1. Please submit three sets of revised/ signed plans to the Jurisdiction Building
Department.
2. Please verify with the city that sprinklers are not required for this project.
3. Please note the name & information of the Special Inspection team on plans, per
response list. Section 106.3.5.
4. Note on the plans: "When serving more than 100 sprinkler heads, automatic
sprinkler systems shall be supervised by an approved central, proprietary or
remote, station service, or shall be provided with a local alarm which will give an
audible signal at a constantly attended location." Section 904.3.
5. Please change note # 15 to 27 on A2.2 for stairs.
6. Please revise note # 27 on A2.1 to state 1-hour rated existing stairs & vestibule
with 1-hour doors (instead of 3/4hr.) subject to field verification. Section 1004.2.2.
7. Provide a letter from the soils engineer confirming that the foundation plans have
been reviewed and that it has been determined that his recommendations have
been incorporated into the plans. Also submit a copy of the soils report to EsGil.
8. The extent of detail 11/S3.2, as shown on S2.1, near grid point 24-F is incorrect.
9. Please indicate the extent of wall footings beyond grid points 24-F & 22-K.
10. Please provide cold joint details and references between the masonry walls and
concrete columns, orshearwalls. I.e., details 14/S3.1, etc. Sec. 1633.2.4.1.
11. If concrete walls are used to provide lateral resistance, then please clarify details
4 or 9/S3.1, in which masonry walls by default will become lateral force resisting
elements..
12. If concrete walls are providing lateral resistance, please show how Section
1633.2.4 is satisfied for the CMU walls.
13. Provide a schematic on plans showing the chord bar size, number & extent for
each level. [Details 3, 4, 5, 8, or 9/S3.2, are not sufficient for this purpose].

This plan review is limited to the technical requirements contained in the Uniform Building Code,
Uniform Plumbing Code, Uniform Mechanical Code, National Electrical Code and state laws
regulating energy conservation, noise attenuation and access for the disabled. This plan review
is based on regulations enforced by the Building Department. You may have other corrections
based on laws and ordinances enforced by the Planning Department, Engineering Department,
Fire Department or other departments. Clearance from those departments may be required
prior to the issuance of a building permit.
Code sections cited are based on the 1997 UBC.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1997 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.
To speed up the recheck process, please note on this list (or a copy) where each
correction item has been addressed, i.e.. plan sheet number, specification section, etc.
Be sure to enclose the marked up list when you submit the revised plans.

2. Please revise the allowable area calculations on cover sheet of plans according
to the next item.
3. Please include the following code information on the Title Sheet for the proposed
building addition/ remodel:*

4. Provide a statement on the Title Sheet of the plans that this project shall comply
with the 1998 edition of the California Building Code (Title 24), which adopts the
1997 UBC, UMC and UPC and the 1996 NEC.
5. Provide a note on the plans indicating no hazardous materials will be stored
and/or used within the building which exceed the quantities listed in UBC Tables
3-D and 3-E.
6. When special inspection is required, the architect or engineer of record shall
submit the name & information of the Special Inspection team to the building
official for approval prior to issuance of the building permit. Section 106.3.5.
7. Provide a statement on the site plan stating: "All property lines, easements and
buildings, both existing and proposed, are shown on this site plan."
8. Clearly dimension building setbacks from property lines, street centerlines, and
from all adjacent buildings and structures on the site plan.
9. Clearly show the yards that are being used for allowable area increases, as
necessary.
10. Provide a note on the plans or on the finish schedule, stating, "Wall and ceiling
materials shall not exceed the flame spread classifications in UBC Table 8-B."
11. Note on plans that suspended ceilings shall comply with UBC Tables 25-A & 16-O.

