FOREWORD (PLEASE READ):
This plan review is limited to the technical requirements contained in the Uniform Building Code,
Uniform Plumbing Code, Uniform Mechanical Code, National Electrical Code and state laws
regulating energy conservation, noise attenuation and access for the disabled. This plan review
is based on regulations enforced by the Building Department. You may have other corrections
based on laws and ordinance by the Planning Department, Engineering Department, Fire
Department or other departments. Clearance from those departments may be required prior to
the issuance of a building permit.
Present California law mandates that residential construction comply with Title 24 and the
following model codes: 1997 UBC, 1997 UPC, 1997 UMC and 1996 NEC (all effective 7/1/99).
The above regulations apply to residential construction, regardless of the code editions adopted
by ordinance.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1997 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.
To speed UP the recheck process, please note on this list (or a copy) where each
correction Item has been addressed. I.e.. plan sheet number, specification section, etc.
Be sure to enclose the marked UP list when you submit the revised plans.

Please make all corrections on the original tracings, as requested in the correction
list. Submit three sets of plans for commercial/industrial projects (two sets of plans
for residential projects). For expeditious processing, corrected sets can be
submitted in one of two ways:
1. Deliver all corrected sets of plans and calculations/reports directly to the City of
Carlsbad Building Department, 1635 Faraday Ave., Carlsbad, CA 92008, (760)
602-2700. The City will route the plans to EsGil Corporation and the Carlsbad
Planning, Engineering and Fire Departments.
2. Bring one corrected set of plans and calculations/reports to EsGil Corporation,
9320 Chesapeake Drive, Suite 208, San Diego, CA 92123, (858) 560-1468.
Deliver all remaining sets of plans and calculations/reports directly to the City of
Carlsbad Building Department for routing to their Planning, Engineering and Fire
Departments.
NOTE: Plans that are submitted directly to EsGil Corporation only will not be
reviewed by the City Planning, Engineering and Fire Departments until review by
EsGil Corporation is complete.
1. All sheets of the plans and the first sheet of the calculations are required to be
signed and sealed by the licensed architect or engineer responsible for their
preparation.
2. The site date on the non-numbered title sheet of the plans lists the project as
"condominiums" but the title of the project is 3 apartment units. Is this building
intended to be an apartment or condominium?
3. Clarify the door schedule found on sheet A6.0. All doors listed on the schedule
are one hour rated. Why are all doors listed as one hour fire rated? The
schedule also indicates door type and hardware by letters. What do these letters
mean?
4. The lower level bed room of Unit 2 shows a 6068 SGD on the floor plan but the
indicates a 3068 vinyl frame one hour rated door assembly. What is intended?
5. Window #5 at the lower level bed room of unit 1 must be tempered glass where it
is within 24" of the bed room door.
6. Window #1 within 24 of the entrance door of unit 3 must be tempered glass.
7. Why are the exterior doors of the garages listed as 1 -3/8 solid core fire rated on
sheet A1.0?
8. Windows 1 & 1A within the stair enclosure of all units must be tempered glass.
9. The floor plan general notes listed on sheet A1.1 do not match the numbers
shown on the floor plan. For instance note 9 appears at the fireplace of unit 3 but
not 9 on this sheet indicates "new water closets and associated flushometer
valves...etc". the floor plan note numbers on sheet A1.1 are as high as No. 30

