Mr. Ran admitted that there is a floor system within his house. He'said it Was built
recently without permits by an unlicensed contractor. I asked him about the use. He_
was evasive about the matter, but he mentioned that headroom was a problem. He
estimated headroom clearance to be 5'8". I told him that the area could be processed
as storage or utility space, but it still had to meet the structural code provisions. No
wiring, telephone, cable or other articles of habitation would be allowed there.
I suggested he hire a designer to create plans as though he was proposing the project. - -
The plan should accurately depict the construction as-built. City plan check would
determine- compliance with the structural code provisions. He was told that
inspections will need to be made following that permitting process and would involve
at leaartial demolition to inspect. End.''- .

Dear Sir,
This letter i in response to your questions and concerns regarding your building
permit numberCB92-592. Your letter questions the need to inspect the interior of.
your house because you added an exterior deck. Since you have a second story deck
with no exterior stairs or access, the question of accessibility does apply to your
permit. It is possible that a second story has been created inside your house.
Records with the City of Carlsbad Building Department and also with the San Diego
County Assessor, show no history of a second story ever being permitted or
inspected at 1446 Forest Avenue
The Uniform Building Code, Sections 202(c), 301(a); 305. and 3306 all pertain to
requirements of construction which may have, been undertaken at your house.

ORGANIZATION AND ENFORCEMENT
Creation of Enforcement Agency
Sec. 201. There is hereby established in 'this jurisdiction a code enforcement
agency which shall be under the administrative and operational control of the
building official.
Powers and Duties of Building Official
'Sec. 202. (a) General. The building official is hereby authorized and directed to
enforce all the provisions of this code. Forsuch purposes, the building official shall
have the powers of a law enforcement officer.
The building official shall have the power to render interpretations of this code
and to adopt and enfOrcerules and supplemental regulations in order to clarify the
application of its provisions. Such interpretations, rules and regulations shall be in
conformance with the intent and purpose of this code.
Deputies. In accordance with prescribed procedures and with the approval
of the appointing authority, the building official may appoint such number of tech-
nical officers and inspectors and other employees as shall be authorized from time
to time. The building official may deputize such inspectors oremployees as may be
necessary to carry out the functions of the code enforcement agency.
Right of Entry. When it is necessary to make an inspection to enforce the -
provisions of this code, or when the building official has reasonable cause to be-
lieve that there exists in a building or upon a premises a condition which is contrary
to or in violation of this code which makes the building or premises unsafe, danger-
ous or hazardous, the building official may enterthe building or premises at reason-
able times to inspect or to perform the duties imposed by this code, provided that if
such building or premises be occupied that credentials be presented to the occupant
and entry requested.'If such building or premises be unoccupied, the building offi-
cial shall first make a reasonable effort to locate the owner or other person having
charge or control of the building or premises and request entry. If entry is refused,
the building official shall have recourse to the remedies provided by law to secure
entry.
Stop Orders. Whenever any work is being done contrary to the provisions of.
this code, or other pertinent laws or ordinances implemented through the enforce-
ment of this code, the building official may order the work stopped by notice in
writing served on any persons engaged in the doing or causing such work to be
done, and any such persons shall forthwith stop such work until authorized by the
building official to proceed with the work.
Occupancy Violations. Whenever any building or structure or equipment
therein regulated by this code is being used contrary to the provisions of this code,
the building official may order such use discontinued and the structure, or portion
thereof, vacated by notice served on any person causing such use to be continued.
Such person shall discontinue the use within the time prescribed by the building

Dear Mr. York,
Thank you fdr your letter dated December, 2, and for returning my.cop of the
permit application I would reply as follows
As for the outdoor electrical outlet, please note first that it is located-not 'within'
the deck but underneath it. It predates the deck, obviously was not designed for
use in conjunction with the deck, is highly unfeasible for such use and indeed has
never been used and is not now being used in this manner. Second, and formost,
- beacusé this is an elevated (wood) deck, any person using it would be far removed
and insulated from the ground, thus deriving nil safety benefit from a Ground-Fault
Interruptor. Therefore any rationale for a GFI is unrelated to the deck's existence.
Consequently an uprade is unnecessary.
As to the stairway, I would point out that it loo predates the deck, is not in any
physically connected to the deck, and is used to jrovide access within the house.
Consequently, in my opinion, the stairway falls outside the 'scope of the project
- and does not require an inspection.
J hope that the foregoing clarifications. will sufficd to ielve all out tndimatters'
relating to the permit, making a final approval possible" However, should you wish

Enclosed ypu will find your copy of the original approved plan. Also, ydu will find a
copy of your proposed knee brace revision for the post to beam connection at the garage
: wall. This proposal was not implemented and not aproved. Instead, an additional post
was added at that. corner near the garage per City request.
The exterior electrical outlet .that requires the ground-fault circuit-interrupter (GFI) is
located within the. deck. Since it is part of the áreaof improvement, the upgrade of a
GFI outlet is necessary. S .. . . .
The request to inspect the interior of the house is within the scope of the deck permit.
Since- you have an elevated deck with no exterior stairs to the deck, the only way to
access the deck is from the interior of the house Therefore, this requires an inspection
of any stairs for minimum code requirements. ..

