Our records indicate that your building permit will expire by liitation of time on 1/25/2000.
The provisions of UBC, Section 106.4.4 as amended by the Carlsbad Municipal Code state: “EXPIRATION.
Every permit issued by the Building Official under the provisions of this code shall expire by limitation and
become null and void if the building or work authorized by such permit is not commenced within one calendar
year from the date of such permit, or if the building or work authorized by such permit is stopped at any time
after the work is commenced for a period of six consecutive calendar months or if the building or work
authorized by such permit exceeds three calendar years from the issuance date of permit. Work shall be
presumed to have commenced if the permittee has obtained a required inspection approval of work authorized
by the permit by the Building Official within one year of the date of permit issuance. Work shall be presumed
to be stopped if the permittee has not obtained a required inspection approval of work by the Building Official
within each six month period upon the initial commencement of work authorized by such permit.”
Before such work can be recommenced, a new permit, or a renewal permit as specified in the attached copy of
the code. shall be obtained.
Any person holding an unexpired permit may apply for an extension of the time within which he may
commence work under that permit when he is unable to commence work within the time required by this
section for good and satisfactory reasons. The Building Official may extend the time for action by the
permittee for a period not exceeding 180 days upon written request by the permittee showing that
circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be
extended more than once.

regulating energy conservation, noise attenuation and disabled access. This plan review is
based on regulations enforced by the Building Department. You may have other corrections
based on laws and ordinances enforced by the Planning Department, Engineering Department
or other departments.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1994 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.

Submit three sets of plans for commerciallindustrial projects (two sets of plans for
residential projects). For expeditious processing, corrected sets can be submitted
in one of two ways:
1. Deliver all corrected sets of plans and calculations/reports directly to the
City of Carlsbad Building Department, 2075 Las Palmas Drive, Carlsbad, CA
92009, (760) 438-1 161. The City will route the plans to EsGil Corporation and the
Carlsbad Planning, Engineering and Fire Departments.

Corporation, 9320 Chesapeake Drive, Suite 208, San Diego, CA 92123, (619)
560-1468. Deliver all remaining sets of plans and calculations/reports directly to
the City of Carlsbad Building Department for routing to their Planning, Engineering
and Fire Departments.

When the character of the occupancy or use changes within a building, the
building must be made to comply with current Building Code requirements for the
new occupancy. Please provide complete details to show the building will

UBC Section 107.2 requires the Building Official to determine the total value of
all construction work proposed under this permit. The value shall include all finish
work, painting, roofing, electrical, plumbing, heating, air conditioning, elevator,
fire extinguishing systems and any other permanent equipment. Please provide a
signed copy of the designer's or contractor's construction cost estimate of all

At your request Environmental Risk Management International, Inc. (ERMI) has been
instructed to prepare a Hazardous Materials Technical Opinion Report and hazardous
materials inventory evaluation for the tenant improvements proposed for your new
manufacturing facility. This Hazardous Material Technical Opinion will be submitted
along with the proposed building plans to the City of Carlsbad and their subcontractor the
Esgil Corporation. EM has categorized your operations and the various materials and
finished products used and manufactured at your new facility with respect to their fire
safety and toxic release safety as required by the Uniform Fire Code, Uniform Building
Code, and Uniform Mechanical Code in the State of California. The specitic code that
were used to evaluate the operations of this facility are as follows:
Following is a technical opinion report based on the proposed usages of hazardous
materials at Sulzer Calcitek new facility. The requirement for preparation of this technical
opinion report is allowed by the Building Code Planning Official (UBC Section 307.1.6)
to determine ifthe stringent requirements of the UBC and UFC for handling of hazardous
materials in H-1, (hazardous occupancy, high explosion hazard) H-2 (hazardous

