Thank you for your quick ~nse to my lcuer of. August 3 l. l understand your point of view and that Mr.
Orenyak bas wncurred with you and the Fire Marshal on our proposed approach. .I have discussed your letter and
our conversations with Able Engineering and they would like to explore accept.ability of the following avproach to
complying with Section 1003.3.LlO:
'l'he offices are occupied by ·1css than ten people. Each dQOr is t;ypie$.ly kept open while the room is occupied. lf
vacated, the door is closed and Jocked. A pto).imity sensor is used to unlock the door. :Note: We are proposing to
meet the reqoirements of Section 1003.3.1.10 but there will be 110 time delay. Note that time delay is not
required by code, and is in fact limited to JJO more than 15 seconds. All features which ar.e used allow the

include compUance with tbe requitements of settiOn 1003.3..l.1@ Therd"ore, safeguards wjll incorpomto the

.l. lf the d«u: js c::Iosoo while sornoone is in th~ room, a 1notion seoror will unlook the door as it is
approached from lhe inside, or upon loss of power to the sensor, with no time delay. lt is intended that

The egress control devices shall be c.lpal)Ie ofbcing dC3Ctivated by a signal from a switch located in a
position approved by you. We suggest tliat the switch be located in the building fire control room.
Eacb doot shall be arranged to unlock using a door handle cmts111lcted to include a touch $Ct1Sing
component within the handle, wbjch js Usted by the CSFM for e~it door m.e. Sioce only touch is required,
this complies with the requirement that a manual force of less than 15 pounds be :required to deactivate
the egress control. The door may only be reset by using the card access system when the handle is used to
deactivate th¢ magnetic lock. Deactivation will occur instantly upon touching the door handle. This
complies with the requirement to deactivate within 15 seconds.
Activation of the door handle (<:auSing deactivation of the egress control del-i(:e) will cause an audiole
sound at the door. If tbe motion detector unlocks the door, die alann will not SQ~nd.,
, ,
Unlatching will not required more than touching the handtc.
A sign will be provided on the door above, and within 12 inches, of tlie door handle which will say: ''Pull
handle to open door. This door will opett with tlQ delay. Alarm will sound." The sign will have letters at
lease 1 inch in height with a suoke of at least 1/8 inch. We are asking for approval of this slightly
modified wordir.ig, since these doors all open into the office, and no puslriog action is appropriate or
req_uired for tlte doors. Please coocur wltb tbis requ~ Note, siPte tbe oc~upaocy of the rooms is
less tbat 10~ (genendly two), M inward swing is allowabJe. Sj»u it is allowed to swmg in, the
mandatory wording should not apply.
Regardless of the means of deactivation (with the exception of deactivation of the lock by the ·motion
detector) the doors will only be re-locked using the proximity sensor at the door. They will not reJoclc
automatically.
If you concur with the above, please advise as soon as possible. A submittal of the plan and components ·will be
made promptly for review and acceptance. In addition, please advise if tllere are any other ou!Slanding Nuilding
Department or Fire Department jssues to resolve which would preclude the planned grand opening of the building
scheduled for September 17. Note that 1he egress control modifications outlined above will require custom design
and installation which will .not be complete for 4 to 6 weeks. In. the meanwhile, our understanding is that the d()Or
egress control devices nmst remain out of semce.
Due to tlle urgency in obtaining a permit. to occupy we would very mucb appteciate a !Mt tra~k approacb to
resolving this i~e. Please call me if you have any questions in the meantime.

Re: Special Egress Control Devices for CB 99-2645
D Urgent x For Review D Please Comment D Please Reply D Please Recycle
• Comments: I received your FAX this morning. As I indicated in our conversation of 8-31-
99, I am not inclined to approve egress control systems that do not explicitly comply with all
the provisions of the 1997 UBC Section 1003.3.1.10. This is the current California Building
Code; the Code applicable to projects constructed at this time in California. The doors in the
rooms mentioned in the FAX from yesterday are exit doors by definition. These doors may
be fitted with egress control of the time delay type as long as all the Code criteria are met.
The time delay allows room occupant to egress the room in a fail safe mode using the door
hardware itself with up to 15 seconds of time delay. No special knowledge or effort is
required in systems of this type as the UBC Section 1003.3.1.8 requires of locks and latches.
There are many other prescriptive requirements for the egress control devices, and the
building must be equipped with a smoke detection system. At this time the City is not
approving egress control systems that do not explicitly comply with this Uniform Building
Code Section. The IBC may eventually be adopted by California as allowing systems such
as is proposed. But there are many hurdles to clear before that happens. The challenges to
the Final Draft language (please see page E-20 of the ICC Final Action Agenda) will be
heard in St. Louis later this month. Then the State of California will have to adopt this same
language when and if the 2000 IBC becomes the California Building Code. Allowing such
systems at this point would be presumptive.
In general, the City Fire Marshal and Building Official agree that egress control should follow
the explicit language contained in the California Building Code. I have no need to meet
further in person with respect to this issue unless you feel compelled to do so.

