for a review of the plan check #06-3221, called Fourth La Costa located at 2003 Costa Del Mar Road The project is an exterior restoration of an existing 48 unit condominium The problem in question refers to the building area not conforming with what is allowed for the occupancy (R-1) and construction type (type V-1HR) We calculated the existing building area using actual measurements we took on site and came up with approximately 47,280 sq ft We estimated construction type by what we found through exploratory openings Todays codes allow 42,000 sq ft for R-1 occupancy in a type V- 1HR 3 story building with yards on three sides We were unable to conform the building using today's code or the previous codes that may have been in use at the time of construction (Per 1967 UBC allowable floor area for occupancy type H in a 3 story type V-1HR building with yards on three sides located in fire zone no 3 = 42,133 sq ft) We believe the building was constructed sometime in the mid to late 60's and we do not have any existing drawings that specify the building construction and/or approvals The building gross square footages shown on the cover sheet of the plans are of the building floor area only This area does not include any of the existing 4' overhang of the mansard roof or the entry canopy that is to be removed nor does it include any area of the new architectural features Item #2 of the EsGil plan check states that the building exceeds allowable floor area for the R1 occupancy and to provide a justification for the new entrance area and miscellaneous other extensions of the building In our first response we noted that the areas listed were reflecting the existing building dimensions and the new additions to the building (separation towers and entry tower) were non occupiable architectural elements and they were not added into the building area This item came back stating that the entrance tower must be included into building area and that additional area may not be added to the building that does not comply with the code I confirmed the area requirement with Chuck Mendenhall at EsGil and even though we are removing all of the 4' mansard roof overhang and the existing entry canopy, the new addition cannot then be included into the non-conforming building area He suggested that we contact you for review and approval for replacement of the new entry tower for the existing entry canopy The new entrance tower area, at 204 sq ft , is smaller than the existing canopy, which is estimated at 314 sq ft (including adjacent mansard roofs) If we include the area of all the 4' mansard roof overhangs the total comes to 18,579 sq ft Compared to the new total area calculation of 16,977 sq ft you can tell that we are substantially decreasing the UBC defined floor area by 1 ,602 sq ft The entrance tower is an architectural element that provides building facade relief and modulation that is an essential part of the building design The area of this tower is comparable to the existing entrance canopy and is much less than the total area of the mansard roof overhangs We feel that the addition of this tower does not pose any threat or decrease the fire safety of the building and request that the design be approved as presented I have included some area exhibits and photos of the existing building as well as a copy of the most recent plan check
