The Planning,Department has completed the latest-building ancheck reiiew for the proposed 98
square foot addition to the residence located at 1898 Forest Ave The existing structure specifically-
, the garage; does not meet the required front yard setback requirement of 20 feet, as measured from
the front property line. This causes the building to be an existing non-conforming building due to
S inadequate setbacks, and as such, limits the amount of improvements that can -be done. The total
amount of expansion for non-conforming buildings is 40 percent of the existing floor area. The
- Planning Departmenthas determined, through a review of past building permits, that the maximum
amount of.expansion for the building has been reached. To allow any additional expansion, the

an FIA can be allowed. Our standared practice has been for Engineering to make that determination. As
standard practice, construction of the improvements are always required unless, it would cause a!
detriment to the citizen's health, safety or welfare. In Mr. Piro's case our recommendation is that that •

The procedure for Mr. Piro to appeal this requirement is to make a written request to you for an FIA. Per
CIVIC 18.04.070 you would make the decision in writting as to whether findings can be made to allow a". ,--

As per our recent telephone conversation, your building plan check (CB 98-1428) for a 1,050 square foot
room addition will expire 30 days from the date of this letter unless a building permit is issued within that
time. Although your application for building permit would have technically expired on 5/12/99, your
application did not expire since the City agreed to keep it active until various issues regarding future street
dedication and improvements were resolved. Those issues have since been resolved.
