Dear Mr. Stork:
After examination of your Application No. 10968 for an Air Pollution Control
District Authority to Construct, and Permit to Operate a gasoline dispensing
facility located at 1~73 la Costa Avenue, Carlsbad, CA, the District has
decided on the following ~ct,on pursuant to Rule 20 of the Air Pollution
Control District Rules and Regulations:
Authority to Construct is granted to install a Phase I vapor control system
at the above specified facility having an estimated maximum monthly throughput
of 800 gallons and consisting of:
One (1) 2,000 gallon storage tank for Regular gasoline with
One (1) dispensing nozzle
The Phase I system shall consist of:
One (1) submerged fill pipe extending to within six (6).
inches of the tank bottom
One (1) three inch dry break vapor valve
One (1) three inch dry break vapor valve cap
One (1) fuel fill adapter fitting
One (1) fuel fill adapter cap
This Authority to Construct is issued subject to the following conditions:
1. The Phase I sys tern sha 11 be constructed in accordance with the "Teed
Vapor Recovery System" drawing and shall use components specified in
ARB Exhibits l and 2 of Executive Orders G-70-9-A and G-70-2-D respectively.
2. This facility is subject to the requirements of District Rule 61.4. You
must meet the increments of progress to Phase II compliance as set forth
in the compliance schedule for this facility as approved by the Air
Pollution Control Hearing Board. You 1·1il1 be advised when the Hearing
Board plans to consider a compliance schedule for your facility.

Upon installation, it is recommended that the vapor control system pass a
pressure decay/leak test in accordance with APCD procedures. For new
construction it is recommended that the pressure test be conducted before
piping, tanks, etc. have been covered. Please contact this office prior to
conducting the pressure decay/leak test so that it may be witnessed by an
APCD representative.
Phase II piping may be installed at the time of construction provided that
vapor control nozzles are not installed and such piping is compatible with
all future Phase II requirements.
This Air Pollution Control District Authority to Construct does not relieve
the holder from obtaining permits or authorizations which may be required by
other governmental agencies. Contact the appropriate building inspection
department {city or county) and fire district prior to installation of the
vapor control equipment for permit and/or inspection requirements.
Within 10 days after receipt of this Authority to Construct, the applicant
may petition the Hearing Board for a hearing on any conditions imposed
herein in accordance with Rule 25.
The Air Pollution Control District shall be notified in writing within ten
working days of the completion of construction. This Authority to Construct
is non-transferrable and will expire one year from date of issuance.
This is not a Permit to Operate.
