After examination of your Application No 14365 for an Air Pollution Control
District Authority to Construct and Permit to Operate a gasoline dispensing
facility located at the Motor Pool Area, La Costa Hotel, Costa del Mar Road
Carlsbad, CA , the District has decided on the following action pursuant to
California Health and Safety Code Section 41960, and Rule 20 of the Air Pollution
Control District Rules and Regulations
Authority to Construct is granted to install a Phase II vapor control system
at the above specified facility having an estimated maximum monthly throughput
of 9,900 gallons and consisting of
Two (2) 4,000 gallon manifolded storage tanks for Regular gasoline with
One (1) dispensing nozzle.
One (1) 2,000 gallon storage tank manifolded to One (1) 1,000 gallon
storage tank for Unleaded gasoline with One (1) dispensing nozzle.
The existing Phase I system should consist of:
Four (4) submerged fill pipes with discharge openings within
six (6) inches of the tank bottoms,
Four (4) three-inch dry break vapor valves with pressure-tight caps,
and
Four (4) fuel fill adapter fittings with pressure-tight caps.
The Phase II system shall consist of
One (1) Emco Wheaton Balance Phase II Vapor Recovery System as
described in ARB Executive Order G-70-17-E, including all specified
components as required for each dispensing nozzle

This Authority to Construct is issued subject to the following conditions
1. A copy of this Authority to Construct letter shall be posted or kept readily
available at the above specified facility until the District issues the
Permit to Operate.
2. The existing Phase I system shall be operated in accordance with the require-
ments of District Rule 61 3.
3 The Phase II vapor control system shall be constructed and installed in
accordance with ARB Executive Order G-70-17-E, and G-70-52-E if appropriate,
and notes accompanying them
4. The vapor plumbing and tank location drawing received June 5, 1981 represents
and describes the vapor recovery system at the above specified facility, except
as modified by conditions herein
5. The vapor spaces of each pair of tanks connected with a liquid syphon shall
be manifolded with minimum 2-inch nominal diameter piping at the tanks
6. Upon request of the Air Pollution Control District (APCD) the permittee shall
provide access, facilities, utilities, and any necessary safety equipment, for
vapor control system testing and inspection
7. Upon system installation, the permittee shall have the following tests performed
in accordance with recommended APCD procedures and provide this office with the
results
a. a pressure decay/leak test of the entire vapor control system including
nozzles and underground tanks
b a liquid blockage test conducted on all vapor return piping between the
vapor return hose/vapor piping connection point (outside the dispenser)
and the tank 'entry point" to ensure adequate line slope and liquid drain-
age (per APCD Test Procedure TP-79-2).
c. a pressure drop vs flow test of the farthest dispenser from the under-
ground tank for each product grade This test is to include nozzle, hose,
trap, associated fittings, piping and storage tanks
Contact this office by telephone (Joe Yager, 565-3923), prior to conducting these
tests so that they may be witnessed by an APCD representative Documentation of
prior tests of this type may be submitted for APCD review and approval to satisfy
these test requirements For new construction it is recommended that these tests
be conducted before piping, tanks, etc , have been covered.
8. Self-propelled motor vehicles with gasoline tanks larger than five gallons shall
have fuel tank fill openings that allow sealing with the Phase II balance system
nozzle faceplate Fill openings shall be modified and cap chains relocated if
necessary to accomplish a seal A tab or cleat shall be installed just inside
the lower edge of such tank fill neck openings, if necessary, to allow engaging
the nozzle into the compressed bellows position.

The District has been advised by the Division of Measurement Standards (Weights &
Measures) that the Emco Wheaton Balance Phase II system may be installed without
the recirculation traps provided the applicant does not engage in the sale of
gasoline from a dispenser so equipped to the public, employees, or any other agencies
or firms. We would caution, however, that use of the system without the recirculation
traps has the potential for recirculating gasoline from the vehicle tank back to the
storage tank. This can lead to possible discrepancies between dispenser meter
readings and tank inventory readings.
This Air Pollution Control District Authority to Construct does not relieve the
holder from obtaining permits or authorizations which may be required by other

Within ten days after receipt of this Authority to Construct, the applicant r\ay ^
petition the Hearing Board, in accordance with Rule 25, for a hearing on any
conditions imposed herein.
The Air Pollution Control District shall be notified by telephone (J Yager,
565-3923) at the time of completion of construction and in writing within ten
working days of the completion of construction. This Authority to Construct
is non-transferable and will expire one year from date of issuance.
This is not a Permit to Operate Operation of this equipment without written
authority (District Permit to Operate, Startup Authorization, or Hearing Board
variance) will be in violation of Rule 10(b) and will be subject to civil and
criminal penalties
