This letter is addressing the field changes made to the feeder for the Refrigeration Rack RK1.
The sizing of the feeders was specified for a 730 Amp load, When the equipment arrived on the job
site the name plate rating was 601 Amps maximum fuse size. Our owner and engineer made the
decision to change the 3 paraUel 300MCM CU. to 2-parallel 350MCM CU.from the 1000A.
Disconnect switch to the Refrigeration Rack RK1, which allows 310 AMPS per phase for a total
Arnpacity of 620 AMPS. This complies with the N.E.C. art. 430 for motor conductor protection and
the revisions will be resubmitted through the City Department of BuUding and Safety for as built
approval before final inspection.

Generally the plans are incomplete and a thorough plan check can not be
done, the following list is a general list only and corrections may follow.
1. Plans and calculations shall be signed by the California state licensed engineer
or architect where there are structural changes to existing buildings or structural
additions. Please include the California license number, seal, date of license
expiration and date plans are signed. Business and Professions Code.
2. Provide a statement on the Title Sheet of the plans stating that this project shall
comply with the 2001 edition of the California Building Code (Title 24 ), which
adopts the 1997 USC, 2000 UMC, 2000 UPC and the 1999 NEC.
3. Provide a description of the use of the dock office, it appear to be an employee
lounge? Sectim1 106.3.3.
4. Provide an exit analysis plan (may be 8 1 /2" x 11" or any convenient size). Show
in this analysis the occupant load of each area, the general exit flow patterns (by
using arrows), accumulated occupant loads and required exit widths. Please
provide a justification of the occupant loads within the coolers.
5. Revolving, slidir:ig and overhead doors are not permitted as exit doors if the
occupant load exceeds 9, the occupant load of cooler #2 should be 21. Section
1003.3.1.2.
6. Please revise the plans to show the second exits from the coolers to comply with
section 1004.2.2 of the building code.
7. Please provide the ICBO listing information and installation information for the
cooler.

8. Please provide plans and calculations signed by the California State licensed
engineer or architect for the structural attachment and lateral bracing of the
coolers, the mezzanine dock office, and all equipment supported from and
mounted on the roof structure of the building and the cooler ceilings etc. Include
all calculations and finding on the plans. Please include the California license
number, seal, date of.license expir~tion and c;Jate plans are signed. Business and
Professions Code. ·
9. Provide complete structural details on the plans with cross referencing as
needed to show the structural framing will comply with the design calculations
and building code requirements. Section 106.3.3.
10. Provide a section view of all new interior partitions. Show:
a) Type, size and spacing of studs. Indicate gauge for metal studs. Specify
manufacturer and approval number or indicate "to be ICBO approved".
b) Method of attaching top and bottom plates to structure. (NOTE: Top of
partition must be secured to roof or floor framing, unless suspended
ceiling has been designed for partition lateral load).
c) Wall sheathing material and details of attachment (size and spacing of
fasteners).
d) Show height of partition and suspended ceiling, and height from floor to
roof framing or floor framing.
11. Please indicate if stockroom shelving exceeding 8' will be installed and part of
this review? If so please provide complete plans and calculations for the
installation of the shelving.
12. Please provide complete electrical plans.
13. Please provide electrical load calculations.
14. Please provide panel schedules, indicate new and existing loads. Please indicate

24. Detail how floor drain trap seal is to be maintained. UPC Section 1007.0 (floor

25. Show that water heater is adequately braced to resist seismic forces. Provide
two straps (one strap at top 113 of the tank and one strap at bottom 1/3 of the
tank). UPC, Section 510.5.
26. Show P & T valve onwater heater and detail drain line route from P & T valve to
the exterior. UPC Section 608.4.
27. Show 1/4" per 12" slope on drain and waste lines. UPC Section 708.0.
28. Note on the plans that new water closets and associated flushometer valves, if
any, shall use no more than 1.6 gallons per flush and shall meet performance
standards established by the American National Standards Institute Standard
A 112.19 .2. H & S Code, Section 17921.3(b ).
29. Provide mechanical ventilation in all rooms, capable of supplying outside air at a
minimum rate of 15 cubic feet ·per minute per occupant. UBC, Section 1202.2.1.

