HomeMy WebLinkAbout; La Costa Reimbursement Study CRMWD; La Costa Reimbursement Study CRMWD; 1979-12-07December 7, 1979 LA COSTA REIMBURSEMENT STUDY Approved and Accepted by the Board of Directors Costa Real Municipal Water District on April 1, 1981 Prepared by Woodside/Kubota & Associates, Inc Carlsbad, California LA COSTA REIMBURSEMENT STUDY On January 19, 1972, an agreement was made between the La Costa Land Company and the Carlsbad Municipal Water District (now the Costa Real Municipal Water District). A portion of this agree- ment stated that the Water District would prepare an engineering study and establish a "Refund Agreement" with the La Costa Land Company so that the Alga Road Water Main capacity not utilized to serve the initial La Costa area would be reimbursed to La Costa, Since the initial La Costa area is not completely developed, it was necessary to make a detailed study of the present and proposed population within the area so that the total water demand could be analyzed. The population study has been completed based upon all figures available as of July 1979. In order to be as accurate as possible the study included all existing developments, ten- tative maps, development trends and land zoning. The results of this portion of the study are included in Table I. The areas in the Table are shown on the attached map, which also delineates the service area of the La Costa community. The number of dwelling units for all developed areas was based on the number of lots within the subdivision. The R2 areas were analyzed as having a duplex on each lot. In partially completed condominium areas we estimated future units based on the building trends of the adjacent parcels. In undeveloped areas we estimated the number of units based upon the maximum units allowed according to present zoning. For the MD zoning, 10 dwelling units per acre were utilized and in the MHD zoning we utilized 20 dwelling units per acre. For all Rl and R2 zoned areas we utilized 3.5 people per dwelling unit. For densities above 10 units per acre we figured 3.2 people per unit and for condominiums of 20 units per acre we figured 2.6 people per unit. These figures may be a little higher than the present census of the area, but the trend is for these numbers to increase as the cost of the newer houses i ncreases. For the hydraulic analysis we utilized the same figures that were used in the initial study in the La Costa area. Mainly 170 gallons per capita per day, average use, a peak day requirement of 340 gallons per capita and a peak hour of 680 gallons. Fire flow requirements were based on the need for the hotel and commercial area of 5,000 gallons per minute (gpm). This fire flow is sufficient to cover the total La Costa development. For the hotel and commercial area we util- ized the initial flow into the area that was included in the Rick Engineering Study of 1,005 gpm for a maximum day. This figure appears to be reasonable as it is very difficult to analyze the many different uses in the area. If the 117 acre area were irrigated utilizing three (3) acre feet per year and watered just during eight (8) hours of night time use, the total requirement would be 656 gpm. If it were analyzed as 20 units per acre it would re- quire 1,437 gpm and, therefore, the 1,005 gpm was utilized. -2- In the Alga Glens area the original plans indicated 680 units and this was utilized in the study. Recent plans indicate that these units may extend to the North of the initial La Costa area. In the Alga Hills area a tentative map indicates that 66 acres of land could develop to the maximum density allowed by the City of 20 units per acre, yielding a total of 1,320 units. This figure is higher than the preliminary plan of the area, but is not too far above some of the other existing condominium developments in the study. The 1,320 units were utilizW, however, no additional units were considered for the adjacent undeveloped portions of the La Costa Estates North Area, which is presently zoned PC. In the Alicante Hills area a tract map, which conforms to the present zoning and the land use map, indicates most of the area as Rl with the exception of two large condominium lots for which 20 units per acre were projected as shown in Table I. The total population estimate for the original La Costa study area is 15,777 people housed in 5,672 units. This compares with an original projection at the time of the design of the Alga Road Main of approximately 7,227 units and a population of 20,152. Based on the above figure of 15,777 times 340 gallons a day per capita equals 3,725 gpm. Adding to this flow the hotel area re- quirement of 1,005 gpm and a fire flow of 5,000 gpm yields a total water requirement of 9,730 gpm. A peak hour flow without any fire flow would be 9,460 gpm. -3- The original design of the Alga Road pipeline for the 27-inch line from the proposed reservoir site to Corintia Street was 26.66 cfs which equals 11,965 gpm. The demand for the La Costa area of 9,730 is 81.32 percent of the capacity of the 27-inch pipeline. For the 21-inch main from Melrose to the proposed reservoir site the original design was for 13.33 cfs for the Carlsbad Municipal Water District, which equals 5,982 gpm. The San Marcos County Water District also had an allocation of 5 cfs in this waterline which was funded separately. This line furnishes water to the reservoir, which will store water