The Project is being built under the i* authorization of the City of Carlsbad, along with Army Corps of Engineers Clean Water Act M Section 404 Permit No. 972020600-SMJ, California Department of Fish and Game Section 1601 ^ Streambed Alteration Agreement No. 5-122-00, California Coastal Commission Coastal Development Permit No. A-6-CII-00-087, and City of Carlsbad Endangered Species Act ** Incidental Take Permit No. HMP 04-01. Phase 1 of the Project included clearing, brushing, and ^ mass grading of the golf course and associated features. Project construction began with clearing, brushing, and mass grading on September 12, 2005 and this phase of work was largely ^^Jj completed by March 2006. * In accordance with our scope of work and relevant permit conditions, monitoring work Dudek ft performed during Phase 1 of the Project included remediation of the former police shooting range, monitoring the clearing and brushing of all existing vegetation, making limited pre- J construction surveys of the two approved golf cart crossings over Macario Creek; archeological, paleontological, and environmental monitoring during mass grading; and establishing baseline ** water quality monitoring. A summary of environmental construction monitoring follows. m Remediation of the Former Shooting Range Dudek performed a soil investigation to assess potential lead contamination associated with the •» former City of Carlsbad Police shooting range. Lead levels were detected in shallow soils that m exceeded the US Environmental Protection Agency Preliminary Remediation Goals. Shallow soils were excavated and transported offsite for recycling and disposal prior to project grading in WWW.DUDEK.COM Mr. John Cahill Subject: Final Environmental Construction Monitoring Report for Phase 1 of the Carlsbad Municipal Golf Course Project, Carlsbad, California the area. Dudek prepared a report for the City titled Site Investigation/Confirmation Sampling, Former Shooting Range Carlsbad Municipal Golf Course Faraday Avenue Carlsbad, California (Dudek 2006). Subsequently, a monitoring well was installed just downstream of this location and periodic water samples will be analyzed for residual lead concentrations. Pre-Construction Surveys In accordance with Coastal Development Permit Condition No. 3, Dudek habitat restoration biologists Andy Thomson and Marc Doalson performed the limited pre-construction surveys at the two approved locations for bridge crossings over Macario Creek. Neither of the bridges has been built yet, but construction is underway. Bridge "B" is to be placed in the footprint of the existing farm road crossing of Macario Creek. The location for Bridge "C" over Macario Creek was altered from that shown on the plans to avoid large willows. According to Coastal Permit language and Dudek's understanding, the bridge was supposed to be placed in a gap in the vegetation to avoid any direct impacts to the willows. To accommodate this, the bridge location was shifted about 30 feet to the east to avoid removing the willows. Post-construction surveys will need to be performed after the bridges have been built to document permit compliance. As- built plans will also need to be prepared to document the actual bridge location. Archeological Monitoring Archeological monitoring was performed on an "on-call" basis by Dudek's sub-contractor, Gallegos and Associates. Gallegos and Associates did extensive pre-construction surveys for cultural resources at the project site during the environmental review and design process. The City of Carlsbad also hired the San Luis Rey Band of Luseno Mission Indians under separate contract to provide additional cultural resources monitoring services. Several known cultural resources sites occur within the Project area and archeological monitors were present when work occurred in these areas to ensure that resources were protected. Several of the sites were preserved by capping with fill and a protective layer of colored concrete in one instance. Other sites were left undisturbed. Significant cultural resources were discovered during project grading. Gallegos and Associates monitors took the required action to coordinate with the grading contractor to temporarily halt construction work, made the required notifications, and then recovered and documented the discoveries, as appropriate. Construction work recommenced once the archeological work was completed. Gallegos and Associates is currently preparing recovered archeological resources for curation, and preparing a final report regarding cultural resources monitoring and recovery for the project. 4821-01 DUDEK 2 July 31,2006 Mr. John Cahill Subject: Final Environmental Construction Monitoring Report for Phase 1 of the Carlsbad Municipal Golf Course Project, Carlsbad, California Paleontological Monitoring ***" Paleontological monitoring was performed during mass grading by Dudek's sub-contractor, the *. San Diego Natural History Museum, on an "on-call" basis. Paleontological monitors were present when grading occurred in undisturbed soil and formations where fossil resources could be expected to be encountered. Fossil shells and other relatively small fossils were encountered, ""' documented, and recovered, as needed. These artifacts are being placed in permanent storage, as ** required. The San Diego Natural History Museum is currently preparing a final report „., documenting paleontological resources monitoring and recovery for the project. •*Environmental Monitoring •HI m Dudek's environmental monitoring work began prior to construction by helping to identify construction haul routes, which had not been accounted for in the planning and design stages. The Project Engineer altered the design in some locations to reduce the need to haul material between areas and Dudek worked with Christer Weston of the City Planning Department and the •* grading contractor to identify haul routes that would not impact any sensitive habitat. Haul M routes were placed along existing SDG&E access roads and across non-native grassland and/or ruderal areas. Haul roads will be restored to their previous grade following project construction, except where SDG&E access roads were used, the areas are being seeded with a coastal sage scrub seed mix. ^ Dudek provided environmental monitoring during vegetation clearing, brushing, and mass grading. Work began on September 12, 2005, following a tailgate meeting with the construction ** crew. As required by permit conditions, Dudek environmental monitors were present each day * that vegetation clearing and brushing took place. Clearing, brushing, and mass grading took M place outside the bird breeding season, so there were no direct impacts to any nesting birds. H Dudek monitors surveyed the areas for wildlife in advance of clearing to the extent possible. * Surveyors staked the limits of work and orange construction fencing was placed along the limits * of work in most areas prior to clearing and grading. Dudek reviewed and verified the accuracy of limit of work staking and fence. Dudek was present while all vegetation was cleared to ensure^M m that areas to be preserved were not damaged during vegetation clearing. In some areas with especially dense vegetation, the orange construction fencing was placed after clearing. In these w locations, the Dudek environmental monitor worked in close conjunction with the heavy M equipment operator to help identify the limits of work edge between survey stakes. Representative photos are attached in Figure 1. . ._.-_„ 4821-01 D U D t K 3 July 31, 2006 Mr. John Cahill ** Subject: Final Environmental Construction Monitoring Report for Phase 1 of the Carlsbad Municipal Golf Course Project, Carlsbad, California mat Coastal Development Permit Condition No. 11 outlines measures for the protection of the *" federally-listed threatened coastal California gnatcatcher (Polioptila californica californicd). m Dudek did not observe any coastal California gnatcatchers present in vegetation to be cleared m that required flushing in advance of the grading equipment. No special action was needed to gj move them away from impact areas, as detailed in the Coastal Development Permit. All potential coastal California gnatcatcher habitat slated for development was cleared, brushed, and f graded prior to the gnatcatcher breeding season. With the exception of a several snakes, Dudek ^ did not observe any dead wildlife during clearing and grubbing. «•» Clearing, brushing, and mass grading occurred while least Bell's vireo (Vireo belliipusilis) was not present at the site, so there were no impacts to this federally-listed endangered species. No ^ least Bell's vireo habitat was slated to be removed as part of the project. • One unauthorized impact to jurisdictional wetland vegetation occurred on September 28, 2005. A heavy equipment operator for Sema Construction working in an area that had already been cleared and brushed took down the orange construction fencing and began clearing vegetation m adjacent to and within the wetland along Macario Creek. Another heavy equipment operator * observed work occurring within protected habitat and notified his supervisor. Dudek was present onsite, but was working with the crew clearing and brushing vegetation in another location. The worker responsible for the unauthorized clearing was terminated that day. Dudek immediately notified the U.S. Army Corps of Engineers by telephone, then documented the impact area with H GPS, field notes, and photographs. Dudek is working with the City to propose appropriate H mitigation to the agencies for this impact. Representative photos showing the wetland impacts are attached in Figure 2.m m ™ The construction contractor did not install the required