but there are only 10 floor plan notes found on sheet A1.1 Correct the plans and
notes on all sheets consistent with what is shown on the plans.
10. What is the purpose of note No. 44 found on sheet A1.1? Does it have some
significance on this sheet? Please clarify.
11. Why does the roof plan on sheet A3.0 show the fire separation between the units
extending 5'-0" beyond the demising walls? What is the purpose of this
extension?
Are these fire walls at the units intended to be area separation walls?
12. The detail references on the sections on sheets A5.0, A5.1 for the most part do
not apply to what is shown on the section. For instances detail 2/SD2.0 is
referenced at the stair sections on sheet A5.0. Detail 2/SD2.0 is a footing detail
and has nothing to do with the stairs. The architect of record should carefully
review the details referenced on the section for accuracy prior to submitting for
recheck.
FIRE-RESISTIVE CONSTRUCTION
13. Detail on the plans the double wall, one hour party wall construction. Reference
the detail to the floor plans. Walls and floors separating dwelling units in the same
building, or guest rooms in hotels, shall be of not less than one-hour fire-resistive
construction. Section 310.2.2.
14. Detail on the plans the floor ceiling fire protection between the garages and the
units above. Reference the floor ceiling construction detail to the sections.
SOUND TRANSMISSION
15. Wall and floor/ceiling assemblies separating dwelling units from each other and
from common space (such as corridors, laundry rooms, common garages, service
areas, etc.) must have a listed rating of STC 50 and IIC 50. Show the location of
and provide details of the listed wall and floor/ceiling assemblies, and indicate the
listing agency and listing number for the tested ratings.
16. Show how penetrations of assemblies for piping, electrical devices, recessed
cabinets, bathtubs, soffits or heating, ventilating or exhaust ducts shall be sealed,
lined or insulated or treated to maintain the required sound ratings.
STAIRWAYS AND ELEVATORS
17. Reference the stair and handrail details found on sheet D1.0. to the floor plans
and sections where the details apply.
R-1 GENERAL OCCUPANCY REQUIREMENTS

18. Draft stops shall be installed in floor-ceilings, attics, mansards and similar
concealed spaces and shall be above and in line with walls separating units from
each other and from other uses. Section 708.3.1.1.2.
19. Show location of attic access with a minimum size of 22"x30", unless the
maximum vertical headroom height in the attic is less than 30." Access must be
provided to each separated attic area, shall be located in a hallway or other
readily accessible location and 30" headroom clearance is required above the
opening. Section 1505.1.
ELECTRICAL (NATIONAL ELECTRICAL CODE)
20. Provide receptacle at each sink in the bath rooms with double sinks. In lieu of
this you may place the required receptacle between the sinks.
• PLUMBING
21. Include the gas line sizing calculations and isometric diagram of the gas pipe.
The plans indicate "See P-7 for gas sizes" there is no sheet P-7 with the plans.
22. Include with the plumbing plans materials specifications for water, waste, vent
and gas piping.
23. Specify a min. 14:12 slope for the waste lines shown on sheets P-4 and P-5.
ENERGY CONSERVATION
24. Cloth backed duct tape is no longer permitted to be used as the sole connection
for mechanical ducting. Note on the plans that duct tape, as a minimum, meeting
the requirements of UL181,181A, or 181B, shall be used or additional duct
attachment devices such as tie wraps or mastic will be required for installing
mechanical ducting.
25. Detail or note on the plans: The return air plenum serving the mechanical
equipment must be fully ducted from the equipment to the conditioned space.
Drop ceilings, wall cavities and equipment platforms may not be used as
plenums."
26.
Provide fluorescent general lighting (40 lumens per watt minimum) in kitchen(s)
and bathrooms (containing a tub or shower).
27. Note on the plans: The manufactured windows shall have a label attached
certified by the National Fenestration Rating Council (NFRC) and showing
compliance with the energy calculations."
28. The window schedule shall clearly describe the required U-factor and solar heat
gain coefficient (SHGC) values and demonstrate compliance with the Title 24