hazard), or H-7 (hazardous occupancy, health hazard) occupancies are met.
Figure 1 presents a general floor plan (not-to-scale) of the facility, which indicates where
the hazardous materials are to be either stored or used at the new facility. Table 1
presents a summary of the usage and storage of hazardous materials, which pose a
physical hazard at the new facility. Table 2 presents a summary of the usage and storage of
hazardous materials, which pose a health hazard at the new facility. Figure 2 presents a
more localized floor plan (not-to-scale) of the facility, which indicates the specific
materials identified in Tables 1 and 2 for the R&D Lab, Particle Control Room, QA Lab,
and the Warehouse. Figure 3 presents a more localLzed floor plan (not-to-scale) of the
facility, which indicates the specific materials identified in Tables 1 and 2 for the Machine
Shop, Manufacturing Stage I Room, and the Manufacturing Stage I1 Room.
ERMI has determined that the hazardous materials to be used and stored at Sulzer
Calcitek will be below the exempt quantities specified in UBC Table 3-D and UFC Tables
7902.54 7903.2-B and 8001.15-A for fire and physical hazards. The materials are below
the exempt amounts for storage, closed use, and open use. ERMI has determined that the
hazardous materials to be used and stored at Sulzer Calcitek will be below the exempt
quantities specified in UBC Table 3-E and UFC Table 8001.15-B for health hazards. The
materials are below the exempt amounts for storage, closed use, and open use. The
specific increases for use in a facility equipped with a fire suppression sprinkler system
have been accounted for in the exempt limits specified in Table 1 and Table 2. Even
though the inventory of hazardous materials present in the R&D Laboratory,
Manufacturing Stage II, the Machine Shop, and the QA Laboratory will be stored in
approved flammable liquid and corrosive liquid cabinets, I have not incorporated the
allotted increase for these materials as a result of these cabinets.
The building as a whole will be an F-1 (moderate hazard factory) occupancy with a B
(business) occupancy office area. The building will be type V-N (non-combustible) fire-
resistive construction (non-combustible walls, one-hour fire-resistive combustible
roofkeilings). The building will have approximately 20,100 ft2 floor area in the
manufacturing F-1 area and approximately 20,580 ft2 (in two levels) in the B office area.
The total building footprint will be about 40,700 ft2. The facility is hlly equipped with a
fire suppression sprinkler system.
As required by UBC 1202.2.2 which states that areas using liquids with flash points below
200°F (Chs I, II or IIA Liquids) must have mechanical exhausting of the flammable
vapors at a rate of at least six air changes per hour and a floor level exhaust pick-up. The

following work areas at the Sulzer Calcitek facility, which will require this type of
ventilation, are as follows:

A brief description of these areas along with the Warehouse is presented below:
R&D Lab
The materials that are to be used in the R&D Lab are specified in Table 1 and 2. AU
materials will be stored in an approved flammable storage cabinet or and acid storage
cabinet. All materials will be used under a laboratory fume hood. The fume hood is
equipped with a down draft pick-up located along the back wall of the hood. The hood
will operate at greater than one air change per minute, significantly higher than the 6 air
changes per hour. The hme hood will exhaust the air directly outside through the roof
through an 8-inch diameter duct by a fan located on the roof. This would provide enough
ventilation to ensure that less than 1% of LEL is reached for the use either of isopropyl
alcohol or acetone. The mechanical ventilation contractor will provide information
detailiig the compliance with the flammable-vapor conveying-requirements of UMC
Sections 505 and 609. The compressed gasses will be stored in accordance with UFC
Section 7402. The
compressed gasses will be used in accordance with UFC Section 7403. AU valves and
fittings will be secured and leak-tight prior to being operated. The compressed gasses will
be used under the fume hood. The Propane cylinder is less than the 250 cubic feet
specified in UFC Section 8001.15.2.3.5, and is used to support the burner located in the
he hood.
The bottles will be secured to the wall in an upright position.

materials will be stored in an approved flammable storage cabinet or and acid storage

Particle Control Room
The materials that are to be used in the QA Lab are specified in Table 1 and 2. The
acetone and isopropyl alcohol will be stored in an approved flammable storage cabinet.
The acetone and isopropyl alcohol will be used at each worktable and will be dispensed
plastic squirt bottles or cans. The Particle Control Room is essentially a modified clean
room. The contractor responsible for constructing the room has specified that there will
be 15 to 20 air changes per hour from this room. The contractor has also specified that
the draft pick-ups will be located at ground level and will be vented directly to the outside.
The draft pick-ups will be located in the general proximity of the worktables to ensure that
the flammable vapors emanating from the acetone and isopropyl alcohol are captured. The
15 to 20 air changed per hour, coupled with the very low usage rates of isopropyl alcohol
or acetone, I have calculated that the air in the ventilation ducts which is to convey the
flammable vapors will to be less than 3% of LEL. The mechanical ventilation contractor
will provide information detailing the compliance with the flammable-vapor conveying-
requirements of UMC Sections 505 and 609.
Warehouse
The only hazardous materials that are to be stored in the warehouse are calcium oxide and
ammonium nitrate. The calcium oxide will be stored in it’s own secondary containment
vessel. The ammonium nitrate will be stored in is own flammable storage cabinet. Both of
these materials will be secured from the general flow of traffic.
Machine ShOD
The materials that are to be used in the machine shop are specified in Table 1 and 2. The
isopropyl alcohol will be stored in an approved flammable storage cabinet. The isopropyl
alcohol will be used at a work table located along side the outside facing wall. The table
will be equipped with a back-draft fume hood where the isopropyl alcohol will be used.
The fume hood is equipped with a down draft pick-up located along the back wall of the
hood, The hood will operate at greater than one air change per minute, significantly
higher than the 6 air changes per hour. The fume hood will exhaust the air directly outside
through the roof through an 8-inch diameter duct by a fan located on the roof. This would
provide enough ventilation to ensure that less than 1% of LEL is reached for the use of
isopropyl alcohol. The mechanical ventilation contractor will provide information
detailing the compliance with the flammable-vapor conveying-requirements of UMC
Sections 505 and 609. The Acetylene and Oxygen cylinders are less than the 250 cubic
feet specified in UFC Section 8001.15.2.3.5. The two cylinders are anchored to an
approved mobile cart and are to be used only for maintenance purposes.