erosion control by October 1, as required _l by the plans, specifications, project permits, and the Stormwater Protection Prevention Plan H (SWPPP). Dudek monitored the contractor's installation and maintenance of erosion control measures and documented installation deficiencies and lack of progress. Representative photos <• are attached showing deficiencies in Figure 3. The Regional Water Quality Control Board • visited the site and issued an Administrative Civil Liability (ACL) order against the City of Carlsbad (R9-2006-0009) for violating State Water Resources Control Board Order No. 99-08- ^ DWQ, NPDES General Permit No. CAS000002, Waste Discharge Requirements for Discharges of Storm Water Runoff Associated with Construction Activity. The City of Carlsbad ultimately P brought in another company, South Coast Erosion Control, to install and maintain the erosion •I control. Shortly thereafter the erosion control was brought into conformance. Dudek actively worked with the contractor and construction management team to install BMPs, such asm m m 4821-01 DUDEK 4 July 31,2006 *•" Mr. John Cahill «• Subject: Final Environmental Construction Monitoring Report for Phase 1 of the Carlsbad Municipal Golf Course Project, Carlsbad, California temporary detention basins and gravel bags that would intercept sediment before it could reach silt fences. Fortunately, rainfall during Phase 1 of construction was below normal. ^^Representative photos showing erosion control being implemented are attached in Figure 4. *• — During the course of mass grading Dudek periodically monitored mass grading to verify that construction stayed within the approved limits of work and that sediment and erosion control m BMPs were being maintained. Any deficiencies or maintenance needs observed were reported to i* the Project Engineer for correction by the contractor. Other than the one unauthorized ^ jurisdictional wetland impact, there were no significant unauthorized impacts to sensitive resources during Phase 1 of the Project. The contractor ran over or otherwise destroyed the orange construction fence and silt fence on numerous occasions. Representative photos of the *" damage to orange construction fence and associated protected areas are attached in Figure 5. tit These deficiencies were repaired by the contractor. IB Water Quality Monitoring •i Dudek implemented the required water quality monitoring plan as part of our scope of work for li Phase 1, in substantial conformance with the direction provided in the City of Carlsbad Municipal Golf Course Water Quality Monitoring Plan (Plan) prepared by P & D Environmental, dated November 18, 2004. The plan calls for monitoring wells to be installed at itt the upstream and downstream portions of the golf course along the creek in Macario Canyon. mi Surface water sampling locations are also to be established in the creek near the monitoring well Ig locations. m: Monitoring well installation was completed on May 5, 2006. Monitoring well installation had to * be postponed until this date because of access and weather related issues. Monitoring well m locations had to me modified from those shown in the Plan. The Plan called for the upstream H monitoring well to be placed in an ephemeral drainage in a gorge above a cliff near the 16th tees. This location was completely inaccessible for a drill rig. In addition, this location was not along P the main Macario Creek drainage. Dudek directed the monitoring well to be installed along " Macario Creek at the upper end of the golf course near the 15th green. The Plan called for the downstream monitoring well to be placed in an area that is within sensitive habitat. Dudek ^ moved the downstream monitoring well location upstream approximately 200 feet to a location along an existing SDG&E service road, which is also nearer the creek. No habitat impacts were * required to install the monitoring well at this location. m m _ . .__._,- 4821-01 •I DUDEK 5 July 31,2006 i i»* Mr. John Cahill M Subject: Final Environmental Construction Monitoring Report for Phase 1 of the Carlsbad Municipal Golf Course Project, Carlsbad, California f* ••^^^^^^^•••^^^^^^^••••^^^^^^^••••^^^^^^^••^^^^^^•^•^^^^^•^^•^^^^•^^^•^^^^••^ * The monitoring wells were developed following standard protocols and initial baseline water P samples were collected from the groundwater monitoring wells and the designated surface water " locations by Dudek soil scientist/hydrogeologist Torin Snyder and habitat restoration specialist p, Chris Oesch on June 1 and 2, 2006. In accordance with the Plan, water samples are to be y analyzed for nitrates and nitrites, total phosphorus, dissolved oxygen, pH, total suspended solids, and acute and chronic toxicity. As would be expected, the initial baseline samples showed some P variability, depending on location. Dudek plans to take additional baseline water samples before • grass is planted and fertilized and/or treated with pesticides for the first time, within the Macario Canyon watershed portion of the golf course. Once a baseline has been established, the area ~! planted, and the first fertilizer and/or pesticide application made, water quality monitoring samples will be collected quarterly, as called for in the Plan. p fctf This report provides a summary of Dudek' s environmental monitoring activities during Phase 1 of construction at the Carlsbad Municipal Golf Course Project that was completed in March r 2006. Said plans shall be in substantial conformance with the plan entitled "City of Carlsbad Golf Course Revisions" submitted with LCPA 1-03B (Habitat Management Plan) on February 7, 2003. The permittee shall undertake the development in accordance with the approved plans. Any proposed changes to the approved plans shall be reported to the Executive Director. No changes to the plans shall occur without a Coastal Commission approved amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The City of Carlsbad submitted detailed final plans for review and approval prior to project construction. The City has constructed the golf course project in substantial conformance with these detailed final plans, except as amended (such as the extension of Hole 18, cart path modifications, etc.). Completed Ongoing Mitigation for Upland Habitat Impacts 2 PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit to the Executive Director for review and written approval, a final detailed coastal sage scrub mitigation plan. Said plan shall be developed in consultation with the U.S. Fish and Wildlife Service and the California Department of Fish and Game. The permittee shall undertake development in accordance with the approved mitigation/restoration plan. Any proposed changes to the approved plans shall be reported to the Executive Director. No changes to the plans shall occur without a Coastal Commission approved amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The City of Carlsbad submitted the Mitigation Plan, Carlsbad Municipal Golf Course (P&D Environmental and HDR, January 2005) for review and approval prior to project construction. The City has constructed the golf course project in substantial conformance with these detailed final plans, except as amended (such as the extension of Hole 18, cart path modifications, etc.). Changes to the upland mitigation plan are pending at Hole #1 1 due to archeological site constraints. A revised plan is being designed that conforms to all permit requirements. Completed Ongoing Restoration for Construction Impacts 3 PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, if any temporary wetland and/or riparian impacts are proposed, the applicant shall submit a detailed revegetation plan indicating the type, size, extent and location of all plant materials, any proposed irrigation system and any other landscape features necessary to revegetate any proposed temporary wetland and/or riparian impacts. The restoration program shall be developed in consultation with the U.S. Department of Fish and Wildlife and the California Department of Fish and Game. The City of Carlsbad submitted the Revised Golf Course Riparian Mitigation Plan (P&D Environmental, December 2003) for review and approval prior to project construction. Completed DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM PERMIT CONDITION RESPONSE Before/After Survey. The condition of the wetland and/or riparian revegetation and substrate under the two approved golf cart crossing locations shall be documented prior to construction, and the extent of proposed temporary impacts shall be identified. The extent of impacts to the vegetation and substrate shall be assessed and documented after completion of the repairs. Temporary wetland and/or riparian impacts shall be revegetated at a ratio of 1:1. There shall be no wetland impacts except for those temporary impacts associated with construction of the two approved golf cart crossings. No permanent wetland or riparian impacts shall be allowed. Dudek conducted the specified "Before" portion of the required "Before/After Survey", prior to bridge construction. The "After" portion of the survey will need to be performed after construction has been completed. No permanent impacts to wetlands have occurred. The location of Bridge C was moved to avoid mature willow trees. The final location was reviewed and approved by a Dudek Biologist. Ongoing Construction impacts to sensitive habitat areas (e.g., coastal sage and other native upland habitat, wetlands, and riparian areas) shall be avoided by identifying and staking all sensitive habitats outside the project footprint, and educating the construction crews about the importance of these habitats and need for protection. The permittee shall undertake development in accordance