12. On the cover sheet of plans, specify any items that will have a deferred submittal
(stairs, sprinklers, etc. Also note the following on plans, per Sec. 106.3.4.2:
"Submittal documents for deferred items shall be submitted to the architect or
engineer of record, who shall review them and forward them to the building
official with a notation indicating that the deferred documents have been
reviewed and that they have been found to be in general conformance with the
design of the building. The deferred items shall NOT be installed until their
design and submittal documents have been approved by the building official." .

Ensure that the meter proposed by the owner/developer is not oversized.
Oversized meters are inaccurate during low-flow conditions. If it is oversized, for
the life of the meter, the City will not accurately bill the owner for the water used.

• If owner/developer proposes a size other than the "standard", then
owner/developer must provide potable water demand calculations,
which include total fixture counts and maximum water demand in gallons
per minute (gpm). A typical fixture count and water demand worksheet is
attached. Once the gpm is provided, check against the "meter sizing
schedule" to verify the anticipated meter size for the unit.
• Maximum service and meter size is a 2" service with a 2" meter.
• If a developer is proposing a meter greater than 2", suggest the
installation of multiple 2" services as needed to provide the anticipated
demand, (manifolds are considered on case by case basis to limit
multiple trenching into the street).
12b. Irrigation Use (where recycled water is not available)
All irrigation meters must be sized via irrigation calculations (in gpm) prior
to approval. The developer must provide these calculations. Please follow
these guidelines:
1. If the project is a newer development (newer than 1998), check the recent
improvement plans and observe if the new irrigation service is reflected on
the improvement sheets. If so, at the water meter station, the demand in
gpm may be listed there. Irrigation services are listed with a circled "I",
and potable water is typically a circled "W". The irrigation service should
look like:

If the improvement plans do not list the irrigation meter and the
service/meter will be installed via another instrument such as the building
plans or grading plans (w/ a right of way permit of course), then the
applicant must provide irrigation calculations for estimated worst-case
irrigation demand (largest zone with the farthest reach). Typically, Larry
Black has already reviewed this if landscape plans have been prepared,
but the applicant must provide the calculations to you for your use. Once
you have received a good example of irrigation calculations, keep a set for
your reference. In general the calculations will include:
• Hydraulic grade line
• Elevation at point of connection (POC)
• Pressure at POC in pounds per square inch (PSI)
• Worse case zone (largest, farthest away from valve
• Total Sprinkler heads listed (with gpm use per head)
• Include a 10% residual pressure at point of connection
In general, all major sloped areas of a subdivision/project are to be
irrigated via separate irrigation meters (unless the project is only SFD with
no HOA). As long as the project is located within the City recycled water

service boundary, the City intends on switching these irrigation
services/meters to a new recycled water line in the future.

1. Recycled water meters are sized the same as the irrigation meter above.
2. If a project fronts a street with recycled water, then they should be
connecting to this line to irrigate slopes within the development. For
subdivisions, this should have been identified, and implemented on the
improvement plans. Installing recycled water meters is a benefit for the
applicant since they are exempt from paying the San Diego County Water
Capacity fees. However, if they front a street which the recycled water is
there, but is not live (sometimes they are charged with potable water until
recycled water is available), then the applicant must pay the San Diego
Water Capacity Charge. If within three years, the recycled water line is
charged with recycled water by CMWD, then the applicant can apply for a
refund to the San Diego County Water Authority (SDCWA) for a refund.
However, let the applicant know that we cannot guarantee the refund, and
they must deal with the SDCWA for this.

WHEREAS, said verified application constitutes a request for a Conditional Use

Permit Amendment as shown on Exhibits "A" - "L" dated February 21, 2001, on file in the

Carlsbad Planning Department PACIFIC BELL - CUP 154(D), as provided by the conditions
19
20 of approval of CUP 154(C) and Chapter 21.42 and/or 21.50 of the Carlsbad Municipal Code; and
21 WHEREAS, the Planning Commission did, on the 21st day of February 2001,
22 hold a duly noticed public hearing as prescribed by law to consider said request; and
^•3•" WHEREAS, at said public hearing, upon hearing and considering all testimony
24 and arguments, if any, of all persons desiring to be heard, said Commission considered all factors

relating to the CUP amendment.

