R40DELS LESS THAN s 09,291 When remodels are valued at less than $69 9 291 access compliance may be limited to the specific area being remodeled when an un- reasonable hardship is determined by the enforcing agency. Staff determination of unreasonable hardship shall be made on Form JICA-1, which ehall be filed in the project file. When the required work outside of the remodeled area (l.a through l.f above) exceeds 10% of the cost of the work to be done in the remodeled area, an unreasonable hardship shall be found to exist (criteria is staff guideline). The unreasonable hardship finding may be by observation when obvious. Form HCA-1 should describe the obvious. C. REMODELS $69291 and HIGHER When remodels are valued over69'29.1 and specific access rcquirements cannot be met: The law allows equivalent facilities to be accepted if strict compliance with the regulations would create an unreasonable hardship. Access cannot be waived unless there are physical or legal barriers that prevent providing either full access compliance or equivalent facilitation compliance. When both access and equivalent facilitation are waived, by the enforcement official, ratification is required by an Appeals Doard. D. MULTI-FLOOR REMODELS: Exceptions and exemptions 1 Provisions for Upper and Lower floors: The Health and Safety Code Section 19955.5 says that.In privately- funded multi-storied passenger vechicle service station,, shopping centers, offices of physicians and surgeons, and office buildings, subject to this code, floors or levels above and below the first floor or ground level are exempt from these requirements if a ramp or elevator is not available to provide public access. to such floors or levels.' 2. health and Safety Code Section 19956 says thàt.1n privately-funded multi-storied buildings, floors or level, above the first floor or ground level are exempt from these requirements it a reasonable portion of all facilities and accommodations normally sought and used by the public in such a building are accessible to and usable by physically handicapped persons. 0. BATHING FACILITIES One such facility shall comply when provided for the public, clients or employees. 2-511.1(a) Shower compartment shall be 42" wide, 48" deep, with a 36 wide entrance. 2-511.1(a) Show on the plans that the'handicapped bathing facilities shall conform to requirements of Sec. 2-'511a-9, 5-1505 and 5-1506, i.e., folding seat, flexible shower hose, etc. / G.AL RflRIS - /1. DRINKING FOUNTAIN / a. Drinking fountains shall be within alcoves. The alcove shall be not less than 32" wide by'18" deep. 2-511.1(c) b. When the enforcing agency determines that it would create an unreasonable hardship to locate the water fountain in an alcove, the water fountain may project into the path of travel, and the path of travel shall be identifiable to the blind as follows: The surface of the path of travel. at the water fountain shall be textured so that it is clearly identifiable by a blind person using a cane. The minimum textured area shall extend from the wall supporting the water fountain to 1 foot beyond the front edge of the water fountain and shall, extend 1 foot beyond each side of the water fountain, or Wing walls shall be provided on each side of the water fountain. The wing walls shall project out from the supporting wall at least as far as the water fountain to within 6 inches of the surface of the path of travel. Also, there shall be a minimum of 32 inches clear between the wing walls. c. Note on the, plans that' drinking fountain shall conform to requirements of Sec. 2-511c and 5-1507. PUBLIC TELEPHONE a. Provide space 30" x 48" for forward or parallel approach to' telephone. 2-511.1(d) b. Note on the plans that public telephone shall conform to requirements of Sec. 2-511.1(d). G ELECTRICAL REQUIREMENTS 15, 20 and 30 amp receptacle outlets shall be installed not less than 12" above floor. .3-210-50(e) b. Center of switches. shall be located not less than 36" nor more , than 48"-above the floor. 3-380-8(c) 24. PLUMBING REQUIREMENTS a. Where kitchenettes' are provided at employee break rooms, conference areas, customer lounges, etc., the faucet controls at kitchen sinks ' shall be operable with one - hand and shall not require tight grasping, pinching or twisting of the-wrist (i.e., use lever- operated, push-type, etc.).