with the approved restoration plan. Any proposed changes to the approved plans shall be reported to the Executive Director. No changes to the plans shall occur without a Coastal Commission approved amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. Construction impacts to sensitive habitat have been avoided, to date, with one exception noted. An unauthorized impact to wetlands occurred on September 28, 2005 when a heavy equipment operator opened up the orange construction fence and began clearing an area that was to be preserved. The City of Carlsbad immediately notified the U.S. Army Corps of Engineers, as required by Special Condition No. 2 of the 404 Permit. Plans are being prepared to mitigate for the unauthorized wetland impact and will be submitted to the agencies as notification of this change. A contractor education program was implemented by Dudek at project inception to educate workers of the environmental sensitivity of the project area. Ongoing Final Landscape Plans PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit to the Executive Director for review and written approval, a detailed final landscape plan for the proposed development. Said plan shall show the type, size, extent and location of all proposed vegetation and any necessary irrigation. The City of Carlsbad submitted detailed final landscape plans (P&D Environmental and KTU+A, 4/15/05) for review and approval prior to project construction. The plans substantially conform to the above referenced conceptual design documents. An omission of 5,000+ native container plants is being amended to the construction contract. Completed The permittee shall undertake development in accordance with the approved landscaping plans. Any proposed changes to the approved landscaping plans shall be reported to the Executive Director. No changes to the plans shall occur without a Coastal Commission approved amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The project is being constructed in substantial conformance with the approved plans, except as amended (such as the extension of Hole 18, cart path modifications, etc.). Changes to the irrigation system (above ground irrigation pipe in lieu of below ground pipe) in temporary irrigation areas (Coastal Sage Scrub Mitigation and Revegetation areas) has been instituted to avoid unnecessary impacts to existing biological resources and to facilitate removal after self-sustaining habitat has been sufficiently established. The permittee shall undertake development in accordance with the approved erosion control plans. Any proposed changes to the approved plans shall be reported to the Executive Director. No changes to the plans shall occur without a Coastal Commission approved amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The City of Carlsbad submitted an erosion and sediment control plan (P&D Environmental) for review and approval prior to project construction. The contractor did not implement the erosion and sediment control plan in a timely manner by the October 1 deadline. The RWQCB issued an Administrative Civil Liability (ACL) for the project on October 20, 2005. Following issuance of the ACL, a separate erosion control contractor was hired to complete and maintain the erosion and sediment control measures. No significant adverse water quality impacts were observed during the rain season. Completed Ongoing Drainage and Polluted Runoff Control Plan 6 PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit for the review and approval of the Executive Director, final drainage and runoff control plans including supporting calculations. The plan shall be prepared by a licensed engineer and shall incorporate structural and non-structural Best Management Practices (BMPs) designed to reduce the pollutant load of runoff to the maximum extent feasible, and reduce or eliminate any potential increases in the volume or velocity of runoff leaving the site. The permittee shall undertake development in accordance with the approved drainage and runoff control plans. Any proposed changes to the approved drainage and runoff control plans shall be reported to the Executive Director. No changes to the approved plans shall occur without an amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The City of Carlsbad submitted a final drainage and runoff control plan (P&D Environmental) for review and approval prior to project construction. The project is being constructed in substantial conformance with the approved plans, except as amended (such as the extension of Hole 18, cart path modifications, etc.). Completed Ongoing Water Quality Monitoring Plan 7 PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit for the review and approval of the Executive Director, a water quality monitoring plan to address the quality of runoff prior to leaving the site or entering the onsite riparian area. The plan shall describe the methodology for monitoring, including specific threshold levels and sampling protocols, location of monitoring sites, schedule for monitoring, and reporting of results. The monitoring plan shall also include a contingency plan describing the actions to be taken if water quality impacts are discovered. The City of Carlsbad submitted the City of Carlsbad Municipal Golf Course Water Quality Monitoring Plan (P&D Environmental, November 18, 2004) for review and approval prior to project construction. Completed DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE nm iPi«wcwwrrwN 1 RESPONSE ,STATUS Turf and Pest Management Plan 8 PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit to the Executive Director for review and approval, a detailed turf and pest management plan for the golf course portion of the development. The permittee shall undertake development in accordance with the approved turf and pest management plan plans. Any proposed changes to the approved plans shall be reported to the Executive Director. No changes to the approved plans shall occur without an amendment to this coastal development permit unless the Executive Director determines that no amendment is legally required. The City of Carlsbad submitted a detailed turf and pest management plan for the golf course portion of the development for review and approval prior to project construction. The project is being constructed in substantial conformance with the approved plans, except as amended (such as the extension of Hole 18, cart path modifications, etc.). Completed Ongoing Public Golf Course Facility 9 The golf course, clubhouse, parking areas, driving range, conference center and pads for future industrial/golf related uses shall be operated as facilities open to the general public. Any proposed change in the level of public access and/or public use shall require an amendment to this permit. Signage shall be provided indicating that the onsite facilities as provided above are open to the public. The Carlsbad Municipal Golf Course is a public course that will be open to the general public once it has been completed and opened for business. The required signs are included in the construction contract documents and shall be installed as part of golf course construction. Ongoing Open Space and Conservation Easement 10 A. No development, as defined in Section 30106 of the Coastal Act, shall occur in those areas indicated as Preservation Areas in Exhibit 7 (City Golf Course, Revised Figure 8 of the Carlsbad HMP, CAR LCPA 1-03B), except for temporary impacts associated with construction of the two approved golf cart path crossings, consistent with Special Condition #3, and onsite habitat restoration/revegetation activities as part of an approved coastal sage scrub mitigation plan, consistent with Special Condition #2. The golf course is being constructed in accordance with the approved plans and Special Condition No. 10.A. Temporary site access was established to facilitate construction equipment circulation during mass grading activities. Some of the access routes crossed HMP lands either on existing SDG&E utility access roads or in areas where sensitive biological resources were absent as determined by a biological survey. Final temporary access routes were reviewed and approved by the City of Carlsbad Planning Department. Ongoing DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM PERMIT CONDITION RESPONSE STATUS B. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicant shall execute and record a document in a form and content acceptable to the Executive Director, irrevocably offering to dedicate to a the California Department of Fish and Game and the U.S. Fish and Wildlife Services, or their successor agencies, an open space and conservation easement over all onsite habitat preservation areas, and all mitigation areas (onsite and/or offsite) that will be utilized to address onsite impacts to habitat. The recorded document shall include legal descriptions of both the applicant's entire parcel and the easement area(s). The recorded document shall also reflect that development in the easement area(s) is restricted as set forth in this permit condition. The City of Carlsbad executed and recorded an acceptable open space and conservation easement over all onsite habitat preservation and mitigation areas prior to project construction. Completed C. The offer to dedicate shall be recorded free of prior liens and encumbrances which the Executive Director determines may affect the interest being conveyed. The offer shall run with the land in favor of the People of the State of California, binding all successors and assignees, and shall be irrevocable for a period of 21 years, such period running from the date of recording. The City of Carlsbad offer to dedicate was done in a manner acceptable to the Coastal Commission's Executive Director. Completed Protection of the Coastal California Gnatcatcher 11 To prevent breeding/nesting season impacts to the coastal California gnatcatcher (Polioptila californica califomica), the permittee shall not undertake any clearing or grading activities on the golf course site between March 1 and August 15, unless approved in writing by the U.S. Fish and Wildlife Service and the California Department of Fish and Game. No clearing or grading activities have occurred since March 1 and none are planned until after August 15 except on manufactured slopes on the east side of College Avenue. This area was cleared only after a nesting bird survey was completed by Dudek. One active nest was buffered and protected until it became inactive two weeks later. Ongoing Herbicide, pesticide and/or fertilizer applications shall occur outside of a 100- foot exclusion zone to avoid drift towards nesting areas. Coastal Commission conditions on pesticide use are rendered moot by California Food and Agriculture Code Section 11501.1, which declares that matters relating to pesticide use are an issue of statewide concern and are to be administered on a statewide basis. Section 11501.1 states that any local regulation is "void and of no force or effect." Pesticides may be used in any area permitted by federal and state laws and in accordance with label directions, including sensitive habitat and wetland areas. To further address sensitive species issues, the City will utilize the guidance found in Protecting Endangered Species, Interim Measures for Use of Herbicides in San Diego County (U.S. Environmental Protection Agency 1999), Protecting Endangered Species, Interim Measures for Use of Insecticides in San Diego County (U.S. Environmental Protection Agency 1998), and Protecting Endangered Species, Interim Measures for N.A. DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM PERMIT CONDITION RESPONSE STATUS Use of Fungicides in San Diego County (U.S. Environmental Protection Agency 2000). These bulletins provide guidance based on the hazard class of the pesticide matches the hazard class (sensitivity of the taxonomic group) of the species. A worker education program shall be implemented to ensure that all golf course construction and maintenance workers know the location of all gnatcatcher nests and are aware of the above-described protection measures. Dudek has implemented a worker education program to ensure all golf course construction workers are aware of environmental issues at the project site, including those related to coastal California gnatcatcher. No protocol-level surveys have been undertaken, nor were they required, so the precise location of any coastal California gnatcatcher territories and/or nests is not known. Golf course maintenance workers will undergo a worker education program once the course has been turned over to the permanent maintenance crew. Ongoing During the non-breeding season (August 16 through February 28), if construction activities will produce noise levels greater than 60 db, gnatcatcher-occupied habitats within the habitat preserve areas shall be shielded from the sight and sound of such activities taking place within 50 feet of the occupied habitat, using the following technique. During construction, the gnatcatcher habitat will be shielded from sight and sound by 8-foot high, solid 1-inch thick barriers. A biological monitor must be onsite daily to ensure that the construction activities are having no negative impact on gnatcatchers. The noise-related portion of this condition appears to be written incorrectly. As written, it imposes noise restrictions during the non-breeding season when gnatcatchers do not maintain strongly delineated territories, instead of during the breeding season, when noise restrictions are typically in place. Dudek and the City of Carlsbad believe the intent of this part of the condition intends to restrict noise levels during the gnatcatcher breeding season. As such, Dudek has conducted limited noise monitoring during the breeding season to determine if construction noise levels exceed the 60 dBA level. Ongoing The permittee shall staff a qualified monitoring biologist on-site during all CSS clearing and any other project-related work adjacent to CSS to be avoided. The biologist must be acknowledgeable (SIC) of gnatcatcher biology and ecology. The permittee shall ensure that prior to and during the clearing of coastal sage scrub and/or any other suitable gnatcatcher habitats outside the gnatcatcher breeding season, the biologist shall locate any individual gnatcatchers on-site and direct clearing to begin in an area away from birds. In addition, the biologist shall walk ahead of clearing equipment to flush birds towards areas of habitat that will be avoided and/or which are located within the permanent preserve areas. Dudek biological monitors were present onsite to monitor all vegetation clearing by the contractor, to date. Dudek did not detect any coastal California gnatcatchers that needed to be flushed out of vegetation to be cleared towards vegetation to be preserved. The vast majority of vegetation cleared for project construction consisted of annual grasses and weeds. The remainder of the vegetation to be cleared will not be conducted until after the gnatcatcher breeding season has concluded and seasonal restrictions are no longer in force. Ongoing DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM PERMIT CONDITION | RESPONSE I STATUS Open Space Restriction 12 A. No development, as defined in Section 30106 of the Coastal Act, shall occur in habitat buffer areas as required in Special Conditions #2 and 4, and as identified in the final landscape plans, and as described and depicted in an Exhibit attached to the Notice of Intent to Issue Permit (NOI) that the Executive Director issues for this permit, except for 1. approved landscaping activities and plantings and/or restoration and revegetation of native habitat according to the final coastal sage scrub mitigation plan; and No development has occurred in habitat buffers, to date. Approved landscaping in buffers, such as coastal sage scrub restoration work, has not been initiated. This activity is scheduled to begin August 16, 2006. Ongoing B. PRIOR TO ISSUANCE BY THE EXECUTIVE DIRECTOR OF THE NOI FOR THIS PERMIT, the applicant shall submit for the review and approval of the Executive Director, and upon such approval, for attachment as an Exhibit to the NOI, a formal legal description and graphic depiction of the portion of the subject property affected by this condition, as generally described above and shown on Exhibit 7 attached to this staff report. The City of Carlsbad supplied CCC with the required dedication prior to CDP issuance. This condition has been satisfied. Completed C. PRIOR TO ANY CONVEYANCE OF THE PROPERTY THAT IS THE SUBJECT OF THIS COASTAL DEVELOPMENT PERMIT, the applicant shall execute and record a deed restriction, in a form and content acceptable to the Executive Director: (1) indicating that, pursuant to this permit, the California Coastal Commission has authorized development on the subject property, subject to terms and conditions that restrict the use and enjoyment of that property (hereinafter referred to as the "Standard and Special Conditions); and (2) imposing all Standard and Special Conditions of this permit as covenants, conditions and restrictions on the use and enjoyment of the Property. The restriction shall include a legal description of the applicant's entire parcel or parcels. It shall also indicate that, in the event of an extinguishment or termination of the deed restriction for any reason, the Standard and Special Conditions of this permit shall continue to restrict the use and enjoyment of the subject property so long as either this permit or the development it authorizes - or any part, modification or amendment thereof - remains in existence on or with respect to the subject property. The City of Carlsbad recorded a deed restriction prior to CDP issuance. This condition has been satisfied. Completed DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM 13 PERMIT CONDITION Any future revisions to the golf course layout and/or design which may be necessary to address golf course operations or any other reason shall require an amendment to this permit. Any such revisions to the golf course shall occur within the approved developable area in the least environmentally damaging manner that is most protective of the sensitive resources within the habitat preserve. No impacts to resources within the preserve shall be permitted. RESPONSE The City of Carlsbad secured a "Consistency Determination" from the City of Carlsbad under the City's HMP for minor changes to golf hole 18 and extension of an emergency/maintenance path between golf holes 13 and 16. CDFG and USFWS were consulted in advance of issuance of the approval. STATUS Ongoing Technical Advisory Panel 14 An independent technical advisory panel of environmental and agency representatives shall be provided the opportunity to review and comment on the management plans and ongoing monitoring reports. This will allow for meaningful input by all parties interested in the water quality in the Agua Hedionda Lagoon, and will assist the Coastal Commission staff and the City in effectively assuring the environmental quality of the golf course. All review and comments will be requested to be submitted within 45 days of receipt of draft plans. The Executive Director of the California Coastal Commission shall have final authority over the determination of condition compliance, unless it is determined that the item should be referred to the Commission. Technical Advisory Panel assembled and consulted