That City agrees to record any irrevocable offers of dedication made by Property Owner for Valley Street Buena Vista Way and McCauley Lane. Section 2. That Property Owner, in lieu of making the hereinafter descri- bed improvements before approval of said Building Permit No. CB 891349 is granted, agrees to install and construct, or cause to be installed or constructed, said improvements in accordance with plans and specifications approved by the City Engineer within sixty (60) days after written demand so to . do by City. Property Owner shall not be required to make said improvements before January 31, 1991, or within such further period of time as is granted by City, provided, however, that upon the happening of either of the following occurrences said improvements may, at the sole election of City, be required to be made sooner than said date or such extended period of time which may have been granted by City: (a) When the City Council finds that the owners of 40% or more of the frontage, including the frontage of Property Owner, between intersecting streets on both sides of the street upon which the property herein described has frontage, have agreed with City to install street improvements to City speci f i cat i ons . (b) When owners of more than 50% of the frontage, between intersect- ing streets on both sides of the street upon which the property herein described has frontage, have petitioned the City to form an improvement district for the improvement of said streets. Said improvements shall be made without cost or expense to City. City I estimates that the cost of engineering and construction of said improvement at the time of signing this contract is two hundred fifty nine thousand eight hundred sixty one and OO/lOO DOLLARS ($259,861 .OO) . Property owner hereby acknowledges that said cost is a reasonable estimate of engineering and construction costs at this time and that the actual cost of same at some time in the future may exceed this estimate. Section 3. That for the faithful performance of the promises and covenants herein contained, Property Owner hereby grants to City a lien upon the hereinafter described property in the amount of $259,861 .OO plus any future increases of cost in excess of this sum resulting from increased engineering and construction costs, and in the event Property Owner, Property Owner's successors, heirs, assigns, or transferees fail to install and construct said improvements in the manner and within the time specified herein, Property Owner agrees that City may do any or all of the following: (a) Have the necessary engineering for said improvements done, and install and construct said improvements by contract or otherwise. City or its contractor and contractor's employees may enter upon any portion or portions of the property reasonably necessary for said engineering and construction, and the entire cost and expense shall be charged against said property and payable by said Property Owner, Property Owner's successors, heirs, assigns or transfe- rrees immediately upon completion of said improvements. In the event same is not paid within thirty (30) days from completion, City may foreclose said lien as provided by law for the foreclosure of mortgages. (b) Direct the City Engineer to estimate the cost of necessary en- gineering, and the work required to install and construct said improvements, r -- and foreclose said lien in said amount. (c) Pursue any remedy, legal or equitable (including those specifi- cally referred to herein), for the foreclosure of a lien, and the Property Owner, Property Owner’s successors, heirs, assigns and transferrees, shall be 1 iable for reasonable attorney‘s fees as a cost in said proceedings. Section 4. That it is agreed that anything herein contained to the contrary notwithstanding, the promises and covenants made herein shall not be binding upon the holders , mortgagees, or benef i ci ari es of any purchase money mortgage or purchase money deed of trust for value which has been or may in the future be executed by the Property Owner, Property Owner’s successors, heirs, assigns or transferees, and the lien hereby created shall be and is hereby subordinated to and declared to be inferior and subsequent in lien to the lien of any such purchase money mortgage or purchase money deed of trust. The lien hereby created shall likewise be of no force or effect against any owner whose title to the property hereinafter described is acquired by or as a result of a foreclosure or trustees‘ sale of any such purchase money mortgage or purchase money deed of trust. Section 5. .That at any time during the period herein provided, the Property Owner, Property Owner’s successors, heirs, assigns or transferees may deposit a cash bond or post a surety performance bond satisfactory to the City to charge said surety with the cost of said improvements; the amount of bond to be the estimated cost of engineering and improvements