Who May Prepare Plans
Provisions of Assemblyman Condit's bill AB 2313 were amended
into SB 790, authored by Senator John Seymour, which has been
signed into law and became effective January 1, 1986. (Chapter
1327, Statutes of 1985).
this measure contains two important items. First, it cleared up a
long-standing conflict between the Architects Act and the Engi-
neers Act in which one act allowed plans to be prepared by certain
individuals, while the other act did not permitthis. Thetwo actsare
now the same. The second important item from the bill limits the
architectural or engineering services that an unlicensed person
may perform.
The following excerpt from the bill addresses the exceptions to
the requirement that a licensed civil engineer or architect must sign
plans.
Section 6737.1 of the Business and Profession Code isamencled

All heating, ventilating, air conditioning, and water heating equipment shall meet all of the
requirements of the Appliance Efficiency Standards and shall be certified by the California Energy
Commission.
A two stage thermostat,. which controls the supplementary heat on its second stage, shall be
provided for heat pumps.
Thermostats shall be equipped with an automatic setback, which the building occupant can program to
automatically set back the thermostat twice in 24 hours.

conforms the requirements of Title 24, Part 2, Chapter 2-53, and that the materials installed
conform with the requirements of Title 20, Chapter 2, Subchapter 4, Article 3. The certificate
shall state the'manufacturerl s name and material identif itation, the installed 1711 value, and (in
applications of loose fill insulation) the minimum 'installed weight per square foot consistent with
the manufacturer's labeled demity for the desired 1711 value.
For infiltration control all openings and penetrations must be caulked and sealed, such as around
windows, at sole plates, and openings for utility*pipes and wires.