33. The completed and signed ENV-1 ,'LTG-1, and MECH-1 forms must be imprinted

34. When alterations, structural repairs or modifications or additions are made to an
existing building, that building, or portioh of the building affected, is required to
comply with all of the requirements for new buildings, per Section 11348.2. These
requirements apply as follows:
a) The area of specific alteration, repair or addition must comply as "new"

b) A primary entrance to the building and the primary path of travel to the
altered area, must be shown to comply with all a_ccessibility features.

EsGil's July 2004 corrections advised the architect to imprint the policy onto the plans for reference. Had
this been done by the architect, this situation would have been averted prior to installing line sets in
violation of the policy. The architect indicated there would be no equipment on the roof, and of course the
plan checker cannot then anticipate otherwise. That policy would have been provided to the architect had
the architect requested it and placed it on the approved plan as the plan checker advised in July. If the
architect noted there is no equipment on the roof, then there should be rio equipment, including line sets
on the roof. N9where ori the approved plans are there line sets shown traversing the roof.
Freon is not considered a hazardous substance, and it is commonly installed throughout residential and
nonresidential occupancies wio physical separation from the environmental system as a hazardous
substance. Of course technicians must have appropriate safety equipment {detectors) to maintain the
systems in a safe manner as we discussed. I am very sorry to hear of the industrial accident which caused
the death of someone so close to you.
I have forwarded this email and the other communications to the field inspector who will be your contact
for this situation. lh my opinion, this situation is exactly the type of situation the policy was put into place to
avoid-

roof mounted equipment, coduit, and piping that is consistent with the city's policy, please work through
the project inspector directly. His name is Tim Phillips.
the. Roof Mounted Equipment Policy was referenced in the initial plan check corrections which were
transmitted to the architect last July. As we discussed, there are many businesses in Carlsbad that
developed comprehensive roof equipment plans to rack and screen piping and ducting off the roof surface
directly. The City is amenable to these types of overall schemes that do not include laying long runs of
ducting, tubing, conduit etc directly on the roof surface.