energy calculations.
FOUNDATION
29. Provide a copy of the project soil report prepared by a California licensed
architect or civil engineer. The report shall include foundation design
recommendations based on the engineer's findings and shall comply with UBC
Section 1804.
30. Investigate the potential for seismically induced soil liquefaction and soil
instability in seismic zones 3 and 4. Section 1804.5
31. There is no foundation support for the 2nd floor area of Unit #3 in front of the
garage.
32. There are no footings shown in the interior bearing walls between the Garage
and Bed Rm of Unit #2Spread footing sizes and column sizes are not shown on
the foundation plan.
There will be no further plan review for the foundation until the soil report Is
submitted and design engineer assuming responsibility for the design of the
structure reviews the foundation plan for consistency with his design and
footing support at all bearing walls and posts.
STRUCTURAL
33. The Table of contents for the structural design calculations lists page numbers
for the various elements of the building design. The pages of the design calc's
must be numbered consistent with the Table of contents on the cover sheet.
34. The design calc's did not include the design of roof beam RBM-3 supporting the
trusses at the 2nd floor.
35. Include as part of the design calc's the columns at the front of the garages. Also,
include connection details for these columns at the foundation and beam.
36. Detail on the plans and reference to the roof plan the connection of the 2nd floor
trusses to the interior shear walls both parallel and perpendicular to the shear
walls.
37. Expand the lateral design to show how you arrived at the lateral force coefficient
of 0.174 X W to determine the seismic loading.
38. Show on the plans the location and size of Hardy frames to resist the lateral
loads at the front of the garages.
39. Clarify how you approached the lateral design of the building. Was the design
based on a unit-by-unit basis? It appears that only certain shear wall lines were

considered for the 2nd and 1st floors and then other lines are analyzed at the 2nd
and 1st floor levels. It is not clear how you approached the design.
40. Include as part of the design calc's the foundations. This applies to continuous
footings and spread footings supporting concentrated loads.
41. There is no support shown for the floor beam FBM-1. Provide vertical support for
this beam.
42. FBM-2 is shown supporting concentrated loads from beams FBM-1 and RBM-3.
The design of FBM-1, 2 & 3 are all identical. This does not match what is shown
on the plans.
NOTE: This was a preliminary plan review. The plans and calc's were very
Incomplete and lacing in details and referencing. A complete plan review will
be provided when the Items above have been addressed.
To speed up the review process, note on this list (or a copy) where each correction
item has been addressed, i.e., plan sheet, note or detail number, calculation page,
etc.

• If owner/developer proposes a size other than the "standard", then
owner/developer must provide potable water demand calculations,
which include total fixture counts and maximum water demand in gallons
per minute (gpm). A typical fixture count and water demand worksheet is
attached. Once the gpm is provided, check against the "meter sizing
schedule" to verify the anticipated meter size for the unit.
• Maximum service and meter size is a 2" service with a 2" meter.
• If a developer is proposing a meter greater than 2", suggest the
installation of multiple 2" services as needed to provide the anticipated
demand, (manifolds are considered on case by case basis to limit
multiple trenching into the street).
12b. Irrigation Use (where recycled water is not available)
All Irrigation meters must be sized via irrigation calculations (in gpm) prior
to approval. The developer must provide these calculations. Please follow
these guidelines:
1. If the project is a newer development (newer than 1998), check the recent
improvement plans and observe if the new irrigation service is reflected on
the improvement sheets. If so, at the water meter station, the demand in
gpm may be listed there. Irrigation services are listed with a circled "I",
and potable water is typically a circled "W". The irrigation service should
look like:

If the improvement plans do not list the irrigation meter and the
service/meter will be installed via another instrument such as the building
plans or grading plans (w/ a right of way permit of course), then the
applicant must provide irrigation calculations for estimated worst-case
irrigation demand (largest zone with the farthest reach). Typically, Larry
Black has already reviewed this if landscape plans have been prepared,
but the applicant must provide the calculations to you for your use. Once
you have received a good example of irrigation calculations, keep a set for
your reference. In general the calculations will include:

Elevation at point of connection (POC)
Pressure at POC in pounds per square inch (PSI)

service boundary, the City intends on switching these irrigation
services/meters to a new recycled water line In the future.
D D 12c. Irrigation Use (where recycled water is available)
1. Recycled water meters are sized the same as the irrigation meter above.
2. If a project fronts a street with recycled water, then they should be
connecting to this line to irrigate slopes within the development. For
subdivisions, this should have been identified, and implemented on the
improvement plans, installing recycled water meters is a benefit for the
applicant since they are exempt from paying the San Diego County Water
Capacity fees. However, if they front a street which the recycled water is
there, but is not live (sometimes they are charged with potable water until
recycled water is available), then the applicant must pay the San Diego
Water Capacity Charge. If within three years, the recycled water line is
charged with recycled water by CMWD, then the applicant can apply for a
refund to the San Diego County Water Authority (SDCWA) for a refund.
However, let the applicant know that we cannot guarantee the refund, and
they must deal with the SDCWA for this.

