Mr. Roston's letter on Friday, copy of which I have sent all

"certified mail" to each Board member, as the matter appears
to have been settled by La Costa itself.

Proposed Change in Drainage System for La Costa Country
Club Hotel Tennis Courts
Gentlemen:
Pursuant to my conversation with Mr. Stork of your office, please be advised that we
are attempting to contact the rest of the board members concerning their thoughts on
your proposal for changing the topography and drainage at the rear of the property be-
longing to the Fourth La Costa Condominium Owners Association.
Due to the fact that your proposal would involve major modification to the existing
topography, as I indicated to you, no single member of the board can give permission
on a matter of this type, and if permission is granted it will have to be done by at least
a majority of the board and/or possibly including all the members of the Association.
As I indicated to Mr. Stork on the telephone, the board is entrusted with the duty of
maintaining the integrity of the property, and while we wish to cooperate and would
entertain any changes for the better, it is the feeling of the board that the matter should
be looked into carefully before giving any permission.
Accordingly, I trust that there will be no encroachment, physical or otherwise, to the
property belonging to the Fourth La Costa Condominium Owners Association.
As soon as the board goes over this matter and has a chance to thoroughly investigate
same,^ve will give you our decision in writing.

Attached hereto is a letter received in to-day's
mail from Mr. Roston of the La Costa Land Company
with reference to their proposed plans concerning
the Association's property and the building of
the new tennis courts.
We are sorry we could not obtain plans or a
written proposal to submit to you for your approval
as we well realize endeavoring to outline a verbal
proposal, at best, is subject to a loss of under-
standing in translation. It is to be hoped if
anything of this nature arises in the future the
Association will be notified ahead of time in
order to give you the opportunity to assess all
phases and give your approval or otherwise.

j that the work we are doing is being done on our own property,
! and we will not be requiring any rights-of-way, slope ease-
' ments, or any other permission, from your Association. We have j
i not accepted direction from any of your Board Members/ and do I
! not intend to do so without written permission. j

I was to see if time would allow us to do what we think might be
i a more pleasing job to all concerned. However, because we are
i pressed for time we are proceeding with our construction with-
i out abusing anybody's rights or priveleges. Rest assured, the