with the City of Carlsbad on several occasions prior to beginning construction. Panel reviewed and provided input on Turf Management Plan, Mitigation Plan, and other project documents, plans, and exhibits. Panel provided CCC with formal letter of support and project endorsement prior to issuance of CDP. Ongoing CALIFORNIA DEPARTMENT OF FISH AND GAME STREAMBED ALTERATION AGREEMENT No. 5-122-00 1 The following provisions constitute the limit of activities agreed to and resolved by this Agreement. The signing of this Agreement does not imply that the Operator is precluded from doing other activities at the site. However, activities not specifically agreed to and resolved by this Agreement shall be subject to separate notification pursuant to Fish and Game Code Sections 1600 et seq. Descriptive statement, no action required.N/A Project Location and Description 2 The Operator proposes to alter the streambed of an unnamed tributary to Agua Hedionda Lagoon to accommodate the construction of a Municipal Golf Course which will include an 18-hole championship golf course, clubhouse, maintenance facility, driving range, conference center, and pads for industrial/golf related uses. The project is located approximately one mile to the east of Interstate 5. Palomar Airport Road forms the southern boundary, Hidden Valley Road forms the western boundary, and the southern edge of grading for the future extension of Faraday Avenue forms the northern boundary. The 396-acres project site is located in the northwestern quadrant of the City of Carlsbad, San Diego County, impacting 0.91 acres of streambed. Descriptive statement, no action required.N/A DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM 3 4 PERMIT CONDITION The agreed work includes activities associated with No. 2 above. The project area is located in an unnamed ephemeral drainage, tributary to Agua Hedionda Lagoon, San Diego County. Specific work areas and mitigation measures are described on/in the plans and documents submitted by the Operator, including an Environmental Impact Report, and shall be implemented as proposed unless directed differently by this agreement. The Operator shall not impact more than 0.91 acre of streambed comprised of 0.46 acre mule fat scrub, and 0.45 acre of unvegetated channel. Impacts are considered permanent and will be mitigated at a 3:1 ratio for mule fat scrub and 1:1 ratio for unvegetated channel, for a mitigation acreage requirement of 1.83 acres. RESPONSE Descriptive statement, no action required. The contactor made an unauthorized impact to wetlands on September 28, 2005 when a heavy equipment operator opened up the orange construction fence and began clearing an area that was to be preserved. Plans are being prepared to mitigate for the unauthorized wetland impact and will be submitted to the Department for approval. STATUS N/A Ongoing Mitigation 5 6 As mitigation for the project, the Operator shall restore through creation and enhancement, 1 .83 acres of comparable wetland habitat on-site. The Operator shall submit a final Mitigation and Monitoring Plan within 60 days of signing this Streambed Alteration Agreement. Department approval of that plan is required prior to project initiation/impacts. All revegetation shall be installed no later than March 31, 2009. The Operator shall mitigate at a minimum 5:1 ratio for impacts beyond those authorized in this Agreement. In the event that additional mitigation is required, the type of mitigation shall be determined by the Department and may include creation, restoration, enhancement and/or preservation. The City of Carlsbad submitted the final City of Carlsbad Revised Golf Course Riparian Mitigation Plan, dated December 2003. The mitigation installation is currently scheduled to be installed beginning September 1, 2006 and will continue until completion sometime in early 2007. The City of Carlsbad is proposing mitigation at a ratio of 5:1 for the unauthorized impacts to jurisdictional area and will be submitting a plan to the Department. Ongoing Ongoing Vegetation, Revegetation and Restoration 7 All mitigation planting shall have a minimum 100% survival the first year and 80% survival thereafter and/or shall attain 75 % cover of native wetland species after 3 years and 90% cover of native wetland species after 5 years. If the survival and cover requirements have not been met, the Operator is responsible for replacement planting to achieve these requirements. Replacement plants shall be monitored with the same survival and growth requirements for 5 years after planting. At the completion of the monitoring period, the mitigation site shall have received NO supplemental irrigation for a period of two consecutive years, nonnative plants shall not make up more than 5% of the entire cover of the site, no more than 5% of the site shall consist of bare ground and site shall be free of invasive exotic plants species. No action required at this time.Ongoing DUDEK 4821-00 July 27, 2006 CARLSBAD MUNICIPAL GOLF COURSE PROJECT PERMIT CONDITIONS COMPLIANCE ITEM 8 9 PERMIT CONDITION All planting should be done between October 1 and April 30 to take advantage of the winter rainy season. An annual report shall be submitted to the Department by January 1 of each year for 5 years after the on-site restoration/planting. This report shall include the survival and percent cover. The number by species of plants replaced, an overview of the revegetation effort, and the method used to assess these parameters shall also be included along with photos from designated photo stations. RESPONSE Plans call for the mitigation to be installed in the fall and winter months. No action required at this time. STATUS Ongoing Ongoing Work Period and Time Limits 10 The Operator shall not remove vegetation within the stream from February 15 to September 1 to avoid impacts to nesting birds. Initial golf course clearing was completed prior to February 15, 2006. Ongoing Habitat Protection 11 12 13 The Operator shall have a qualified biologist onsite daily during any impacts to vegetation for the purpose of monitoring and enforcing conditions of this agreement. Preparation shall be made so that runoff from steep, erodible surfaces will be diverted into stable areas with little erosion potential. Frequent water checks shall be placed on dirt roads, cat tracks, or other work trails to control erosion. The perimeter of the work site shall be adequately flagged to prevent damage to adjacent riparian habitat. Dudek biological monitors have been present onsite on all days when vegetation removal is scheduled. The contractor did not implement the erosion and sediment control plan in a timely manner. The RWQCB issued an Administrative Civil Liability (ACL) for the project on October 20, 2005. Following issuance of the ACL, a separate erosion control contractor was hired to complete and maintain the erosion and sediment control measures. No adverse water quality impacts were observed during the 2005-06 rain season. The project perimeter was outlined with orange construction fence. The perimeter fence location was reviewed and verified by Dudek prior to construction initiation. In addition, a biological monitor was present on all days when vegetation clearing was scheduled. In spite of these protections, an unauthorized impact to wetlands occurred on September 28, 2005 when a heavy equipment operator opened up the orange construction fence and began clearing an area that was to be preserved. Plans are being prepared to mitigate for the unauthorized wetland impact and will be submitted to the Department for approval. Any equipment or vehicles driven and/or operated within or adjacent to the stream shall be checked and maintained daily, to prevent leaks of materials that if introduced to water could be deleterious to aquatic life. The clean-up of all spills shall begin immediately. The Department shall be notified immediately by the Operator of any spills and shall be consulted regarding clean-up procedures. RESPONSE briefly entered Macario Creek during the unauthorized impact on September 28, 2005. No staging/storage has occurred in the stream. Existing roads and access ramps have been used for project access. The contractor has a program in place to inspect and maintain equipment on a daily basis. There have been no spills recorded on the project, to date. Raw cement/concrete or washings thereof, asphalt, paint or other coating material, oil or other petroleum products, or any other substances which could be hazardous to aquatic life, resulting from project related activities, shall be prevented from contaminating the soil and/or entering the waters of the state. These materials, placed within or where they may enter a stream/lake, by Operator or any party working under contract, or with the permission of the Operator, shall be removed immediately. No debris, soil, silt, sand, bark, slash, sawdust, rubbish, cement or concrete or washings thereof, oil or petroleum products or other organic or earthen material from any construction, or associated activity of whatever nature shall be allowed to enter into or placed where it may be washed by rainfall or runoff into, waters of the State. When operations are completed, any excess materials or debris shall be removed from the work area. Spear It is understood the Department has entered into this Streambed Alteration Agreement for purposes of establishing protective features for fish and wildlife. It is further agreed all liability and/or incurred cost related to or arising out of the Operator's project and the fish and wildlife protective conditions of this agreement, remain the sole responsibility of the Operator. The Operator agrees to hold harmless the State of California and the Department of Fish and Game against any related claim made by any party or parties for personal injury or any other damages. The Operator may request one extension of this agreement, subject to Department approval, prior to its termination. The extension request and fees shall be submitted to the Department's Region 5 office at the above address. If the Operator fails to request the extension prior to the agreement's termination, then the Operator shall submit a new notification with fees and required information to the Department. Any activities conducted under an expired agreement are a violation of Fish and Game Code Section 1600 et. seq. The City of Carlsbad has provide a copy of this agreement to all contractors, subcontractors, and the City's project management team. On top of the hill, near the manufactured slope for College Blvd, the dozer destroyed a number of pieces of aged metal irrigation pipe (used for irrigation of revegetated plants on the manufactured slope?). The pieces did not appear to have been in use. Other impacts seen during this work include one killed rattlesnake and a small amount of dust created by the mechanical equipment. 