at the time of such deposit or posting as ascertained by the City Engineer, and that upon deposit of said cash or posting of said bond the City agrees to release the property, or any portion of it as to which said deposit or posting applies, from the provisions of this agreement, and to execute any necessary release to enable the record title of the property to be released from the lien herein imposed. Section 6. Said City shall not, nor shall any officer or employee thereof,, I I I be liable or responsible for any accident, loss or damage happening or occurring to the work or improvements specified in this agreement prior to the completion and acceptance of the same, nor shall said City, nor any officer or employee j thereof, be liable for any persons or property injured by reason of said work or improvements, but all of said liabilities shall be assumed by said Property Owner and Property Owner’s successors, heirs, assigns or transferees, and they shall save the City harmless from, and indemnify the City against, any and all 1 claims, suits and liabilities of or to any person or property injured or claiming to be injured as a result of said work or improvements. Said Property Owner, and Property Owner‘s successors, heirs, assigns or transferees, further agrees to protect said City and the officers and employees thereof from all liability or claim because of, or arising out of, the use of any patent or patented article in the construction of said improvement. Section 7. It is further agreed that said Property Owner will at all times up to the completion and acceptance of said work and improvements by the City, give good and adequate warning to the traveling public of any dangerous or defective conditions of public property. The Property Owner hereby agrees to pay for such inspection of improvements as may be required by the City Engineer of City. Section 8. This agreement and the covenants contained herein shall be binding upon and inure to the benefit of the successors, heirs, assigns and transferees of Property Owner, shall run with said real property, and create an equitable servitude upon said real property. The purpose of the investigation was to determine if the site is suitable for the proposed single family dwelling. The scope of the investigation was to: A. Determi ne the physical properties and engineering characteristics of the surface and subsurface soils. 6. Provide design information with regard to grading, site preparation, and foundation design of the proposed structures. 2. LOCATION AND DESCRIPTION OF SITE The site is located at 1835 Buena Vista Way, in the City of Carlsbad, California. The 4.3 acre rectangular shaped lot is bordered by Val ley Street ‘to the southwest, Buena Vista Way to the northwest, McCaully Lane to the southeast, and a single family dwelling and agricultural development to the northeast. Site topography consists of gently terrain sloping downward to the west and southwest. The site is presently utilized for agricultural purposes. the southeast region of the property and the remaining land is utilized for cultivating crops. FIELD INVESTIGATION The field investigation was performed on October 17, 1989, and included an inspection of the site and the excavation of six exploratory trenches, with a backhoe to depths of ten feet. SOIL CONDITIONS Loos? surficia1,soils eilty-sands) consisting of plowed ground were found to be 2, 2', 1-1/2, 1-1/2, 2' and 2' in depth in Test Pit No.'s 1 through 6, respectively. Underlying native formational soils to depths explored were medium dense to dense si1 ty-sands (coastal terrace deposit). Expansive soils were not observed in any of our test pit excavations. Therefore, no consideration need be given this characteristic. Groundwater was not encountered at the time of our investigation, nor did caving of exploratory trenches occur. 5. LABORATORY SOIL TESTING All laboratory tests were performed on typical soils in accordance with accepted test methods of the American Society for Testing and Materials (ASTM). Tests conducted include: (1) Maximum Density & Optimum Moisture (2 Direct Shear (Remold) (3 Sieve Analysis (4 Field Density & Moisture (5) Expansion Potential (conducted in accordance with requirements of the City of San Diego Test for Expansive Soils.) RECOMMENDATIONS & CONCLUSIONS General It is our understanding wood frame construction utiziling slab on grade foundations are planned. Grading +Genera 1 Project No. CL-2297 October 26, 1989 Page 3 Grading at the site will be required to remove and recompact loose surficial soils and to construct a level building pad to accommodate the proposed residence. All grading should be performed in accordance with the City of Carlsbad Grading Ordinance and the Recommendations/Specifications presented in this report. Subsequent to site demolition, loose surficial top soils (plowed ground), as indicated on attached Plate NO'S. 2 and 3, should be undercut or