WHEREAS, on August 7, 1996, the Planning Commission approved CUP
28 154(C), as described and conditioned in Planning Commission Resolution No. 3960.
1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
2 Commission of the City of Carlsbad as follows:

A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commission
APPROVES PACIFIC BELL - CUP 154(D) based on the following findings
5 and subject to the following conditions:
7 Findings:
That the requested use is necessary or desirable for the development of the community, is
essentially in harmony with the various elements and objectives of the General Plan, and
is not detrimental to existing uses specifically permitted in the zone in which the
10 proposed use is located, in that: (1) the proposed expansion to the telephone electronic
switching facility will ensure that telephone service is available for new growth in
11 the City; (2) the proposed telephone electronic switching facility is consistent with
General Plan policies related to industrial uses; and, (3) the proposed project has
been designed with comparable architecture and enhanced landscaping.
13 2. That the site for the intended use is adequate in size and shape to accommodate the use, in
14 that only 26% of the site will be covered with a structure and the site has been
designed with adequate setbacks, parking and enhanced landscaping.

. That all the yards, setbacks, walls, fences, landscaping, and other features necessary to
adjust the requested use to existing or permitted future uses in the neighborhood will be
provided and maintained, in that the proposed project meets all development
standards of the PM zone and the site has been conditioned to provide and maintain
18 adequate landscaping on the site.
4. That the street system serving the proposed use is adequate to properly handle all traffic
generated by the proposed use, in that the traffic impacts of the telephone electronic
switching facility amount to approximately 32 trips per day and Camino Vida
21 Roble, a secondary arterial, is adequate in size to accommodate the vehicle trips
generated by the project.

The project is consistent with the City-Wide Facilities and Improvements Plan, the Local
23 Facilities Management Plan for Zone 5 and all City public facility policies and
24 ordinances. The project includes elements or has been conditioned to construct or
provide funding to ensure that all facilities and improvements regarding: sewer collection
25 and treatment; water; drainage; circulation; fire; schools; parks and other recreational
facilities; libraries; government administrative facilities; and open space, related to the
26 project will be installed to serve new development prior to or concurrent with need.
Specifically,
2g A. The project has been conditioned to provide proof from the Carlsbad Unified
School District that the project has satisfied its obligation for school facilities.

B. The Public Facility fee is required to be paid by Council Policy No. 17 and will be
2 collected prior to the issuance of building permit.
3 C. The Park Facilities impact fee for Zone 5 is required by Carlsbad Municipal Code
21.90.050 and will be collected prior to the issuance of building permits.

D. The Local Facilities Management fee for Zone 5 is required by Carlsbad
Municipal Code Section 21.90.050 and will be collected prior to issuance of
building permit.
6. The project is consistent with the Comprehensive Land Use Plan (CLUP) for the
McClellan-Palomar Airport, dated April 1994, in that the project has recorded a notice
concerning aircraft noise. The project is compatible with the projected noise levels of
the CLUP; and, based on the noise/land use compatibility matrix of the CLUP, the
proposed land use is compatible with the airport, in that the telephone electronic
10 switching facility is identified as a compatible use in the CLUP.
11 7. That the project is consistent with the City's Landscape Manual (Carlsbad Municipal
Code Section 14.28.020 and Landscape Manual Section I B).

154(A) and CUP 154(C) apply to this conditional use permit and are incorporated
14 herein by reference.
15 9. The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
to mitigate impacts caused by or reasonably related to the project, and the extent and the
17 degree of the exaction is in rough proportionality to the impact caused by the project.