We appreciate your time and Mr. Tim Phillips' time in this matter and ur;,derstand that you both have busy
schedules. However, what you have stated is not consistent with my conversations with Bosz
architecture. It is for this reason that I thought it would be constructive for all of us to meet face to face to
discuss and clarify what has transpired. I will summarize our case as part of this email and would be
'happy to meet with you should you have further comments, questions, or concerns.
It is my understanding that Gary Bosz never received the policies and procedure sheet that you are
referring to. The correction sheet from Esgil issued back in July asked if there were any roof mounted
equipment. Gary responded no, the evaporators would be located within the refrigerated space and
compressors were ground mounted. The issue was closed and a policies and procedure sheet that you
recently emailed me· was never provided to Bosz Architecture. (Also see fax from Bosz Architecture as
reference). Therefore, we (Clarion constructio11, BoszArchitecture, and Subzero Constructors) had
absolutely no knowledge that a city ordinance existed prohibiting roof top piping.
Without knowledge of the ordinance, we located the piping in accordance to engineering, maintenance
and safety considerations. ·
1. Maintenance -the valve groups associated with each evaporator (13 evaporators each with 3 valves)
would be easier to maintain and replace above the roof rather than in a confined attic space.
2. Safety -Freon, although not considered a hazardous material is colorless and odorless. If leaks
develop in a system, which is not uncommon, they typically occur at the valve groups. Because human
senses are not able to detect freon, leaks occurring in a confined space could be life threatening.
If the valve groups and piping are within an attic area and a leak develops, oxygen will be displaced. An
unsuspecting service technician or employee entering the area could very well pass out from the lack of
oxygen and eventually die if unattended to. This has recently happened to the son of Errol Briggerman.
Errol is the VP of operations of Vons and his son died from oxygen deprivation two weeks ago working in
a area where a freon leak had developed. He was unaware of the leak and was working in an attic area
where the leak had occurred. He passed out and then died. The system at Florexpo will have
approximately 5,000 lbs of freon. This is a significant charge and will have an serious effects if a leak
develops in a confined area. Hence, we kept as much piping outside as possible.
3. Engineering -Due to the roof slope, we are able to slope the piping back the main refrigeration
equipment. This allows us to recover any oil migration within the system, thus allowing for a more efficient
system.
The piping is constmcted. in a professional manner and they do not sitting directly above the roof nor are
they laying on wood sleepers. The piping is supported with quality pipe stands and is not visible from the
streets because the building is located on top of a hill and is one of the highest buildings in the area.
In summary, we hope that you· reconsider due to the following reasons:
1. We were not provided with the ordinance during plan check arid thus not properly informed.
2. For a system of this size, it would be safer to locate the piping outside of confined spaces.
· 3. For industrial applications whether ammonia or freon, piping above the roof is typically preferred and
industry standard. With proper installation of roof pipe stands and sealing of pipe penetrations the
infegrity of the roof is not jeopardized.
4. With the local' of this building, the installation can be considered aesthetically sensitive to the building
c;1nd adjoining properties.
5. the piping is piped in a neat and orderly fashion and kept as low as possible while still allowing a
gradual slope. We do not think it will restrict access to other parts of the roof for the fire department.
Furthermore, the fire department will have the advantage of seeing the valve groups, thus able to identify
the approximate floral room locals from above the roof.
6. SubZero also made an effort to submit detailed mechanical drawings for plan check in August. I
spake with Mr. Scott Burns and was informed that a drawing package had already been submitted by
Bosz Architecture and a permit had.already been issued. Since, the permitted drawing package showed
the local of the refrigeration equipment a separate ~ubmitt_al would not be necessary from Subzero. We
were told to proceed and that should the building inspector want to see more detail during an inspection,
to provide it for him at that time.
We understand the purpose of the city ordinance and respect it. In the future, we will know these
guidelines and address any concerns, if any, during the permitting pha$e. In this case, we were never
provided with the actual ordinance and thus unaware of the ordinance until yesterday. Please take this
and Florexpo's need to move into this building within the next two weeks into consideration.