3. On the eastern side of hole 16, near the riparian area, I met one of the archeologists, who informed me that the area in which we stood, which was already bulldozed and scraped, was not supposed to have been scraped (for archeological purposes), but only to have had fill placed on top of the existing soil. The damage occurred the day before (9/21/05). Later in the day, the archeologists set pin-flags in this area, and GPS'ed the area. I monitored the dozing and grading of a new fill-access road that cut through an HRA, connecting the clubhouse area with hole 10. This road was authorized by Doug Gettinger a few days earlier. The road is intended for transporting soil from the top clubhouse area down to hole 10. A D10R dozer was used, cutting a road approximately 20 feet wide and 120 linear feet long through the HRA. Vegetation removed included approximately 90% non-native grassland, and 10% coastal sage scrub, with Artemesia califomica, Malacothamnus fasciculatus, and Malosma laurina. Soil cutting was profound, removing all topsoil. Impacts to the surrounding HRA include dirt clods being thrown off the road, sliding downhill into a small drainage. 3. Later in the afternoon, I monitored the D10R dozer on the far eastern side of hole 16/industrial area, removing vegetation. The gentleman operating the D10R dozer stopped working and told me that Brad need monitoring immediately on hole #13 green, for clearing was to begin soon. As I was waiting for Brad to arrive at the location, he drove up next to me and notified me that there had been a problem and that he recommends I observe it. I asked him what had happened and he said a dozer on the North side of hole #16 has penetrated the orange fencing and had cleared vegetation beyond the permit boundary. Brad was very upset at the situation and told me that he "specifically walked the operator through designated clearing area and thoroughly directed him what he was to do. (clear vegetation only on the inside of the orange fencing)" As I arrived at the incident location (approximately 1000), a Gallegos archeologist onsite, Nick, directed me to the exact area of the unapproved clearing. I asked him what had happened and he told me that he was here monitoring a Shinner on an archeological site when the operator stopped and asked him if they were allowed to work on the North side of the orange fence near the creek; Nick replied with no. The worker operating the Shinner notified Nick of the D6 dozer nearby; then proceeded to stop the operator of the D6 dozer and immediately notified Brad. 5. I walked and thoroughly observed the impacted area. I estimated the damage was approximately 100-150 meters long by 10-20 meters wide. Within this damaged vicinity, I observed two areas where the D6 dozer penetrated the riparian vegetation. In one of these two regions, the Dozer actually immersed dozer treds into the water. After analyzing the incident I called Doug to notify him of the problem. I began to record a species list for the impacted area and estimate how many willow individuals were taken (about 30). During lunch I returned to the Dudek office to get a digital camera and GPS unit to record this event. Unfortunately, no GPS unit was available; however, I was able to retrieve a camera easily and took many digital photos of the impacted area. Since no orange fence was present and the daylight stakes were not visible, I directed the gentleman operating the Shinner to carefully remove the vegetation until stakes were visible. The operator did a good job and stayed inside the perimeter of the daylight stakes (some debris from the shredding did fly out into the undisturbed vegetation). Dudek will return to GPS the impact area and determine the acreage of the unauthorized impacts and notify the city. It appears the area may be 0.1 to 0.2 acre total, with only a portion of that being riparian, but GPS will determine the acreage. 3. Doug and Mike also reviewed the gnatcatcher fence requirements and locations. Mike will investigate further before final determinations are made. 4. No erosion control installation has occurred yet. The contractor is significantly behind in the installation of this material, which is supposed to be fully in place by October 1. Orange construction fence still needs to be installed where it is missing. 5. The creek crossing has not had rock placed in it yet and Brad with Sema told me in the late afternoon that it will be done Monday instead of tomorrow as planned. Since they are not doing any clearing, Dudek will not have an environmental monitor onsite tomorrow. 6. Dudek investigated the areas where the groundwater monitoring wells are supposed to be installed. The Water Quality Monitoring Plan has a small figure showing approximate locations for the wells, but provides no other information. There is a large freshwater marsh below the waterfall, so this area is also inaccessible until well downstream into the golf course footprint. The creek in Macario Canyon bifurcates and the arm selected for the upstream monitoring well appears to be the drier of the two streams. Dudek believes that a suitable location at the upper end of the other stream might be more accessible, but might be a change requiring a Coastal Commission approval. The downstream well location shown on the figure appears to be well off the property about 125 feet off the road in undisturbed native habitat. There appears to be enough room to drill a well along the SDG&E easement road at the lower end of the golf course that will meet the plan's intent and is in the same general location. The lower surface monitoring point looks like it will be a bit tricky as well, as the creek area has dense vegetation with lots of marsh plants, so finding an open water location to collect from could be tricky. Dudek is not sure of where the City wants to place the third monitoring well, so I could not check access to this area today. 7. I notified the Marina workers to make sure the line is buried in the ditch to ensure that adequate fencing is underground. I walked around to evaluate the silt fencing and noticed that it was improperly attached to the orange fence along hole #13 fairway. I notified the workers to move the silt fencing to the inside of the orange fence before they began to dig a ditch and install it. 3. After lunch I continued to monitor the four gentleman move the silt fence to the inside of the orange fencing. 4. A worker from SEMA introduced himself and informed me that he required monitoring to place rock in a wetland area for an equipment passage. I directed him to stay between the marked daylight stakes. He did a great job. Rocks which fell over the permitted line, he shoveled back within the boundary using his CAT machine. After completely laying down this first layer of rock, Brad arrived and informed the CAT operator where pipe needed placement and to continue to fill rock over the placed pipes. After retrieving the pipes the operator informed me that he was finished for the day. 5. I returned back to the area where the silt fence was being installed, but the workers were no longer present. When I arrived, I noticed that the daylight stakes were positioned on the inside of the orange fencing (approximately 8-10'). Since the daylight stakes and the orange fencing are supposed to be aligned together, I called John P. to speak with him about the fencing placement. He said that he and Brad would meet me at my location soon to determine which markers were correct. I stopped the operator of the D6R dozer and explained to him the situation and my concern of clearing the dense ess vegetation. The operator told me that Brad specifically asked him to clear vegetation up to the orange fence. John P. and Brad arrived approximately 30 minutes later and decided that it would be to their benefit to preserve as much pristine ess as possible. Even though the operator had now already cleared majority of the dense habitat (15'x180') prior to their arrival, about 15'x90' of ess was salvaged. In addition, we decided to move the orange fencing around the saved habitat to secure it during future grating. 4. John P. and I walked the perimeter of hole #12 to ensure there were no more fencing issues; none were found. 