for peak hour flows and fire flows. Therefore, the 21-inch pipe was designed to carry only the maximum daily requirement. For the population of 15,777 this is 3,725 gpm, plus the hotel area of 1,005 gpm for a total of 4,730 gpm. This is 79.06 percent of the initial design flow in the 21-inch line. The original cost of the 21-inch line in Alga Road from Melrose to the proposed reservoir site was $46,336.97. The above figures indicate a use of 79.06 percent of this line and the remaining 20.94 percent would be excess capacity and is valued at $9,702.96. For the 27-inch line the total cost was $110,757.26 and the initial La Costa Study area utilized 81.32 percent of this line so the excess capacity would be 18.68 percent or $20,689.46 giving a total value for both lines of $30,392.42 as excess capacity not utilized within the initial La Costa Study area. There were other facilities built along with the Alga Road 21-inch and 27-inch -4- mains mentioned above, which included many facilities which were required only for the La Costa development. Since these items have no excess capacity or cannot be utilized to the benefit of any other areas no reimbursement is justified. There is one item, a pressure reducing station, constructed along with the 27-inch line at a cost of $17,185.00. Based on the same percentage indicated for the 27-inch line the pressure reducing station would also have the 18.68 percent excess capacity for an additional reimbursement of $3,210.16 giving a total possible reimbursement of $33,602.53 for the excess capacity in the Alga Road main. REIMBURSEMENT OPTIONS Any actual reimbursement of the aforementioned amounts can only be accomplished when excess capacity in the Alga Road line is utilized elsewhere. At the present time the Rancho Carrillo Estates Developments No. 1 and 2 are temporarily connected to the Alga Road line until a future main is constructed to the North. This future main will provide an alternate emergency source of water for the La Costa area and the new proposed La Costa North Area. The main area that can use the surplus capacity in the Alga Road line is the La Costa North Area. Present zoning in this area indicates a possible added population of 10,400 which would more than utilize the excess capacity. It would appear advisable to reserve the excess capacity for this La Costa North Area. -5- If a reimbursement is made now from the funds deposited by Rancho Carrillo Estates it would then be possible to consider the temporary connection as a permanent one and a portion of the excess capacity would be assigned to that area and would not be available in the future for the La Costa North Area. AGREEMENT THIS AGREEMENT, made this to fa day of J»frv «•«•*>- Y a , 1971, betv;een CARLSBAD MUNICIPAL WATER DISTRICT, a municipal water district, hereinafter for convenience referred to as "DISTRICT", and LA COSTA LAND COMPANY, an Illinois corporation, hereinafter for con- venience referred to as "LA COSTA". EIT-NEJl^ETH: 1. Recitals. This agreement is made in light of the follow- ing facts and circumstances: A. As a condition of approval of the LA COSTA MEADOWS subdivisions Units No. 1, 2 and 3 by the DIS- TRICT, LA COSTA is obligated to construct certain pipelines and pumping facilities which form the public water system of said subdivisions. B. As a condition of approval of LA COSTA MEADOWS Subdivision Unit No. 2 by SAN MARCOS COUNTY WATER DISTRICT, LA COSTA is obligated to construct certain pipelines and pumping facilities which form the public water system of said subdivision. C. In lieu of the pumping stations now required and pipelines now required in ALGA ROAD by the DISTRICT and SAN MARCOS COUNTY WATER DISTRICT for the prior approved subdivisions of LA COSTA MEADOWS, LA COSTA is willing to finance the construction of one transmission main in ALGA ROAD to meet the require- ments for water service to LA COSTA MEADOWS subdivisions for prior approved subdivisions and for the benefit of other real property owned by LA COSTA in the DISTRICT and in Improvement District No. 2 of the DISTRICT. D. LA COSTA is in agreement that the DISTRICT sponsor the con- struction of the major trans- mission main in ALGA ROAD that will also accomodate the public water system requirements for the portions of the LA COSTA MEADOWS subdivisions already approved lying within the boundary of the SAN MARCOS COUNTY WATER DISTRICT. E. The SAN MARCOS COUNTY WATER DISTRICT and the DISTRICT have by separate agreement, estab- • -2- lished the terms and conditions under which a joint pipeline is to be constructed and the interim water service contract that will provide the immediate water supply. F. The DISTRICT has prepared the plans and specifications and contract documents for the ALGA ROAD Trans- mission Main under the title "CONTRACT DOCUMENTS AND CONSTRUC- TION SPECIFICATIONS, TRANSMISSION MAIN FOR ALGA ROAD PROJECT, PRO- JECT NO. 7127, November, 1971", said documents and plans and specifications incorporated herein by reference. G. The DISTRICT has also advertised for bids for said construction, opened the bids at a public meet- ing, and have received an apparent low responsible bidder. H. To facilitate the time schedule for the construction, the DIS- TRICT has already arranged for and placed a purchase order for the fabrication and delivery of a portion of the pipeline that will be located within LA COSTA MEADOV7S UNITS NO. 2 and 3. I. After approval of the entire -3- • project by SAN MARCOS COUNTY WATER DISTRICT and execution of a joint powers agreement for construction and maintenance and operation of the transmission main and the deposit of the necessary security for the con- struction project by LA COSTA, the DISTRICT will proceed to award the construction contract and proceed with the construction. 