I was under the impression that the Code Enforcement issues at 2045 Corte Del
Nogal had been resolved, when in fact they have not As a result the above
referenced building permit was issued in error I will be processing a refund for
the permit fee and will mail it to you

Dear Mr Kelly,
On September 15, 2005 we submitted a permit application for the upgrade to a larger gas
meter at our building located at 2045 Corte Del Nogal A plumbing permit was issued to
us by Mike Peterson (Permit No CB053261) The reason for the request was due to the
recommendation of the manufacturer of our current hot water boiler (Parker Boiler) We
have been experiencing some operational problems with the boiler and we had a
technician from Parker Boiler come out and look at our system He concluded that the
existing natural gas meter needed to be replaced with a meter capable of supplying 5
PSIG This would adequately satisfy the gas requirement for our existing boiler
On the afternoon of September 15, 2005 I called to request an initial inspection so the
Carlsbad Building Department could provide a release to SDGE to proceed with the
meter replacement
On September 16, 2005 Pete Dreibelbis, the senior building inspector, came to our
location and informed me that the City would not give the work order release to SDGE to
replace the meter He stated that he had met with you earlier in the day and at your
direction "no permits would be granted regarding any expansion at this facility until the
issue relating to the small utility building was resolved"
We are fully aware of the issues relating to the utility building As soon as Seasilver has
the financial means to correct your concerns relating to this addition to the existing
building these will be completed
What we are requesting concerning the gas meter does not relate to "expansion" Our
production requirements are 10% of what they were two years ago when the issue related
to the utility building was brought to our attention What we are trying to accomplish is to
prevent any "business interruption" due to having an inadequately sized gas meter for our
existing equipment
Please reconsider the stance you have conveyed to us and let us moved forward with the
replacement of the gas meter