Dear Mr. Ran,
The City received two letters from you on May 10. One letter was addressed to
myself and the other to Inspector Paul York. Your letter to me requested an extension
of the above referenced, building permit. This extension will be granted for a period
expiring June 3, 1994. No further extensions will be granted;
Building permit 92-592, for constructing a deck, was issued in June of 1992. By then
the deck had already been built. No inspections were requested or made, and that
permit expired by limitation on June 19, 1993 A renewal permit was issued on
September 8,1993. . During a final inspection of the deck, Mr.York requested
admission to the residence on November 3, 1993. Your January 5, 1994 response to
Mr.York contained a statement to the effect that there is a second story within your
residence unrelated to the deck. CountyTax Assessor records.and City Building Permit
records show no history of a second storyever being permitted at 1446 Forest.
Your May 51etterstates that by issuing Building Permit .92-592 the City implied a
promise to.final the deck, and that the City should have known about .any other
unpermitted construction at your home based on the.Building Permit. application.
Uniform Building Code Section 303(c) states," The issuance or granting of a permit
or approval of.plans, specifications and computatiOns shall not be construed to be .a
permit for, or an approval of, any violation of any of the provisions of this code or of
any other ordinance of the jurisdiction."
If a second story has been constructed within your house without building permits,
you should now take steps to secure building permits and legalize it without further
delay and debate. If there is no illegallyconstructed second floor, simply allow an
inspector to verify this by June 3,1994, and the City will final building permit

This is in response to your letter of Ap±i1 11. -As I' understan , the <I'
reason you now give for witholding final approval on the deck pr
your apparent suspicion that access to the deck is provided through
unpermitted second story, this suspicion being based on the information
that, (a) deck is elevated without extrior.access, (b) no record of
second story permit. -
Without commenting upon the merits of your suspicion, I would point out
that the a1leged information i purports to be based upon i5a matter -
of city record available, and presumably known, to the .City'at the time of
initial permit application. Perhaps, this might have been used by the City
as grounds for denying said application' However, the City gralited the permit,
thus giving me the green-light to go through the considerable trouble and
expense of constructing the deck. In so doing, the City clearly made an
implied promise that if the deck is built in accordance with plan and
specs, then it will be approved,-barring, perhaps, unfoseen circumstances.,.
Cl-early, information previously known or readily available does not
constitute such an unforseen circumsance. -
I, am unaware of any Building Code-or similar provision that would
legitimise a City's reneging on an implied promise as above. If you are
aware of same, please advise accoidingly.- Otherwise, I hopeto have -your
final approval of the deck project without further delay.

Our records indicate that your building permit will expire by limitation
of time on 05/02/94.
The provisions of UBC, Section 303(d) state: "EXPIRATION. Every permit issued
by the Building Official under the. provisions of this code shall expire by
limitation and become null and void if the building or work authorized by such
permit is not commenced within one calendar year from the date of such permit,
or if the building or work authorized by such permit is stopped at any time
after the work is commenced for a period of six consecutive calendar months or
if the building or work authorized by such permit exceeds three calendar years
from the issuance date of permit. Work shall be presumed to have commenced if
the permittee has obtained a required inspection approval of work authorized
by the permit by the building official within one year of the date of permit
issuance. Work shall be presumed to be stopped if the permittee has not ob-
tained a required inspection approval of work by -the building official within
each six month period upon the initial commencement of work authorized by such
permit.
Before such work can be recommenced, a new permit, or a renewal permit as
specified below, shall be obtained.
1. PERMITS WHERE WORK HAS NOT COMMENCED. For permits where work has
not commenced in the first calendar year frqm the date of issuance, a renewal
permit may be obtained provided:
(A) No changes have been made or will be made in the original plans and
specifications for such work.
-(B) That the expiration has not exceeded three years from the original
issuance date.
(C). That the same edition of the model codes is in effect as used in
the initial plan check.
(D) That a fee equal to one-half the amount required for a new permit
be paid.
The renewal permit shall expire three calendar years from the date of initial
permit issuance.