5. We noticed that there were many places in which fencing needed to be installed. Also, there were areas that had been damaged due to dozer activity. Furthermore, multiple regions of the proposed silt fencing areas had been improperly placed (simply attached to the orange fence and not trenched in). Since there were two Marina Landscaping Co. crews working in distant areas from one another, we split up in order to effectively monitor them both. I monitored the crew located on the Eastern parcel of the project site (East of College Ave.), Doug on hole #16. They were installing silt fencing along the Eastern side of College Ave adjacent to the industrial development pad. I noticed they were not trenching the bottom of the fence in. Coincidently, Doug arrived and I told him about the problem. He notified the Marina foreman and proceeded to call individuals representing SEMA construction, since the foreman stated that SEMA told him to install it this way along the road. The Marina foreman replied that he did not want any trouble and that he would trench the silt fence in. When Doug spoke to the SEMA they notified him that an individual onsite would observe the situation. When this gentleman arrived, Doug also notified him of the additional problems of silt fencing covered by dozer activity. The gentleman replied by stating that he would fix those areas today. After the crew finished they moved to a location at the corner of Palomar Airport Rd. and College Ave. where silt fencing needed to be installed. I monitored the crew completely install the fence. When they were finished the crew went home (1530). Throughout the afternoon I also monitored the individuals from SEMA whom were fixing the silt fencing in the areas where it was destroyed. Because the site was so dry and the rainfall was no more than half an inch or so there appears to be no erosion problems so far. 3. Sema had bulldozers working some of the big slopes to turn the wet surface under and expose drier soil to soak up more rain. Marina Landscape has their small crews working on more silt fence installation. I found some minor erosion and sediment deposition on the silt fence between Holes 5 and 6 that needed immediate attention and pointed this out to Sema. 4. Brad Barnish with Sema asked me to look at a storm drain connection in the HMP above Hole 17. The storm drain is along an existing dirt access road with Hottentot fig iceplant and non-native grasses present, so this should not present any habitat issues to make the connection. 5. Dudek discovered numerous new locations where the orange environmental limits-of-work fence and/or silt fence have been run knocked over and/or buried under fill or sediment. Dudek observed at least five locations where sediment has been discharged outside the limits-of-work, including into jurisdictional "Waters of the U.S." and into sensitive coastal sage scrub habitat. This requires immediate notification of the U.S. Army Corps of Engineers in accordance with the 404 Permit issued for the project. Sediment and fill was discovered up against the silt fence in many locations project-wide. 4. Dudek observed that the contractor had submitted a signed SWPPP monitoring form certifying that the SWPPP was in conformance. Dudek observed that the contractor has made a few repairs to the erosion control, but none of the repairs conforms to the SWPPP (such as leaving gaps in silt fence where two pieces join, piling soil up against the silt fence, not removing silt accumulations against silt fence, etc.). The contractor's SWPPP certification report is at variance with site conditions and is not factual. Dudek recommends the City take up this issue with the contractor. 5. Dudek prepared a map documenting SWPPP violations that will be given to John P. on Monday morning, and sent e-mails to project staff at Dudek, the City, and Sema, with photos documenting the numerous violations. The size of the crews installing erosion protection is not proportionate with the task at hand, nor does the effort indicate the contractor acknowledges the urgency of the situation. Dudek recommends once again that the contractor not be allowed to grade areas where there is no environmental fence in place, and we also recommend that the contractor's grading operations be shut down until the SWPPP installation is in compliance. George Litzinger has brought in South Coast Erosion Control to help install erosion control at the direction of the City and they were present at the meeting. The Regional Water Quality Control Board has fined the City and will be back out to inspect the site again on Friday. George discussed division of labor for the remaining work and I discussed the need to install the erosion control materials in conformance with the SWPPP, which Marina Landscape has not been doing. I met with them after the meeting and they were unaware of the SWPPP requirements and when given a copy of the SWPPP, they did not understand the details until they were explained to them. 2. At the conclusion of the meeting South Coast Erosion Control began work along College Boulevard and Marina Landscape left the project site. When contacted later, they said they had to get materials. They returned towards the end of the day. He notified me as to where the different erosion control working crews were located and asked me to take an overall observation of the site and see if there are any places the silt fence either needs to be replaced or installed. I drove thoroughly through the project site parcels and analyzed the silt fencing status. First, I noticed an area on hole #16 where silt fencing may be required; on the south side of the fairway near a small canyon across from the previously impacted area (Pics. 3-4). Another area where silt fencing should be installed is along the haul roadway between holes #14 to #15. The silt fence installation is needed on the south side only, towards the creek (Pics. 5-6). On hole #15 directly bordering the creek crossing, west of the green, the current standing silt fence is not complete. Meaning, it ends and needs to be extended to the actual project boundary line (Pics. 7-8). Additionally, on hole #15 northwest of the proposed green location, silt fencing is required and must be installed within the project region of the creek (Pics. 9-10). Furthermore, on hole #15 in the middle of the fairway there is another area where silt fencing is not present. Possible silt fencing may be required on hole #6 surrounding the protection of a small isolated vegetation patch in the middle of fairway. 5. Fencing near the bottom eastern corner of hole #4 needs to be fixed again (see observation report for 10/15/05). Traveling west along the southern boundary of hole #4 I noticed an area where the installed fencing has been buried and needs to be replaced (Pic. 12). 6. A section of silt fencing on hole #7, directly across from the Callaway testing range and parallel to Palomar Airport Rd., has been buried and needs to be correctly fixed (Pic. 13). About 25m west along this same boundary fence is another location where silt fencing is buried and needs to be replaced (Pic. 14). 7. At the end of the site erosion analysis I informed and visually showed John P. of all the locations where silt fencing issues needed to be addressed. 8. The rock has been displaced due to all the heavy weight going back and forth over the rock layer laying on an uncompacted saturated area. This needs to be addressed right away or equipment will soon be operating in flowing water, which the permits prohibit. 4. There are still areas (Holes 15, 16, 17, etc.) where no orange construction fence has been installed. This fence needs to be installed as soon as possible. The project permits require this fence to be in place before work is done in the area. 5. The contractor has run over and buried a section of the orange construction fence and silt fence once again along the haul road between Holes 4 and 5. The fence needs to be repaired right away and the contractor should be reminded not to wait to be told to do the repairs when they inadvertently run over the fence. These areas include the path from the tunnel to the clubhouse, 18th fairway extension, violation area, drainage for the 8th hole, and the driving range. 2. Path from tunnel to clubhouse; the proposed path would be approximately 12 feet wide with an overall footprint of approximately 15 feet. No plans and specifications were available at the time of the site visit. Disturbed coastal sage scrub is the vegetation community in this area; black mustard is the dominant overstory species and California sagebrush if the dominant understory species. 3. 18th fairway extension; the proposed extension would encroach into nonnative grassland. 4. Violation area; this area is adjacent to Hidden Valley Road and was an encroachment into a preserve area. This has been previously documented by Dudek staff. At the time of this visit the silt fence in this area was not installed properly and is in violation of the projects SWIPP. Immediate correction is needed. 5. 8th hole drainage; this area was assessed to determine if habitat would be impacted by installing the drain pipes and their connection to a storm drain. The area where the work was scheduled to occur was outside of the limits of work and habitat was present. I did not allow work to be done in this area on this day. Review of the permits was needed to determine if the proposed action was covered under the projects permits. 6. Driving range; a small patch of disturbed habitat and disturbed coastal sage scrub occurs as an island in the middle of the driving range. This area was assessed for biological value. As an isolated patch of highly disturbed habitat this area has minimal biological value. Dudek met with John Przybyszewski adjacent to the 15th Hole and existing wetlands to discuss adjusting a construction fence to allow machinery to access the shooting range area. The new fence alignment was agreed upon and a SEMA crew moved the construction fence and the silt fence to the new location. A potion of a Brazilian pepper tree (Schinus terebinthifolius) and soil was removed to accommodate the realignment. The adjacent creek crossing was reinforced with gravel bags. It is planned that gravel bags, fill rock and steel plates will be installed to protect the creek crossing. 