2. Cost of Project and Deposit. LA COSTA agrees to pay all of the costs of the DISTRICT in the construction of the ALGA ROAD Transmis- sion Main, including, but not limited to, the amount of the construction contract, engineering fees and costs, legal expenses, the cost of the acquisition of neces- sary easements and all other expense actually incurred in the construction of said transmission main and neces- sary appurtenances. LA COSTA is depositing $240,000.00 by an irrev- ocable commitment of funds under Escrow No. 3121, Title Insurance and Trust Company, according to terms and condi- tions of an agreement dated January 7, 1972, a copy at- tached hereto as Exhibit "A" and incorporated herein by reference. The said sum of $240,000.00 is the estimated cost of said project. Should the expenses incurred by the DISTRICT be in excess of said deposit, LA COSTA shall pay the amount of such excess to the DISTRICT on demand. Should the expenses incurred by the DISTRICT be less than the amount deposited, DISTRICT shall refund to LA -4- COSTA the difference upon completion of the work and 'its acceptance by DISTRICT and SAN MARCOS COUNTY WATER DISTRICT. 3. Easements and Rights of Way. LA COSTA, at the expense of LA COSTA, shall furnish to the DISTRICT any necessary easements, docu- ments and title policy (policies) to insure title of all necessary easements in the record name of the DIS- TRICT and SAN MARCOS COUNTY WATER DISTRICT. The DIS- TRICT shall determine the acceptability of any neces- sary easements, documents and title policy (policies). In the event that it may be necessary to ac- quire any easements or rights of way by eminent domain proceedings, the DISTRICT agrees to take any necessary steps to secure such easements and rights of way. All costs for such easements and right of way acquisitions will be a part of the total project cost. 4. Construction by LA COSTA. LA COSTA agrees to rough grade the proposed easterly extension of ALGA ROAD to not less than a twenty foot width road section so that the new trans- mission main can be properly located in the future street right of way. 5. Refund Study. The DISTRICT agrees to prepare an engineering study and establish a "refund agreement" with LA COSTA, so that LA COSTA will receive reimbursement for that por- tion of the cost of the transmission main, wherein the excess pipeline capacity will benefit lands within the -5- DISTRICT other than the lands of LA COSTA. 6. Meters. The DISTRICT shall contribute all expenses relating to the metering that are a part of the ALGA ROAD Transmission Main Project. ,7. Books and Records. The DISTRICT shall keep and maintain proper books of account and records in which complete and cur- rent entries shall be made of all transactions, relating to the acquisition, construction, administration and engineering connected with the construction project. LA COSTA shall have the right at reasonable times, from time to time, during regular business hours, to inspect all such books and records. IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by its duly author- ized officers as of the day and year first above written. In consideration for the Carlsbad Municipal Water District entering into that certain Agreement with La Costa Land Company, a copy of which is attached hereto, and causing to be constructed the improvements therein mentioned, we agree to set aside from the construction funds at Title Insurance and Trust Company, under Escrow No. 3121, funds in the amount of $240, 000. 00, to be used exclusively in paying for those improvements in the project above mentioned, and as provided under the terms of the above mentioned Agreement. The escrow covering this project will provide that as the work progresses, the funds will be disbursed to you under our voucher system, supported by invoices and releases to cover the costs of said improvements and for no other purposes. In the event that La Costa Land Company shall fail to pay for such improvements as required in said Agreement, the Trustees of Central States, Southeast and Southwest Areas Pension Fund, will, upon your written certification stating that the invoices mentioned above have not been paid and enumerating the amounts Carlsbad Municipal Water District Carlsbad, California January 7, 1972 Page 2 payable, make such funds remaining in said escrow of said $240, 000. 00, immediately available to the Carlsbad Municipal Water District to complete and pay for the cost of said improvements. The Carlsbad Municipal Water District shall not in any way be obligated to repay such funds so used, provided however, the amounts paid to the District, pursuant to this Letter of Credit, shall not exceed the said sum of $240, 000. 00. This is an irrevocable commitment of funds which is not subject to recall by the Trustees of Central States, Southeast and Southwest Areas Pension Fund. If this letter meets with your approval, please so indicate by signing the enclosed two copies at the places indicated and deliver them to J. A.