Note: Unless otherwise specified herein, all conditions shall be satisfied prior to Grading
Permit Issuance.
21 1. If any of the following conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
22 implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
" future building permits; deny, revoke or further condition all certificates of occupancy
24 issued under the authority of approvals herein granted; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No
25 vested rights are gained by Developer or a successor in interest by the City's approval of
this Conditional Use Permit

. Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the Conditional Use Permit documents, as necessary to make them
internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
different from this approval, shall require an amendment to this approval.

2 3. The Developer shall comply with all applicable provisions of federal, state, and local
laws and regulations in effect at the time of building permit issuance.

4. If any condition for construction of any public improvements or facilities, or the payment
of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project
are challenged, this approval shall be suspended as provided in Government Code Section
66020. If any such condition is determined to be invalid this approval shall be invalid
unless the City Council determines that the project without the condition complies with
all requirements of law.
5. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and
hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
and costs, including court costs and attorney's fees incurred by the City arising, directly
10 or indirectly, from (a) City's approval and issuance of this Conditional Use Permit, (b)
City's approval or issuance of any permit or action, whether discretionary or non-
11 discretionary, in connection with the use contemplated herein, and (c)
Developer/Operator's installation and operation of the facility permitted hereby,
including without limitation, any and all liabilities arising from the emission by the
facility of electromagnetic fields or other energy waves or emissions.
14 6. The Developer shall submit to the Planning Department a reproducible 24" x 36",
mylar copy of the Site Plan reflecting the conditions approved by the final decision
15 making body.
7. The Developer shall include, as part of the plans submitted for any permit plan check, a
17 reduced legible version of all approving resolution(s) in a 24" x 36" blueline drawing
format.

8. Prior to the issuance of a building permit, the Developer shall provide proof to the
Director from the School District that this project has satisfied its obligation to provide
school facilities.
21 9. This project shall comply with all conditions and mitigation measures which are required
as part of the Zone 5 Local Facilities Management Plan and any amendments made to
22 that Plan prior to the issuance of building permits, including but not limited to the
following:23 &
24 10. The developer shall pay a Local Facilities Management Plan park Fee of $.40 per square
foot of non-residential development to be collected at the time of building permit
25 issuance.
26 11, This approval is granted subject to the approval of the Negative Declaration and
Hillside Development Permit and is subject to all conditions contained in Planning
Commission Resolution No. 4924 for those other approvals.
28 12. The existing use on site (telephone electronic switching facility) was approved under
Conditional Use Permits CUP 154(A) and CUP 154(C), Planning Commission

Resolutions No. 3666 and 3960. All conditions of the previously approved project
2 (CUP 154(C), Resolution No. 3960) are superseded by Planning Commission
Resolution No. 4923. All conditions of approval for CUP 154(A), Planning
3 Commission Resolution No. 3666 were superseded by CUP 154(C), Planning
Commission Resolution No. 3960, when CUP 154(C) was approved.

13. This Conditional Use Permit shall be reviewed by the Planning Director on a yearly basis
to determine if all conditions of this permit have been met and that the use does not have
5 a substantial negative effect on surrounding properties or the public health and welfare. If
the Planning Director determines that the use has such substantial negative effects, the
7 Planning Director shall recommend that the Planning Commission, after providing the
permittee the opportunity to be heard, add additional conditions to reduce or eliminate the
substantial negative effects.
9 14. This Conditional Use Permit is granted for a period of 10 years from February 21, 2001
10 through February 21, 2011. This permit may be revoked at any time after a public
hearing, if it is found that the use has a substantial detrimental effect on surrounding land
11 uses and the public's health and welfare, or the conditions imposed herein have not been
met. This permit may be extended for a reasonable period of time not to exceed 10 years
upon written application of the permittee made no less than 90 days prior to the
expiration date. The Planning Commission may not grant such extension, unless it finds
that there are no substantial negative effects on surrounding land uses or the public's
14 health and welfare. If a substantial negative effect on surrounding land uses or the
public's health and welfare is found, the extension shall be denied or granted with
15 conditions which will eliminate or substantially reduce such effects. There is no limit to
1 the number of extensions the Planning Commission may grant.16
17 15. Approval is granted for CUP 154(D) as shown on Exhibits "A" - "L", dated February
21, 2001, on file in the Planning Department and incorporated herein by reference.
18 Development shall occur substantially as shown unless otherwise noted in these
conditions.

