I am referring to an ordinance that requires home owners undertaking home construction improvements of $20,000 or more to sign a lien on their property to ensure payment for future city- planned improvements such as sidewalks and burying of SDG&E power lines. We plan to undertake a major renovation effort to beautify our home and thus enrich the overall appearance of our neighborhood. We have a fixed budget and plan to proceed just as soon as we finalize our construction plans and receive a permit. You can imagine our dismay upon learning that we must sign a promissory note of approximately $7,000+ to pay "our share" of the burying of SDG&E power lines on Basswood Ave. We have learned from the city engineering department that such a project is currently not planned for at least the next 10 years! That means that we will have to carry the lien against our property during that time and, should we decide to sell our home, most assuredly will be penalized due to the often pejorative connotation inferred by property liens. Additionally, we're informed that, should said burying of SDG&E power lines occur on Basswood Avenue at some distant point in the future, we will be billed for "our share" based on the linear footage across our property, and our neighbors who do not undertake major home improvement projects will not be required to pay. Rather, we're told, the city (i.e the taxpayer) ultimately will pay for those individuals. That appears to be double taxation to me: 1) a direct taxation in the form of a lien placed on my property, and 2) taxes collected from me and all citizens to pay for those neighbors who have not undertaken $20,000 or more in home improvements. If I am correct in this assessment, I must strongly disagree with the City of Carlsbad policy. It would appear to be more equitable for all citizens in a given area, slated to receive the benefits of underground utilities or other city planned improvements, to finance the project rather than to heap it upon the backs of a relative few homeowners whose only crime was to renovate, update, improve and beautify their property. I understand that this policy is currently being reviewed by the City of Carlsbad. I would ask that, by whatever means possible, my misgivings and the feelings of other area homeowners be duly considered in recasting the policy. We are anxious to begin our home renovation project and hope that some accommodation for homeowners who beautiful their property can be agreed upon.
