This is written per your request in order to reference our
conversation of a couple of weeks past concerning the accompanying
plans for the Katherine Baum as-built room addition.
As was then discussed Mrs. Baum was not aware at the time she
purchased her home that a room had been added to it without a
building permit. She has done nothing illegal and now must pay the
price for the former owner's actions. She has gone to great effort
and expense in order to comply with the City's building codes and
settle this matter.
In light of this, we were hoping that the City would relax the
requirement that the existing retaining wall be moved to four feet
from the room addition from the existing three feet. Could this
situation possibly jeopardize the public safety or the structural
soundness of the building? I think not. It is certainly unlikely
enough that you should not cause this woman the enormous expense
that moving the wall would incur.
