within 5 days of the approval date.
Burrows shall provide proof of approval from the County Health Department within 5 days of the

contradicting very clear requirements of the Building Code. The life safety issues
can be solved through expansion of the seating area, but other building code issues
arise when the applicant attempts to increase the number of occupants beyond the
current code limit of 49 Since the building was not constructed for the more
intense use Mr. Borelli desires, significant upgrading would be necessary to achieve
even substantial conformance with the codes.
BACKGROUND:
Over a period of several years, the former restaurant tenant installed deck and
balcony improvements without permits. The most serious life safety violation,
inadequate exiting, was corrected recently, when the tenant complied with a Fire
Department requirement to install an additional stair to serve the second floor.'
Table and chair seating was occurring on the balcony at that time, and was allowed
to continue based on statements by the tenant that he also wanted to enlarge the
balcony. He indicated that a plan submittal for the change was imminent.
Within 2-3 months the tenant learned that his lease would not 'be renewed by
Burrows Southcoast Inc., the leaseholder. He stated that he would be making no
more improvements to the property because he was being evicted. During an
ensuing legal struggle between Burrows and the tenant, Mr. Joe Pate, a principal of
Burrows, indicated to staff that they had other plans for the restaurant once the
existing tenant was out. He indicated that the plans ranged from replacing the
restaurant with a new structure, to simply bringing it into compliance with the
codes. Anticipating the change, this office did not force the compliance issues
related to seating on the balcony. '
Prior to eviction of the restaurant tenant, Mr. Pate asked for and was given
information regarding the outstanding Building and Fire Code corrections in the
restaurant. He indicated an interest in correcting them prior to installing a new
'tenant. August 1, 1995, Principal Building Inspector, Pat Kelley sent a 'letter to Mr.
Pate, confirming the necessary corrections. They included relocation of the recently
installed exit from the South to the North side of the restaurant, and removal of
table and chair seating on the balcony. This would allow the restaurant to serve 49
occupants and achieve substantial conformance with the codes. Mr. Pate and his
new tenant, Mr. Borelli, seemed to be in agreement, as the corrections were clearly
represented on the restaurant improvement plans.
On March 29, 1996 it was discovered that the tenant had violated the conditions
agreed upon by placing tables and chairs on the exterior balcony. He complied when
ordered by the Fire Prevention Office to remove the tables.
ISSUES:
Seating capacity reduction
The seating capacity of the restaurant was significantly reduced when the owner and
tenant agreed to eliminate seating on the balcony. During the building
improvement process it was explained to the applicants that, at a width of 42 inches,
the restaurant observation deck is not large enough to accommodate tables and
chairs, and at the same time, provide the minimum 36 inch exit width required by
code for its occupants. As stated earlier, the applicants agreed to eliminate the
balcony seating and indicated so on their approved plans.
It is the recommendation of the Fire Marshal that the restriction on balcony seating
remain until improvements can be made which can accommodate seating without
compromising the exit requirements of the Building and Fire Codes.
Other occupancy limitations
The number of patrons permitted in a restaurant is limited ordinarily by the size of
the seating area. Although the restaurant seating plan submitted by applicant
indicates only 46 seats, Fire has determned that their is space for 49 patrons,
eighteen on the outside deck and thirty-one inside in fixed seats. Forty-nine
happens also to be the maximum occupant load for a restaurant classified as a B-2
occupancy.
The only means of increasing the occupancy is to enlarge the approved' seating area.
This could be accomplished by expanding the balcony. However, when the
occupancy exceeds 49 the' Building Code classification changes to A-3. In order to
accomplish the change in occupancy, the applicant would have to demonstrate,that
the second floor restaurant conforms to one-hour construction standards, and that a
one-hour rated fire resistive assembly separates it from the floor below..
EDU concerns
The issues related to the payment for and transfer of Equivalent Dwelling Unit
(EDU) fees will be addressed by the Building Department in a companion.

Burrows shall provide to the Airport Director a copy of the final "as-built" drawings
within 30 days after construction is complete.
County's approval for subject improvements is solely for the deck expansion, and
does not constitute approval for any similar or future irnproveimnts.