WHEREAS, Karnack Architecture, Inc, "Developer," has filed a verified
application with the City of Carlsbad regarding property owned by Salim Ayonb, "Owner,"
described as
That portion of Tract 100 of Carlsbad Lands, in the City of
Carlsbad, County of San Diego, according to Map thereof No.
1661, filed in the Office of the County Recorder of San Diego
County, March 1,1915.

WHEREAS, said verified application constitutes a request for a Site Development
Plan as shown on Exhibits) "A" - **P" dated January 16, 2002, on file in the Planning
Department, AYOUB TRIPLEX - SDP 00-18 as provided by Chapter 21.06/Section 21.53.120
of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 16th day of January, 2002,
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Site Development Plan.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Planning
Commission APPROVES AYOUB TRIPLEX - SDP 00-18 based on the
following findings and subject to the following conditions:
1. That the Planning Director has determined that the project belongs to a class of projects
that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15303(b), new construction
of four or less units in an urbanized area, of the state CEQA Guidelines. In making
this determination, the Planning Director has found that the exceptions listed in Section
15300.2 of the state CEQA Guidelines do not apply to this project.
2. The project is consistent with the City- Wide Facilities and Improvements Plan, the Local
Facilities Management Plan for Zone 1 and all City public facility policies and
ordinances. The project includes elements or has been conditioned to construct or
provide funding to ensure that all facilities and improvements regarding: sewer collection
and treatment; water; drainage; circulation; fire; schools; parks and other recreational
facilities; libraries; government administrative facilities; and open space, related to the
project will be installed to serve new development prior to or concurrent with need.
Specifically
A. The project has been conditioned to provide proof from the Carlsbad Unified
School District that the project has satisfied its obligation for school facilities.
B, The Public Facility fee is required to be paid by Council Policy No. 17 and will be
collected prior to the issuance of building permit.
3. That the requested use is properly related to the site, surroundings and environmental
settings, is consistent with the various elements and objectives of the General Plan, will
not be detrimental to existing uses or to uses specifically permitted in the area in which
the proposed use is to be located, and will not adversely impact the site, surroundings or
traffic circulation, in that the project's density is consistent with the Residential High
General Plan designation for the property; a two-story building is compatible with
surrounding one and two-story buildings; all necessary public streets and utilities
have been constructed, or will be dedicated and a Neighborhood Improvement
Agreement secured for future street Improvements, prior to occupancy of any units;
no conflicts with existing easements will result from the development, and no
encroachments into sensitive habitat are proposed on this previously developed site.
4. That the site for the intended use is adequate in size and shape to accommodate the use, in
that the proposed apartment units comply with all development standards of the R-3
zone and Beach Area Overlay Zone (BAOZ) and fits within the existing lot lines,
and property boundaries and will be compatible with existing and future
surrounding multi-family and single family development
5. That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust
the requested use to existing or permitted future uses in the neighborhood will be

provided and maintained, in that the proposed three apartment units comply with all
standards of the R-3 and Beach Area Overlay Zone standards. The project provides
adequate setbacks, parking and complies with the 30 foot building height limit.
6. That the street systems serving the proposed use is adequate to properly handle all traffic
generated by the proposed use, in that access will be provided by Pine Avenue, a local
street, designed to accommodate the 24 ADT proposed by the project.
7. That the project is consistent with the City's Landscape Manual (Carlsbad Municipal
Code Section 14.28.020 and Landscape Manual Section IB).
8. The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
to mitigate impacts caused by or reasonably related to the project, and the extent and the
degree of the exaction is in rough proportionality to the impact caused by the project
Conditions;
Note: Unless otherwise specified herein, all conditions shall be satisfied prior to building
permit
Planning:
1. If any of the following conditions fail to occur, or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
future building permits; deny, revoke or further condition all certificates of occupancy
issued under the authority of approvals herein granted; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No
vested rights are gained by Developer or a successor in interest by the City's approval of
this Site Development Plan.
2. Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the Site Development Plan documents, as necessary to make them
internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
different from this approval, shall require an amendment to this approval.
3. The Developer shall comply with all applicable provisions of federal, state, and local
laws and regulations in effect at the time of building permit issuance.
4. If any condition for construction of any public improvements or facilities, or the payment
of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project
are challenged, this approval shall be suspended as provided in Government Code Section
66020. If any such condition is determined to be invalid this approval shall be invalid
unless the City Council determines that the project without the condition complies with
all requirements of law.

5. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and
2 hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
3 and costs, including court costs and attorney's fees incurred by the City arising, directly
or indirectly, from (a) City's approval and issuance of this Site Development Plan, (b)
4 City's approval or issuance of any permit or action, whether discretionary or non-
- discretionary, in connection with the use contemplated herein, and (c)
Developer/Operator's installation and operation of the facility permitted hereby,
5 including without limitation, any and all liabilities arising from the emission by the
facility of electromagnetic fields or other energy waves or emissions. This obligation
7 survives until all legal proceedings have been concluded and continues even if the City's
approval is not validated.8
6. This approval is granted subject to the approval of CDP 00-66 and is subject to all
conditions contained in Planning Commission Resolution No. 5052 for those other
approvals incorporated herein by reference.
11 7. The Developer shall submit to the Planning Department a reproducible 24" x 36",
mylar copy of the Site Plan reflecting the conditions approved by the final decision
making body.
13 8. The Developer shall submit and obtain Planning Director approval of a Final Landscape
14 and Irrigation Plan showing conformance with the approved Preliminary Landscape Plan
and the City's Landscape Manual. The Developer shall construct and install all
landscaping as shown on the approved Final Plans, and maintain all landscaping in a
healthy and thriving condition, free from weeds, trash, and debris.
17 9. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the
landscape plan check process on file in the Planning Department and accompanied by the
18 project's building, improvement, and grading plans.
10. Developer shall pay to the City an Inctusionary housing In-lieu fee as an individual fee
2Q on a per market rate dwelling unit basis hi the amount in effect at the time, as established
by City Council Resolution from time to time.

11. Prior to the issuance of the Site Development Plan, Developer shall submit to the City a
22 Notice of Restriction to be filed in the office of the County Recorder, subject to the
satisfaction of the Planning Director, notifying all interested parties and successors in
interest that the City of Carlsbad has issued a(n) Site Development Plan by Resolution(s)
24 No. 5051 on the real property owned by the Developer. Said Notice of Restriction shall
note the property description, location of the file containing complete project details and
25 all conditions of approval as well as any conditions or restrictions specified for inclusion
in the Notice of Restriction. The Planning Director has the authority to execute and
26 record an amendment to the notice which modifies or terminates said notice upon a
. showing of good cause by the Developer or successor in interest.
28 12. Prior to the issuance of a building permit, the Developer shall provide proof to the
Director from the Carlsbad Unified School District that this project has satisfied its
obligation to provide school facilities.

13. This project shall comply with all conditions and mitigation measures which are required
as part of the Zone 1 Local Facilities Management Plan and any amendments made to
that Plan prior to the issuance of building permits.
14. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy
#17, the License Tax on new construction imposed by Carlsbad Municipal Code Section
5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by
Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable
Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such
taxes/fees shall be paid at issuance of building permit. If the taxes/fees are not paid, this
approval will not be consistent with the General Plan and shall become void.
15. All roof appurtenances, including air conditioners, shall be architecturally integrated and
concealed from view and the sound buffered from adjacent properties and streets, in
substance as provided in Building Department Policy No. 80-6, to the satisfaction of the
Directors of Community Development and Planning.
16. This approval shall become null and void if building permits are not issued for this
project within 24 months from the date of project approval.
17. Building permits will not be issued for this project unless the local agency providing
water and sewer services to the project provides written certification to the City that
adequate water service and sewer facilities, respectively, are available to the project at the
time of the application for the building permit, and that water and sewer capacity and
facilities will continue to be available until the time of occupancy.
Engineering:
General
Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, Developer shall apply for and obtain approval from, the City Engineer
for the proposed haul route.
Prior to issuance of any building permit, Developer shall comply with the requirements of
the City's anti-graffiti program for wall treatments if and when such a program is
formally established by the City.
Prior to occupancy, Developer shall install rain gutters to convey roof drainage to an
approved drainage course or street to the satisfaction of the City Engineer.