2.0 DESCRIPTION
2.1 General:
The Metl-Span M-S Ill CFP and CFAP composite foam pan-
els are factory-assembled, metal-faced, sandwich. panels
with a chemically bonded, continuously foamed-in-place
plastic core. The panels are used as interior and exterior, non-
load-bearing wall or fascia systems for combustible and non-
combustible construction. Panels have model numbers
CF-30, CF-36, CF-42, CFA-30, CFA-36, and CFA-42, which
correspond to standard 30-, 36-and 42-inch (762, 914 and
1067 mm) widths. -Panel thicknesses are 2, 21/2 and 3 inches
(51, 63.5 and 76 mm) for noncombustible construction, and
2, 21/2;3, 4, 5 and 6 inches (51, 63.5, 76, 102, 127 and 152
mm) for combustible construction. Maximum panel length is
52 feet (15 850 mm). The panels recognized in this report
have identical side joints and liner profiles; the difference be-
tween the panels is the t'!xterior fascia skin. Three exterlor fas-.
cia profiles are available:. Fluted, Mesa, and ·Architectural
Flat. See Figure 1 for panel profiles. ·
2.2 Materials:
2.2.1 Panel Core: The core is a polyurethane foam plastic,
designated FE-219 or FE-242 (both manufactured by Foam
EnterpriSes, Inc.) and having a 2.0-pcf (32 kg/m3) nominal
density. The foam plastic has a Class I flame-spread:classifi-
cation and a smoke-developed rating of less than 450 when
tested in accordance with UBC Standard 8-1. The foam plas-
tic is continuously foamed-in-place into the core of the panel
during panel fabrication. ·
2.2.2 Panel Facings: Panel facing material is steel con-
forming to ASTM A 653 (SQ), 33 grade, with ASTM A 924,
Class G 90 galvanization. Facing materialthickness is No. 26,
No. 24 or No. 22 gage, with an uncoated metal thickness of
0.019, 0.024 or 0.03P0 inch (0.483, 0.610 or0.762 mm). The
panel sl<in material facing the exterior of the building is called
"Fascia Skin," and the panel skin material facing the interior
of the building is called "Liner Skin.• The fascia and liner skins
can have equal or different thicknesses. The three types
of fascia skin profiles are denoted by a single character, as
follows:
A = "Architectural Flar profile, having a maximum width
of 36 inches (914 mm).
F = "'Fluted"' profile, having a maximum width of 42 inch-es (1067 mm). . ·
M = "Mesa" profile, having a maximum width of 42 in,
es (1067 mm).
For example, product designation CF-42-FM-22/26 ir
cates a composite foam panel that has a 42-inch (1067 m
panel cover width, "Fluted"' fascia profile and "Mesa· liner p
file, and No. 22 gage [0.030 inch (0.762 mm)] and No. 26 gc
[0.019 inch (0.483 mm)] fascia and liner skin steel thi,
nesses, respectively.
2.2.3 U-(:lips: The U-clips are galvanized or stainl~ss ste
and measure 1 inch (25.4 mm) wide by 4 inches (102 m
tong by No. 14 gage [0.068 inch (1.727 mm)]. See Figure,
and 3 for details-of the U-clip and its application.
2.2.4 Clip Fasteners: Screws used to attach the panels
steel supports are minimum No. 14, self-tapping or selt-ci
ling screws, and must comply with SAE J78, 1979 Standi
Specification for Self-Drilling Tapping Screws. The sere
used with the panels must be sufficiently long to penetrate 1
structural supporting member.
2.2.5 Exp,nsion Fasteners: Fab-lok® expansion anch,
. used to support the panels have three different grip rang,
0 to 1/4 inch (0 to 6.4 mm), % to 1/2 inch (6.4 to 12.7 m,
and 1/2 to 3/4 inch (12.7 to 19 mm).
2.2.6 Sealants: Butyl caulk is used for panel joints, and bt
sealant tape is used for trim.
2.2.7 Flashing: Flashing material is steel having the sa1
finish, color, texture, and gage as the panel fascia skin.
2.3 Installation:
The par.els are placed with the longitudinal joint orientec
the vertical or horizontal position. Individual panels may si::
one, two, three or more spans. The panels are erected frt
left to right or from bottom to top, leading with the male ed!
See Figure 2 for typical panel layout. The panels are faster
to structural girts by means of self-tapping screws and U-c
fasteners placed in the tongue-and-groove joint of the panE
These structural fasteners mechanically fasten both the f,
cia (exterior) and the liner (interior) metallic sheets to 1
structural girts. The side joints of the panels have a 1/4-ir
(6.4 mm) bead of butyl sealant that is either factory-or fie
applied into one or both of the grooves of the panels. Duri
erection, the side joints of adjacent panels are firmly int
locked to make continuous contact with the sealant. Erecti
proceeds along the wall elevation, with the installation
successive panels in accordance with the published M1
Span installation guide. Expansion fasteners are-used to
tach the liner facing to framing supports as required by the 1
proved structural design. See Figure 3 for panel joint det,
and Figure 4 for attachment details.
Flashing must be placed at the building base and at eav,
openings, and horizontal and vertical comers. The flashin~