Manufacturine Stage I Room
The hazardous materials that are to be used in the Manufacturing Stage I Room are
calcium oxide and ammonium nitrate. As mentioned previously the calcium oxide will be
stored in it’s own secondary containment vessel, located in the warehouse and the
ammonium nitrate will be stored in is own flammable storage cabinet, also located in the
warehouse. The Manufacturing Stage I Room has a large stainless steel mixing vessel
where the two materials are mixed with the appropriate quantity of distilldde-ionized
water. The maximum quantity of calcium oxide that would be present in this room at any
one time would be 200 pounds. The maximum quantity of ammonium nitrate that would
be present in this room at any one time would be 20 pounds.
Manufacturing Stage 11 Room
The materials that are to be used in the Manufacturing Stage 11 Room are specified in
Table 1 and 2. The two IB flammable liquids, acetone (12 gallons) and Isopropyl alcohol
(20 gallons), will be stored in an approved flammable storage cabinet. The isopropyl
alcohol and acetone will be used at a work table located along side the outside facing wall.
The table will be equipped with a back-draft fume hood where the isopropyl alcohol will
be used. The fume hood is equipped with a down draft pick-up located along the back
wall of the hood. The hood will operate at greater than one air change per minute,
significantly higher than the 6 air changes per hour. The fume hood will exhaust the air
directly outside through the roof through an 8-inch diameter duct by a fan located on the
roof This would provide enough ventilation to ensure that less than 1% of LEL is
reached for the use of isopropyl alcohol. The mechanical ventilation contractor will
provide information detailing the compliance with the flammable-vapor conveyhg-
requirements of UMC Sections 505 and 609.
The Manufacturing Stage 11 Room will also be the location of the hydrogen and argon
compressed gas manifold system. The compressed gasses will be stored in accordance
with UFC Section 7402. The bottles will be secured to the wall in an upright position.
The compressed gasses will be used in accordance with UFC Section 7403. AU valves and
fittings will be secured and leak-tight prior to being operated. The manifold system will be
located alongside the wall adjacent two the two plasma booths. The system and bottles
will be located within a galvanized steel enclosure equipped with two (2) self-closing
doors and a ventilation system. The ventilation system will puU air from the
h4anufacturing Stage 11 Room through the enclosure and directly to the outside. The
enclosure will have negative pressure in relation to the Manufacturing Stage 11 Room.
The hydrogen and argon gas cylinders are less than 250 cubic feet in size as specified in
UFC Section 8001.15.2.3.5, and are to be used to support the plasma equipment located
in the two adjacent plasma booths.
Upon review of the materials and their intended use, the proposed quantities of flammable,
combustible, and hazardous materials used and stored at this facility are below the exempt

quantities allowable for this building. The intended use of these materials complies with
the UBC, UFC, and UMC.
Sulzer Calcitek currently has approved HMBPs for their existing facilities. I will complete
the revised Hazardous Materials Business Plan, which will incorporate this new
construction. The revised HMBP will be submitted to the San Diego County Department
of Health Services, Hazardous Materials Management Division by February 19, 1999.
The copies of the Material Safety Data Sheets for the materials outlined here in this report
are quite voluminous. Should the Esgil representative request a copy of each MSDS one
should be made available. I have used the most recent copies of the MSDS available in
the preparation of this evaluation, and they are available at your request.

We visited the jobrite on September 16, 1999 to visually examine the equipment and found it
to be generally in conformance with applicable electrical standards with the following
exceptions:
1. Fuse replacement and disconnect power signs are missing on some of the
equipment.
Some control transformers do not have adequate overcurrent protection 2.
3. Some of the equipment has too many conductors under one ground termination
and the control enclosure doors are not bonded to the equipment ground.
Some equipment requires equipment nameplates or additional nameplate
information.
The ground fault protection for a few motors is not adequate.
Some components do not appear to be listed and may require replacement.
When the above discrepancies have been corrected, we will submit a final report for your
review and approval.
ET1 requires power to the equipment so that we may complete our testing with the equipment
under normal, full load operating conditions.

approved plans on the subject project, to account for minor field changes. In
summary, the field changes have to do with the gauge and spacing of metal stud
walls to be constructed on the project and the addition of a detail which depicts
framing for “hard lid ceilings in selected rooms. The changes (marked on the