cause Owner to give written consent to the City Engineer to the annexation of the area

Based upon a review of the proposed grading and the grading quantities shown on the site
plan, a grading permit for this project is required. Developer shall apply for and obtain a
grading permit from the City Engineer prior to issuance of a building permit for the
project.
Developer shall cause Owner to process a street vacation subject to City processing
and City Council approval for 10 feet of public right-of-way along the project
frontage as shown on the site plan. Said street vacation must be approved and
recorded prior to the issuance of a grading permit
Developer shall execute and record a city standard development improvement agreement
to install and secure with appropriate security as provided by law, public improvements
shown on the site plan and the following improvements including, but not limited to
A. Sidewalk, driveway approach, curb and gutter, and 6 inch high transitional
asphalt berm;
B. Sewer lateral, sewer access hole and potable water service line.
C. Water service line with above ground double check valve detector assembly if
building fire sprinklers are required by the Fire Department
Said improvements shall be installed to city standards to the satisfaction of the city
engineer. Improvements listed above shall be constructed within 18 months of
approval of the development improvement agreement or such other time as
provided in said agreement
Prior to removing or relocating the Eucalyptus tree located within the public right-
of-way fronting Pine Ave., and prior to issuance of a grading permit, the developer
shall obtain a permit to remove or relocate said tree in accordance with the
procedures and standards of Chapter 11.12 of the Carlsbad Municipal Code. If
application for permit to remove or relocate said tree is denied, applicant shall
design and Install public sidewalk so as not to harm the tree.
Developer shall have the entire drainage system designed, submitted to and approved by
the City Engineer, to ensure that runoff resulting from 10-year frequency storms of 6
hours and 24 hours duration under developed conditions, are equal to or less than the
runoff from a storm of the same frequency and duration under existing developed
conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the
detention basin capacities necessary to accomplish the desired results.

^—' the applicant shall submit for City approval a "Storm Water Pollution Prevention
Plan (SWPPP)." The SWPPP shall comply with current requirements and
provisions established by the San Diego Region of the California Regional Water

post-construction phases of the project At a minimum, the Plan shall:
A. Identify existing and post-development on-site pollutants.
B. Recommend source control Best Management Practices (BMPs) to filter said
pollutants.
C. Establish specific procedures for handling spills and routine clean up.
Special considerations and effort shall be applied to resident education on the
proper procedures for handling clean up and disposal of pollutants such as
household products, fluid leaks from cars, etc.
D. Ensure long-term maintenance of all post construct BMPs in perpetuity.
E. Identify how post-development runoff rates and velocities from the site will
not exceed the pre-development runoff rates and velocities for a 10-year, 6-
hour storm event
Prior to occupancy, developer shall install sidewalks along all public streets abutting the
project site in conformance with City of Carlsbad Standards.
Prior to the issuance of a building permit, applicant shall cause owner to enter into
an encroachment agreement with the City for a portion of the proposed infiltration
basin and fence encroaching into the 10-foot public utility easement to be retained
from the proposed street vacation.

Prior to approval of improvement plans or final map, Developer shall meet with the Fire
Marshal to determine if fire protection measures (fire flows, fire hydrant locations,
building sprinklers) are required to serve the project. Fire hydrants, if proposed, shall be
considered public improvements and shall be served by public water mains to the
satisfaction of the District Engineer.
Prior to issuance of building permits, Developer shall pay all fees, deposits, and charges
for connection to public facilities. Developer shall pay the San Diego County Water
Authority capacity charges) prior to issuance of Building Permits.
The Developer shall install potable water services and meters at a location approved by
the District Engineer. The locations of said services shall be reflected on public
improvement plans.

This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the District Engineer has