16. The Developer is aware that the City is preparing a non-residential housing impact fee
(linkage fee) consistent with Program 4.1 of the Housing Element. The applicant is
21 further aware that the City may determine that certain non-residential projects may have
to pay a linkage fee, in order to be found consistent with the Housing Element of the
22 General Plan. If a linkage fee is established by City Council ordinance and/or resolution
and this project becomes subject to a linkage fee pursuant to said ordinance and/or
resolution, then the Developer, or his/her/their successors) in interest shall pay the
24 linkage fee. The linkage fee shall be paid at the time of issuance of building permits,
except for projects involving a request for a non-residential planned development for an
25 existing development, in which case, the fee shall be paid on approval of the final map,
parcel map or certificate of compliance, required to process the non-residential PUD,
26 whichever pertains. If linkage fees are required for this project, and they are not paid, this
project will not be consistent with the General Plan and approval for this project will
become null and void.
28 17. The Developer shall submit and obtain Planning Director approval of a Final Landscape
and Irrigation Plan showing conformance with the approved Preliminary Landscape Plan

and the City's Landscape Manual. The Developer shall construct and install all
2 landscaping as shown on the approved Final Plans, and maintain all landscaping in a
healthy and thriving condition, free from weeds, trash, and debris.

18. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the
landscape plan check process on file in the Planning Department and accompanied by the
project's building, improvement, and grading plans.
5 19. Prior to the issuance of the building permit, Developer shall submit to the City a Notice
of Restriction to be filed in the office of the County Recorder, subject to the satisfaction
7 of the Planning Director, notifying all interested parties and successors in interest that the
City of Carlsbad has issued a Conditional Use Permit by Resolutions No. 4923 on the
real property owned by the Developer. Said Notice of Restriction shall note the property
description, location of the file containing complete project details and all conditions of
approval as well as any conditions or restrictions specified for inclusion in the Notice of
10 Restriction. Tbe Planning Director has the authority to execute and record an amendment
to the notice which modifies or terminates said notice upon a showing of good cause by
11 the Developer or successor in interest.
17 20. No outdoor storage of materials shall occur onsite unless required by the Fire Chief.
When so required, the Developer shall submit and obtain approval of the Fire Chief and
the Planning Director of an Outdoor Storage Plan, and thereafter comply with the
14 approved plan.
15 21. All roof appurtenances, including air conditioners, shall be architecturally integrated and
concealed from view and the sound buffered from adjacent properties and streets, in
substance as provided in Building Department Policy No. 80-6, to the satisfaction of the
17 Directors of Community Development and Planning.
18 22. The Developer shall submit and obtain Planning Director approval of an exterior lighting
plan including parking areas. All lighting shall be designed to reflect downward and
avoid any impacts on adjacent homes or property.
20 23. The minimum front yard setback for buildings and parking spaces shall be 65 feet
2i as measured from the right-of-way line of Camino Vida Roble. This setback shall
be entirely landscaped and irrigated.

24 General
25 24. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, Developer shall apply for and obtain approval from, the City Engineer
26 for the proposed haul route.
97 25. Prior to issuance of any building permit, Developer shall comply with the requirements of
the City's anti-graffiti program for wall treatments if and when such a program is
formally established by the City.