Dear Pat,
I am writing to you with a request to work with Florexpo and Clarion Construction in the remedy
of a situation that was unavoidable.
Clarion's subcontractor Sub-Zero Refrigeration has mounted approximately $80,000.00 worth of
. piping on the roof of the new Florexpo facility in Carlsbad. The pipes are mounted on racks
approximately 24" -36" above the roof and will be insulated with metal jacketing when
completed.
dur inspector Mr. Phillips, observed the piping a few days ago and rejecte<i their location
:because of a Carlsbad ·city ,ordinance, of which Clarion and Sub-Zeto wen~ unaware. That
ordinance is reported to state that no duct work or piping systems are to be molinted on the roof
of buildings in Carlsbad to maintain the aesthetics of the various Industrial Parks.
If this were a normal situation, I believe we would be out ofluck, but It is not normal and if you
.read on I believe you will agree with my reasoning.
1. · In no way, would I be able to argue aesthetics on any other building· in this park, however,
1960 Kellogg Avenue, is the highest in elevation ofaj.l bttllding in t4at ~ea.,
Consequently, the piping cannot be seen from any arigel or any location'.around the
building, nor any locatioµ, down either of the approaching streets.
2. · Clarion pulled a pirmit for the overall project. The ordinance was neve:t' considere'd,
because a copy ofwltj.cJ:i was not attached to the platt check con:ections,,o\!Ieql,lip:pient
was indicated to b.e-ground mounted. My architect Gary Bosz, simply did not know of the
ordinance, so we,,proceeded with pulling the permit 1li1aware of the· ordfuance as it relates
to piping on the roof. .

3. . Sub-Zero called the City of Carlsbad to submit their refrigeration plans. These plans
clearly depict the piping on the roof. The plan checker, Scott Burns told Sub-Zero, that a
permit was issued for that work. Sub-Zero told Scott that their plans were much more
specific than the architectural drawings. Scott said their was no need to submit the
refrigeration drawings as he was satisfied with the architectural plan. Sub-Zero did not
push the issue and proceeded with the installation. It was upon a request for inspection,
that the ordinance was brought to our attention. By then obviously the work had
completed and now we face a deadline of the 25th of this month for Florexpo to occupy
the Cooler as the exit their existing building which has been sold.
4. Lastly, all of the projects of this size, traditionally run the pipes on the roof or exterior
side walls of the building for safety reasons. This is no exception, as there will be 5,000
pounds of Freon in the system. By locating the pipes and some valves on the roof, we are
minimizing the risk of interior Freon loss. Freon loss can be catastrophic as it displaces
oxygen. All of Clarion's projects are designed with exterior piping runs for this reason.
Pat, I'm asking for some help here as I am certain leaving the pipes as installed will never pose
an aesthetic~ problem to anyone in the park. I believe it is a much safer installation, and because
of the deadline, Florexpo will be forced to lease back their former building at a mind boggling
$100,000.00 per month as stipulated in their escrow agreement.
Can we work this out, I will build a screen wall if necessary but no one can see the pipes from
any angle, please call me as soon as possible. I can meet you on site immediately if need be.

We would like to construct 2 refrigerated floral coolers in this existing
building. .
Cooler #1 is 18,044 sf with an occ:t..Jp~nt load of 36 occupants (1
occupant per 500 sf)
Cooler #2 is 6,421 sf witi-i an occupant load of 13 occupants .( 1
occupant per 500 sf)
UBC 1997 Code Section 1007.7.3.1 requires refrlgerated rooms
grea~er then 1,000 sf to have 2 exits.
USC, 1997 Code Section 1004,2.2, EXL"'eption 4 requires one of the 2
exits egress directly to an exit or dfrect ac-c-ess to .an exit.
?lease note on the attached pfan the problerns we have. Both coolers are
separated from the east exterior wall by a 15 ft, wida loading dock. Coolsr #1 is
adjacent to the south building wail but an exit door in that waH causss a problem
with installing an insulated door in the wail. ConitrucHng corridors across the 15
ft. dock would block the traffic flow within the <lock.
We under$tand the code situation, but do not agree with the intent. The 2 door
cooler requirement appears to be a safety issue s1nc-e it idenUfies the refrigerant_
evaporator as also being a determinant. The o-c-cupant toad within these coolers
would not on its o•.vn require 2 exits if not for the evaporators.

Our request is to align one of the required cooter exit doors with the existing exit
door across -the 15 ft wide dock. The fioot wouid have a 5 ft wide striped aisle
from door to door. This aiste would be further idetrufied with painted ietf.enng /lFire
Als"le -Oo Npt Btock" on each .side of the aisie. We feef this would solve ths
exiting issue without the construction of a corridor.
