Thank pu for your prompt reply of December 21 to our request for variance in the installation
of spa equipment, specifically heater venting. Health and safety are rightly of paramount concern
and we want to do what is best in that regard. If our neighbors to the north and south lived on the
property line, then the Cht limitation would be best for health and safety. However, there is not a
structure adjacent to the property line. If the spa heater were located in the south side yard in
compliance with the Uniform Mechanical Code Section 806.7, the vent termination would be located
approximately 16 feet from the south neighbor’s house and directly opposite the kitchen/family
room. Installation at this location would also requk greater disruption of the environment in terms
of trenching and excavation. If the variance were granted for the north side installation, the vent
termination would be located at least 27 feet from the north neighbor’s house and be directly
opposite their driveway and garage. Envknmental disruption is minimal since the gas/electric lines
and meters are very close to the proposed installation. The heater, which the contractor proposes to
use, is a stack less, open grate type that stands 34 inches high. There is a Ght h@ cinder block
wall that separates the pn>perties and would shield the heater and equipment from the neighboring

I!& believe that granting the variance in this case would actually ensure greater compliance with
the intent of the Uniform Mechanical Code in that safety and health issues are addressed by having a
greater separation of the vent termination from human habitation. There is no possibility of some
future construction of a habitable structure just on the other side of the property line since the
Aviara Master Association prohibits additions of this type. Therefore, we are respectfully requesting
a reconsideration of our request for variance and would be pleased to discuss our request with pu
at pur convenience.

Re: Location of Spa Equipment

I am in receipt of the request for a spa equipment variance dated December ltjth. The
request is to allow the spa equipment to be installed closer than 4 feet to the property
line. That request must be denied with respect tmThe vent
termination for a gas fired spa heater is required to be at least 4 feet from the property
lines. The Uniform Mechanical Code Section that specifies this requirement,\s_enclosed
for your reference. Gas vent termination is a health and safety issue 'knd cannohe
waived even with the current neighbors' and the home owners' association consent.
Please note the required distance to openings into the house as well as the property
line setback. The other equipment needed to run the spa is not specifically regulated by
code with respect to property line adjacency however. The spa filter, pump, and blower
(air intake) may be located closer than 4 feet to the property line, Howevetyna part of
the vent for the gas heater may be within 4 feet of the property liq. Electric spa heaters
are not subject to this 4 foot setback obviously because there are no gas by-products of
combustion associated with their use.

Dear Sir:
We are requesting a variance for the Cfoot clearance from property line requirement for spa
equipment. Our lot is narrow and our choices are somewhat limited. The spa equipment footprint is
3 x 7 feet and the width from the house to the property line is 6 feet on the north side where we
would like to place the equipment. We believe that the north side of the house is the best choice for
our spa equipment for the following reasons:
1. The north side location affords the greatest distance from neighbors and minimizes any
noise or fumes generated by the equipment. Distance from the north side property line to
the nearest structure of our neighbor, a garage is 24 feet. Moreover, the north side
adjacent house is set on a pie shaped lot, which further removes the house from the
equipment. A six-foot concrete block wall separates the equipment from the neighboring
properties.
2. The Aviara Master Association has approved the plans for the spa equipment on the
north side, which is the same side as the builder installed air conditioning units.
3. A location on the south side, while not requiring a variance, would be a less preferable
location. The distance from the south property line to the neighboring house is 10 feet 6
inches and the equipment would be opposite the south neighbor’s kitchen and family
room.
4. The neighbors to the north, Mr. and Mrs. Rosenthal, at 1334 Bulrush Court have
concurred with this request for variance.
Please see attached sketch for details of the request for variance.