Prior to the issuance of grading permit or building permit, whichever occurs first, the
applicant shall submit for City approval a "Storm Water Pollution Prevention Plan
(SWPPP)". The SWPPP shall be in compliance with current requirements and provisions
established by the San Diego Region of the California Regional Water Quality Control
Board. The SWPPP shall address measures to reduce to the maximum extent possible
storm water pollutant runoff at both construction and post-construction phases of the
project. At a minimum, the Plan shall:
A) Identify existing and post-development on-site pollutants.
B) Recommend source control Best Management Practices (BMPs) to filter said
pollutants.
C) Establish specific procedures for handling spills and routine clean up.
D) Special considerations and effort shall be applied to employee education on the
proper procedures for handling clean up and disposal of pollutants.
E) Ensure long-term maintenance of all post construct BMPs in perpetuity.
F) Identify how post-development runoff rates and velocities from the site will not
exceed the pre-development runoff rates and velocities. If maintaining post-
development rates at pre-development levels cannot be achieved, adequate
justification subject to the City Engineer's approval must be provided.
Fees/Agreements
27. Developer shall cause property owner to execute and submit to the City Engineer for
recordation the City's standard form Drainage Hold Harmless Agreement regarding
drainage across the adjacent property.
Grading
28. Prior to the issuance of a grading permit or building permit, whichever occurs first,
Developer shall submit to the City Engineer proof that a Notice of Intention for the start
of work has been submitted to the State Water Resources Control Board.
29. Based upon a review of the proposed grading and the grading quantities shown on the site
plan, a grading permit for this project is required. Developer shall apply for and obtain a
grading permit from the City Engineer prior to issuance of a building permit for the
project.
Dedications/Improvements
Developer shall cause Owner to make an irrevocable offer of dedication to the City
and/or other appropriate entities for all public streets (5 foot dedication of property
frontage for public right-of-way) and other easements (water easement for onsite fire
hydrant and water main) shown on the site plan. The offer shall be made by separate
recorded documents. All land so offered shall be offered free and clear of all liens and
encumbrances and without cost. Streets that are already public are not required to be
rededicated.
The developer shall process improvement plans through the City for the relocation
of the on-site water line and fire hydrant and installation of sidewalk. The plans

must be processed and approved by the City Engineer prior to the issuance of a
2 building permit. The sidewalk must also be installed prior to the issuance of a
building permit unless cash in an amount satisfactory to the City Engineer is
3 submitted to the City as collateral to secure the sidewalk installation.
Water/Sewer/Recycled Water
32. The Developer shall design and construct public facilities within public right-of-way or
within minimum 20-foot wide easements granted to the District or the City of Carlsbad.
At the discretion of the Deputy City Engineer - Utilities, wider easements may be
required for adequate maintenance, access and/or joint utility purposes.

33. This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the Deputy City Engineer -
10 Utilities has determined that adequate water and sewer facilities are available at the time
ofoccupancy.11
The sewer cleanout located within the driveway shall be protected by a concrete box

15 The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
17 35. Developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
18 with Carlsbad Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction
of the City Engineer.

36. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy
#17, the License Tax on new construction imposed by Carlsbad Municipal Code Section
5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by
Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable
22 Local Facilities Management Plan fee for Zone 5 pursuant to Chapter 21.90. All such
taxes/fees shall be paid at issuance of building permit. If the taxes/fees are not paid, this
approval will not be consistent with the General Plan and shall become void.
24 37. The Developer shall pay a landscape plan check and inspection fee as required by Section
25 20.08.050 of the Carlsbad Municipal Code.
26 38. Approval of this request shall not excuse compliance with all applicable sections of the
Zoning Ordinance and all other applicable City ordinances in effect at time of building
27 permit issuance, except as otherwise specifically provided herein.
28 39. The project shall comply with the latest non-residential disabled access requirements
pursuant to Title 24 of the State Building Code.

2 40. Any signs proposed for this development shall at a minimum be designed in conformance
with the City's Sign Ordinance and shall require review and approval of the Planning
3 Director prior to installation of such signs.

6 dedications, reservations, or other exactions hereafter collectively referred to for convenience as
"fees/exactions."7
You have 90 days from date of final approval to protest imposition of these fees/exactions. If
