This plan review is limited to the technical requirements contained in the Uniform Building Code, .
Uniform Plumbing Code, Uniform Mechanical Code, National Electrical Code and state laws
regulating energy conservation, noise attenuation and access for the disabled. This plan review
is based on regulations enforced by the Building Department. You may have other corrections
based on laws and ordinances enforced by the Planning Department, Engineering Department,
Fire Department or other departments. Clearance from those departments may be required
prior to the issuance of a building permit.
Code sections cited are based on the 1994 UBC.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1994 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.
To speed up the recheck process, please note on this list (or a copy) where each
correction item has been addressed, i.e., plan sheet number, specification section, etc.
Be sure to enclose the marked up list when you submit the revised plans.

1. Please make all corrections on the original tracings and submit two new sets of
prints, to:
Esgil Corporation, 9320 Chesapeake Drive, Suite #208, San Diego, CA 92123,
(619) 560-1468 or to the jurisdiction's building department.
2. Plans and calculations shall be signed by the California state licensed engineer
or architect. Please include the California license number, seal, date of license
expiration and date plans are signed. Business and Professions Code.
3. Provide a note on the site plan indicating the previous use of the tenant space or
building being remodeled. Section 106.3.3.
4. When the character of the occupancy or use changes within a building, the
building must be made to comply with current Building Code requirements for the
new occupancy. Please provide complete details to show the building will
comply. Section 3405.
5. UBC Section 107.2 requires the Building Official to determine the total value of \,
all construction work proposed under this permit. The value shall include all finish
work, painting, roofing, electrical, plumbing, heating, air conditioning, elevator,
fire extinguishing systems and any other permanent equipment. Please provide a
signed copy of the designer's or contractor's construction cost estimate of all
work proposed.
6. Provide a fully dimensioned floor plan showing the size and use of all rooms or
areas within the space being improved or altered. Draw the plans to scale and
indicate the scale on the plan. Section 106.3.3.
7. Indicate the use of all spaces adjacent to the area being remodeled or improved.
8. Show any existing fire rated area separation walls, occupancy separation walls,
demising walls, shafts or rated corridors. Identify and provide construction details
for proposed new fire rated walls.
9. Specify on the plans the fire ratings of assemblies to protect penetrations or
proposed op~nings in existing or new fire walls, floor-ceiling assemblies or
roof-ceiling assemblies.
10. A complete description of the activities and processes that will occur in this
tenant space should be provided. A listing of all hazardous materials should be
included. The materials listing should be stated in a form that would make
classification in Tables 3-D and 3-E possible. The building official may require a
technical report to identify and develop methods of protection from hazardous
materials. Section 307.1.6.

11. If control areas are used for exceeding the exempt amounts of hazardous
materials from Tables 3-D and 3-E, they shall be constructed of not less that
required for a one-hour occupancy separation. Footnote 1.

shall not exceed two; the number of control areas in buildings with other uses

16. The tenant space and new and/or existing facilities serving the remodeled area
must be accessible to and functional for the physically disabled. See the
attached correction sheet. Title 24, Part 2.
17. Specify lever-type hardware for passage doors on floors accessible to the
disabled. Section 2-3304, Title 24.
18. Provide an exit analysis plan (may be 8 1/2" x 11" or any convenient size). Show
the occupant load of each room and the flow of exit from each.
19. Rooms with more than 1 0 occupants may have one exit through one adjoining
room. Revise exits to comply. Section 1003.5.
20. Corridors must provide continuous protection to the exterior of the building.
Interruptions by an intervening room is not permitted. Foyers, lobbies or
reception rooms constructed as required for corridors are not considered
intervening rooms. Section 1005.1.
21. Corridors serving 30 or more occupants shall have walls and ceilings of one-hour

22. One-hour fire-rated corridors shall have interior door openings protected by tight-
fitting smoke and draft control assemblies rated 20 minutes, except openings in
interior walls of exterior exit balconies. Doors shall be maintained self-closing or
be automatic closing by action of a smoke detector per Section 713.2. Doors
shall be gasketed to provide a smoke and draft seal where the door meets the
stop on sides and top. Section 1005.8.1.

Attached to this letter are the revised drawings incorporating the plan check corrections from the first
plan check review. We have noted on a copy of the attached copy of the original correction sheet, the
location where the corrections have been made.
Additions since the first review: In addition to the corrections, the following additions have been made
to the plans.
• New exterior stairway: In a pre plan check review with the Building Dept., an existing dead end
corridor at the second floor was identified. The Building Dept. performed a review and determined
·that this existing condition must be rectified. An emergency exit stairway has been added extending
from the second floor corridor to the ground at the exterior, at the north west corner of the building.
This will be for exit only.