removed to firm native ground and recompacted in accordance with attached Appendix "Bl' enti tl ed "Recommended Grading Specifications.'' We should be contacted to inspect and/or test imported soils prior to hauling them on-site to assure they will be suitable for the proposed construction. & We should be contacted to document firm native (Note: If encountered, leach lines and/or pipes should be removed. Concrete pipes may be crushed in-place. Trench lines should be recompacted in accordance with Appendix "B" . It is highly probable the proposed structure will be traversed by,a transition from cut to fill. Therefore, to reduce structural damage occurring from foundations bearing on two different soils types, the following measure should be employed. It is recommended the cut side of the transitional areas be removed to a depth of one foot below the bottom of the deepest proposed footing and brought back to grade with properly compacted fill. This will allow the proposed structure to bear entirely on a compacted fill matt, thus reducing the probability of differential settlement. Slopes Cut and compacted fill slopes constructed to maximum of heights of 15 feet with minimum slope ratios of 2:l (horizontal to vertical units) will be stable with relation to deep seated failure provided they are properly maintained. During grading, positive drainage away from top of slopes should be provided. Subsequent to completion of grading, slopes should be planted, as soon as possible, with light groundcover indigenous to the area. I 6D. Retaining Walls For static conditions the prevailing soils will have an allowable equivalent passive fluid pressure of 369 psf, increasing 369 psf per foot of depth. Allowable pressures assume walls are backfilled with a non-expansive sand a distance behind the wall equivalent to two-thirds of retained height. Allowable active pressures may be assumed to be equivalent to the pressure of a fluid weighing 38 pcf for unrestrained walls. Therefore, should soils encountered during construction differ from those presented in this report, we should be contacted to provide their engineering properties. INTENT The intent of these specifications is to provide general procedures in accordance with current standard practices regarding clearing, compacting natural ground, preparing areas to receive fill, and placing and compacting of fill soil to the lines, grades and slopes delineated on the available plans. Recommendations set forth in the attached preliminary soils investigation report and/or special provisions are a part of the "Recommended Grading Specifications" and shall supersede the provisions contained hereinafter in the case of conflict. 2. INSPECTION Q TESTING A qualified soil engineer shall be employed to inspect and test the earthwork in accordance with these specifications and the accepted plans. It will be necessary that the soils engineer or his representative be allowed to provide adequate inspection so that he 'may certify that the work was or was not accomplished as specified or indicated. It shall be the responsibility of the contractor to assist the soil engineer and to keep him appraised of work schedules, changes, new information and dates, and new unforeseen soils conditions so that he may make these certifications. If substandard conditions (questionable soil, poor moisture control, inadequate compaction, adverse weather, etc.) are encountered, the soil engineer will be empowered to either stop construction until the conditions are remedied or recommend rejection of the work. HATERIALS .* Those soils used as fill will have a minimum of 40 percent passing a 44 sieve. They will be free of vegetable matter or other deleterious substances 'and contain no rock over six inches in size. Should unsuitable materlal be encountered, the soil engineer will be contacted to provide recommendations. 4. PLACING AND SPREADING OF FILL The selected fill material shall be placed in layers which when compacted will not exceed 6 inches in thickness. Each layer shall be spread evenly and shall be thoroughly blgde mixed during the spreading to insure uniformity of material in each layer. When the moisture content of the fill material is below that recommended by the soil engineer, water shall then be added until the moisture content is as specified to assure thorough bonding during the compacting process. When the moisture content of the fill material is abov-e that recommended by the soil engineer, the fill material shall be aerated by blading or other satisfactory methods'until the moisture content is as specified. 5. COMPACTION After each layer has been placed, mixed, and spread evenly, it shall be thoroughly compacted to not less than 90% relative compaction. Compaction shall be by sheepsfoot rollers, multiple-wheel pneumatic tired rollers or other types of rollers. Rolling shall be accomplished while the fill material is at the specified moisture content.