Comments; Mr. Kelley, please review the attached Jetter and support documents. Lucent
Technologies is at a critical point in. this project. Resolution of the access co.ntro1led door issue is
the key element blocking completion of the project. It would be appreciated if this reivew and
meeting could be given a fast track approach to resolution. All interested parties are prepared to
travel to Carlsbad for a meeting on Thursday afternoon to discuss any technical issues or explain
the design basis. Please call to confinn a time so that we can meet your scheduling needs.

Thank you for returning my call today to discuss the design criteria for the doors used in Rooms
208? 209, 210,211,212, 213, 215~ 216, 217, and 223 of this property. As we discussed, we
would like to hold a meeting with you to discuss the ~it door arrangements for these rooms to
explain the design basis, and obtain your acceptance of the approach proposed.
You indicated that one or more installations of magnetically held doors have occurred in
Carlsbad, without permit or approval. In at least one of these installations~ the arrangement was
unsatisfactory, and caused an individual who had used a Knox box key to obtain entry to become
Jocked inside a room by a magnetically held door. This is unfortunate, but there are,
unfortunately. many examples of projects which have been done by individuals and companies
which require permitting and a,pproval, and which have not been installed _per codes and
regulations.
Our client, Able Engineering, acting on behalf of the tenant~ Lucent Technologies, is following
protocol, and wants to obtain a proper permit to occupy the facility. The building is fully
sprinklered and is provided with an automatic fire alarm· system.
The issue concerns the proposed installation of magnetic door locks on the offices identified
above and on the attached second floor plan. The offices are occupied by two people or less.
Each door is kept open while the room is occupied. If vacated, the door is closed and locked

using a keypad. The keypad is used to open the door. Safeguards also include the following
design features;
I. If the door is closed while somoone is in the room. a motion sensor will unlock the door as
it is approa(;hed from the insid~, or upon loss of power to the sensor. with no time delay.
2. Loss of power to that part of the access control which locks the doors shall automatically
unlock the door with no time delay.
3. Each door shall be arranged to unlock from a manual unlocking device, a touch sensing
pad, located 40 to 48 inches vertically above the floor and within 5 feet of the secured
door. Ready access is provided to the manual unlocking device and the devices are clearly
identified by a sign. When operated, the manual unlocking device causes direct
interruption of power to the lock -independent of the access control system electronics -
and the door will remain unlocked for at least thirty seconds.
4. Activation of the building fire alarm system will automatically unlock the doors, and the
doors will remain unlocked until the fire alarm system has been reset.
5. Activation of the building automatic s_prinkler or fire detection system will automatically
unlock the doors. and the doors will remain unlocked until the fire protective signaling
system has been reset.
6. The entrance door will. not be secured from the egress side during periods. that the building
is open to the general public.
During our discussion, you indicated concern that this arrangement may be considered to be a
timed-delay egress, subject to the requirements of the California State Building Code (CBC)
paragraph 1003.3.1.10. In particular, this set of provisions requires that one condition be
operation of the door using the door release mechanism or push bal'. We suggest that since this is
not a timed delay arrangement. that a more applicable set of requirements under the heading
"Access-Controlled 'Egress Doors'' is found in the BOCA Code., section l 0 17.4. 5 { attached),
These requirements are also found in the Final Draft of the International Building Code, section
1003.3.1 .3.4 (attached). which will replace the UBC in the year 2000. No objections or
comments were made concerning these provisions so it is expected that they will appear as shown
in the IBC final draft. A similar set of requirements is found in the NFPA Life Safety Code,
NFPA 101, Section 5-2.l.6.2 (attach.ed).
The point of including the BOCA, IBC and NFPA 101 requirements for Access-Controlled
Egres$ Doors is to demonstrate that codification of the use of magnetic door locks as proposed
for this .facility has and is occurring, even while not specifically addressed by the UBC. While we

appreciate the desire to not set a precedent for the ·unrestricted use of access controlled egress
doors, clearly if this installation meets the requirements as adopted by BOCA and NFPA IO 1, and
as proposed fof adoption in the me, there is strong support for acceptance a.'> an installation in
. Carlsbad. In addition, ICBO was a major participant in the development of the final draft of the
IBC. Since they did not offer any comments or objections to the proposed IBC provisions for
''Access-Controlled Egress Doors" we can assume that the released code will include thls
wording.
GBA was the sponsor for the wording included in all three codes, and was intimately involved in
the code revision process that introduced and adopted the wording into the BOCA. IBC and
NFP A l O l Codes. This facility is exactly the type of installation which was intended to be
covered by the wording adopted.
We would appreciate your concurrence. and would be willing to travel to Carlsbad on Thursday
for an afternoon meeting _to discuss the technical aspects of the design, and to answer any of your
concerns. All components for example are CSFM listed and UL approved. I will call you after
lunch tomorrow (Wednesday) to set a meeting time if you feel it is needed. Due to the urgency in
obtaining a permit to occupy we would vecy much appreciate a fast track approach to resolving
this issue. Please call me if you have any qm~stio~s in the meantime.