3. Dudek GPSed the limit of clearing and construction fencing at the realigned 10th Tee and at the location of the proposed maintenance access road between the 13th and 16th holes. The information was downloaded into the DUDEK mapping data base. 4. Erosion control issues identified in the field are as noted: a. The silt fence at the western end of the 14th hole has been buried by grading activities and dirt has been pushed into the adjacent ruderal habitat (predominantly black mustard [Brassica nigra}). The area is approximately 30 feet long and at widest 2 feet into the ruderal habitat. The silt fence needs to be reinstalled. 5. There is a potential problem in the northern middle portion of the 16th fairway where fill dirt has been pushed up against the silt fence and could push it over if more dirt slides down the slope. 6. The silt fence in the violation area on the 9th hole still has not been installed properly and in the western portion of the fairway and approximately 18 foot section has been removed and needs to be replaced. 7. The silt fence at the western portion of the 8th hole near the drainage has been removed and needs to be reinstalled. 8. The silt fence on the haul road for the 5th hole has been run over and needs to be reinstalled. 9. The silt fence for the cart path between the 4th and 5th holes on the south side has had soil from grading pushed against it and in some places the silt fence has been buried. This is adjacent to coastal sage scrub; however the areas with the fill are small patches of ruderal habitat. 10. The silt fence on the College Road side of the fairway of the 4th hole has been impacted by fill soil and needs to be reinstalled. 11. Fill soil on the haul road for the 16th hole has been buried or knocked down in numerous places and needs to be unburied and/or reinstalled. 12. Dudek recommends repair of any compromised BMPs found on site as there is a 40% chance for rain on Saturday. BMP's at all creek crossings should be installed as well. 5. Dudek took pictures and inspected the intersection of Hidden Valley Drive and Palomar Airport road at the location of the proposed monument sign. This location was evaluated because of its adjacency to native vegetation. CA-SDI-8303 near Hole 16 was being grubbed by scrapers. Dennis Gallegos requested that Brad Bamish (SEMA) halt scraping activities in this location, as CA-SDI-8303 was to be avoided by heavy equipment and capped with fill soil as per the mitigation report. Gallegos and Doose conducted a survey of the site area using transects at 5 m intervals. No cultural material was observed. Dennis Gallegos had a meeting with Brad Barnish, and John Przybszewski (Heinbuch Golf, LLC). Barnish and Przybszewski determined that they would like all of the remaining cultural resource sites mapped and staked to avoid any miscommunication. Monitor's Signature Page 1 of 2 Notes From Dennis Gallegos Project: CARLSBAD GOLF COURSE MONITORING NOTES Date: 9/21/05 Time: 8:30-ll:00am Notes: Visited CA-SDI-8797, end of Hidden Valley Road and noted cul-de-sac meeting, as well as brushing and clearing of vegetation in progress adjacent to and east of CA-SDI-8797. Gallegos was not notified of work adjacent to CA-SDI-8797 or the need for a monitor. Met with Kalid Dawood, Brad Barnish, John Przybyszewski, and Doug Gettinger with respect to archaeological site area staking, site avoidance, capping and fill measures for archaeological sites CA-SDI-8797, CA-SDI-8303, CA-SDI-14563, and CA-SDI-14565. Kalid was to provide Gallegos with a digital copy of the grading plans. For site CA-SDI- 8694, data recovery, and field monitoring of the grading of this site has been completed. For CA-SDI-8797, Gallegos visited the site, checked the location of stakes, surveyed for artifacts and midden in the cleared/grubbed area, located adjacent to and east of site. A few debitage artifacts and a few shells (small Chione sp., Mytilus sp. possibly recent fill material) were noted. Soil was a very silty loam, beige to light brown in color, and was not the color of the archaeological midden in the area adjacent and west (protected/open space area). In addition, recent transient camp debris was noted at the east edge of the archaeological site. Nick Doose to recheck site boundary stakes placed by survey crew around CA-SDI-8797 for agreement. Around 2:30pm, Dennis Gallegos noticed clearing at CA-SDI-8303 and Gallegos and Doose visited site CA-SDI-8303. Clearing and grubbing was in progress, however Gallegos & Associates was not notified of heavy equipment or the need for a monitor in the area of the Late Period Luiseno village (CA-SDI-8303). Scrapers were noted clearing the area, and then it appeared that the scrapers were beginning to grade the archaeological site. At this time (around 3:30pm) that Gallegos called Brad Barnish (SEMA) to notify him that clearing of the site had been completed and that the site was beginning to be damaged by additional scraping. Barnish moved the scrapers off the site. Shortly after the removal of the scrapers, a D8 dozer moved on to the archaeological site and began to clear brush adjacent to the north fence line at CA-SDI-8303 and started to scrape and grade into the archaeological site. Gallegos notified the operator to halt activity, and the operator called Barnish. Brad Barnish, John Przybyszewski, and Dennis Gallegos had a meeting on site at CA-SDI-8303, and Przybyszewski recommended a lighter weight (rubber wheeled) vehicle, such as a D4 or D6 to clear vegetation from the northern portion of site CA-SDI-8303. The area adjacent to and south of archaeological site CA- SDI-8303 was given clearance for grubbing, and the D8 proceeded to clear vegetation. As a result of the field meeting, it was agreed that Gallegos & Associates would map and stake archaeological sites: CA-SDI-8303, -8797, -14563, and -14565. Gallegos & Associates will also provide a digital copy of site locations on development plan maps. Nick Doose staked off the remainder of the southern edge and half of the northern edge of cultural resource site CA-SDI-8303 from 8:30am- 4:00pm. Karen Hovland performed a survey of the graded and grubbed area east of Hidden Valley Road, and west of College Blvd., along ridgelines and slopes closest to Palomar Airport Road. Upon arrival at the grubbing location, an excavator with a saw was waiting for a monitor to arrive. After Nick Doose spoke to the operator, he began to clear large trees on the south side of the orange silt fence. At approximately 9:30am, a D6 dozer arrived on site. The dozer operator removed a small section of orange silt fence, and drove the dozer north toward the creek. The dozer operator then proceeded to clear vegetation on the north side of the orange silt fence, within biological open space just south of the creek. The dozer operator cleared approximately 150 meters by approximately 8 meters of riparian brush, north of the orange silt fence, within biological open space. At one point, near the middle of the cleared area, the dozer operator drove throuRh the heavy brush and into the middle of the creek. The operator of the excavator with saw notified Brad Barnish (SEMA) of the biological area cleared by the dozer operator. Clearing and grubbing in the immediate area was halted for the remainder of the day. Gallegos was spot-checking the project area and met Barnish at the end of Hidden Valley Rd. Gallegos monitored clearing of brush (grubbing) at CA-SDI-8797 by a D6 dozer, and called Nick Doose to monitor grubbing at CA-SDI-8303. Gallegos observed some artifacts including a mano fragment, fire-affected rock, and debitage on the surface of CA-SDI-8797 as the dozer grubbed in a south to north orientation. However, no artifacts were collected. Grubbing at CA-SDI-8797 was completed by 9am. Gallegos requested a trench be excavated in the area of the pad to identify presence/absence of buried cultural deposits. After review of the trench, it was determined that the pad was the result of previous grading and filling, and that no intact cultural deposit was present. Gallegos arrived at site SDI-8797 at 8:2Qam and approximately 30% of the site SDI-8797 Area C had been cement capped. In all, 17 truckloads of red slurry were spread over Area C to ensure protection. D. Gallegos monitored the completion of the slurry operation. In the afternoon, D. Gallegos visited CA-SDI-8303 and noted that vegetation had been removed from the west portion (north of the creek) of CA-SDI-8303. It appears that this work was completed on Thursday without an archaeological monitor. Vehicle tracks were very noticeable as it had rained on the previous Sunday and Monday. The western area surveyed, as well as the northeast comer of CA-SDI-8303. Elevation stakes were noted across CA-SDI-8303. Cat 14H grader Yes Type: Cultural areas Type: Type: CA-SDI-8303 Cultural Action/Comments: Larry Tift and Dennis Gallegos arrived at approximately Sam. Grading commenced around 9am in the northwest portion of cultural resource site CA-SDI-8303. Larry Tift was the monitor. Topsoil (dark clay loam) was shallow and was present primarily within a 10 m (E/W) x 40 m (N/S) area near the west edge of the grading area. A trace of highly fragmented shell was observed in this soil. As the area appeared to have been previously disturbed likely from agricultural activities and Faraday Rd. construction, a large portion of the grading area was comprised of subsoil or was mottled (dark clay loam and subsoil).
