.
(See attached Exhibit for a statement of the qualifications and
experience.)
The Assessment Engineer then makes his recommendation at the
public hearing on the Assessment District and the final authority
and action rests with the City after hearing all testimony and
evidence presented at that public hearing. Upon the conclusion
of the public hearing, the City must make the final action in
determining whether or not the assessment spread has been made in
direct proportion to the benefits received.
First of all, it is necessary to identify the benefit that the
public improvement will,render to the properties within the
boundaries of the Assessment District. By construction of the
new public street, most parcels within the Assessment District
will enjoy the direct benefit of receiving access from adjacent
City streets to their property. By construction of a storm
drainage system, including all appurtenances and connecting those
facilities to the City of Carlsbad storm drain system, all par-
cels and streets within the Assessment District will enjoy the
direct benefit of receiving protection from flooding caused by
the runoff originating from lands within the Assessment District
boundaries for the "design storm" recommended by the City.

Access to the parcels fbr emergency and other vehicles during
storm conditions will be ensured ^ By construction of a sewer
system, including collector pipeline and appurtenances, most
parcels within the Assessment District will enjoy the direct
benefit of receiving a connection to the local and regional
sewerage facilities serving the rest of the City through under-
ground pipelines and the elimination of potential health problems
from the storage and dumping of sewage on site. By construction
of water system facilities, including distribution mains, fire
hydrants, and appurtenant structures, and connecting these
facilities to City of Carlsbad source, storage, and transmission
facilities, most parcels within the Assessment District will
enjoy the direct benefit bf receiving domestic water service and
water for fire suppression. By construction of the above im-
provements, most parcels within the Assessment District will
enjoy the direct benefit of having the necessary street and
utility improvements to subdivide and/or build additional
residential units upon the parcels.. The cost of providing the
above improvements and appurtenances will be equitably divided
among the participating properties according to the benefit
rece ived.
In further making the analysis, it is necessary that the property
owners receive a special and direct benefit distinguished from
that of the general public. In this case, an in-depth analysis
was made, and several factors are being used in the final method
and spread of assessment. The spread was determined by the
following method:
1. The costs of the grading and construction of the pavement
area of James Drive were spread to the parcels having access
to the new street on a ratio of the developable area within
the District.
2. The costs of the construction of frontage improvements for
James Drive, consisting of curb, gutter, and sidewalks, were
spread on a ratio of the lot frontages.
3. The costs of construction of the drainage facilities were
paid for by a City of Carlsbad contribution.^
4. The costs of the construction of the utilities with the
exception of the sewer laterals and water services were
spread on a ratio of all developable areas within the
district.
5. The costs of the sewer laterals and water services were
direct cost to the parcels receiving the benefits.
6. The incidental costs were spread on a ratio of all the
construction costs.

In conclusion, it is my opinion^that the assessments for the
above-referenced Assessment. District have been spread in direct
accordance with the benefits that each parcel received from the
works of improvement.

DESCRIPTION OF WORKS OF IMPROVEMENT
The proposed works of improvement are generally described as
foilows:
The construction proposed in Assessment District No. 83-2 to
generally benefit the area consists of the improvement of a
portion of James Drive between Oak Avenue and Basswood
Avenue. The work includes the necessary removal of vegeta-
tion to prepare the construction area; excavation of earth
and trenching to install necessary storm drains, water lines,
water services, sewer, sewer laterals, and other utility
services; preparation and compaction of subgrade; placement
and compaction of aggregate base; placement .and compaction of
asphalt concrete; installation of concrete curb and gutter;
work and acquisition of necessary rights-of-way and easements
to accomplish the improvement, to serve the parcels shown in
the Assessment Diagram for Assessment District No. 83-2. All
parcels fronting on the proposed street will be provided with
sewer lateral and water service to the owner's property line.
This will permit the owner to connect to an on-site system
after the owner has satisfied the necessary City
requ irements.

RIGHT-OF-WAY CERTIFICATE

The undersigned, CHARLES R. BRAS, hereby CERTIFIES UNDER PENALTY
OF PERJURY, that the following is all true and correct:
At all times here inmentioned, the undersigned was, and nov/ is,
the authorized representative of BSI CONSULTANTS, INC., the duly
appointed ENGINEER OF WORK of the CITY OF CARLSBAD, CALIFORNIA.
That there have now been instituted proceedings under the provi-
sions of the "Municipal Improvement Act of 1913," being Division
12 of the Streets and Hghways Code of the State of California,
for the construction of certain public improvements in a special
assessment district known and designated as:

(hereinafter referred to as the "Assessment District").

THE UNDERSIGNED STATES AND CERTIFIES AS FOLLOWS: (Check One)

the accomplishment of the works of improvement for the
above referenced Assessment District have been obtained
and are in the possession of the City.
[X] b. That all easements, rights-of-way, or land necessary for
the accomplishment of the works of improvement for the
above referenced Assessment District have been obtained
and are in the possession of the City, EXCEPT FOR THOSE
DESCRIBED IN EXHIBIT "A" attached hereto, showing legal
description and maps of rights-of-way and easements not
yet obtained at this time.
It is further acknowledged that works of improvement as proposed
to be constructed within said Assessment District must be con-
structed within public rights-of-way, land, or easements as owned
by said City at the time of the construction of the works of
improvement, and the undersigned hereby further certifies that
all rights-of-way necessary for the works of improvement will be
obtained and in the possession of the City prior to the commence-
ment of any construction.

Carlsbad, County of San Diego, State of California, according to
Map of No. 1661 , on file in the office of the County Recorder of
said County and State, and that portion of Basswood Avenue, as
per- Map thereof No. 1681 of Thum Lands, on file in the Office of
the County Recorder of San Diego County, more particularly
described as follows:
That portion of the land described in a Deed to Lloyd E. Stein and
Leone Stein recorded July 21, 1983 , as File/Page No. 83-2501 53 ,
records of said County and State, lying within the following
described land;
That portion of the described land lying Southerly of a curve
concave Northerly and having a radius of 20.00 feet, said curve
being tangent Northwesterly with the Southwesterly line of said