I have reviewed the operations in your Carlsbad facility relative to the use and storage of your
flammable and combustible materials at your various workstations. My review was based on
personal observation of the operations, review of applicable codes, and industrial hygiene studies
that I asked to be conducted.
The purpose of my review was twofold. First, I needed to determine whether your operation both
currently and as proposed following your consolidati9n activity is in compliance with the
requirements of the Uniform Building Code (UBC) and Uniform Fire Code (UFC). Second, my
review was also to determine whether a hazard existed relative to the use of materials that could
pose a threat from an unreasonable increase in the fife hazard, or which posed a health hazard
above the applicable.OSHA r~gulations. Following is a summary of my conclusions.
The use of flammable and combustible materials is part of the operation at the Carlsbad site
currently. This primarily involves the use of material for cleaning various small pieces of
machinery. The use of these cleaners is largely confined to workstations where the amount used in
containers of approximately 4 ounces each where the cleaning agent is dispensed from a squeeze
bottle onto a rag or the part. This is an operation which is repeated at a number of workstations
throughout the facility on an intermittent basis throughout the course of your work day.
It is expected that with the consolidation of your sites, the use of cleaning with some of these
materials will continue and in fact increase. Essentially the type of materials will remain the same,
but the number of workstations will increase throughout the operation. It should be noted that the
total amounts used throughout the site in both open and closed systems, as well as storage is
expected to remain under the UBC Table 3D amounts in order that you can remain classified as a
Group F, Division I occupancy i:p. those areas used for manufacturing or assembly.
In reviewing the materials used for cleaning, the most commonly used flammable liquid is
isopropyl alcohol (IP A) which is classified as a Class IB flammable liquid. The flash point for
this material in pure form is 53° F, and t4e flammable range is 2% tQ 12.7%. In your processes
you use both pure and some dilute solutions which raise the flashpoint even higher.

In addition to being flammable, IP A also has a degree of toxicity which OSHA regulates as part of
the worker protection program in Title 8. The safe levels of the airborne material is expressed as
the Permissible Exposure Limits (PEL) as published by Cal OSHA, and in other reference
documents such as those.of the American Conference of Governmental Industrial Hygienists
where we find the TL V /I'W A for each material. Levels below the PEL and TL V rrw A are
considered to be safe relative to the toxicity of the materials for periods of exposure up to eight
hours per day. The 8 hour average exposure limit established for IP A is 400 ppm~? 1.
In reviewing the area where the materials are used I find it to be adequately ventilated, and very
open. Discussions with the architect for this project have confirmed that the ventilation system
complies with the requirements of the UBC for a Group F, Division I occupancy as outlined in
Chapter 12 of the 1994 UBC. It is also my understanding that ventilation in the area of
manufacturing and assembly is expected to increase with the consolidation of your sites. The
increase in ventilation where these materials are used will further increase what seems to be an
already good situation. Given this, ventilation seems to be in compliance with the UBC as
adopted.
As someone who does not understand the use of the UBC, you might be confused at this point
regarding two areas of the UCB which also discuss ventilation requirements. The first of these is
the requirement of section 120,2.2.2 which requires that when materials classified as Class I, II,
and ill-A liquids are used, the ventilation system must be capable of providing six air changes per
hour. While this is the case, this section relates only to Group B occupancies as is noted in the
heading.
Another item which may cause you some confusion is the use of the Appendix to Chapter 12 of
the UBC. In the Appendix, it states that this ventilation requirement may also apply to hazardous
areas and even to Group F occupancy classifications. Obviously you could be confused about this
given that it is written in the Code book, but you should understand that the Appendices to the
UBC are not necessarily part of the adopted code for the jurisdictions using it. In fact, I checked
with the City of Carlsbad to determine whether they had adopted the Appendix to Chapter 12 and
found out that this Appendix has not been adopted by the City as part of their City Ordinance (Title
18) which adopted the UBC for local use.
I confirmed this by reading Title 18 of the City Code, in which it states that the City adopted "The
Uniform Building Code, Volumes 1, 2, and 3, 1994 Edition, excluding Chapter 11 and including
Appendix Chapters 15, 29, and 31 Division ill." Given that the City chose not to adopt this
Appendix, it would follow that the requirements as outlined in the Chapter 12 Appendix would not
be enforced by them. Further, given that your site is in compliance with the requirements of
Chapter 12 of the UBC relative to ventilation systems, it would follow that the issue of regulatory
compliance is resolved.
Regulatory compliance aside, I also wanted to confirm that we did not have any type of hazard
relative to toxicity at the workstations and/or whether any increased fire hazard did in fact exists
which would warrant changes to your ventilation system. To do this, we conducted some testing
of the workstations where the various cleaning agents were used at each of your sites. The tests
consisted of conducting air sampling by a Certified Industrial Hygienist (CIH) who was briefed by
me on the data required.

The tests consisted of conducting air monitoring for levels of IP A at the workstations which were
determined to present the worst case scenarios for both increasing the flammability hazards as well
as those which would pose the highest potential for exposure of employees working in the areas.
The tests were conducted at multiple sites, including Carlsbad, on two separate days, using a
variety of operations determined to present the highest levels of vapor production.
The results of the tests were better than anticipated. During the most extreme use of the IP A for
routine cleaning, it was determined that the levels never rose above 400 ppm. The 400 ppm level
was noted only momentarily and given the high vapor pressure of IP A, the levels quickly returned
to normal. Clearly, the exposure of your employees is well below the 8 hour average exposure
that is required.
Flammability testing was also conducted using a combustible gas indicator with the appropriate
conversion tables for IP A. Results of the air sampling for flammable vapors showed levels at
approximately 2% of the Lower Explosive Limit (LEL). Obviously this is well under the levels
considered to be safe and given that the levels were only transient due to the rapid evaporation of
the product, there does not appear to be an issue relative to the collection of flammable vapors with
the ventilation system presently in place.
During the testing we also found one area where some items were dipped into a small tank of
solvent. Testing of this area while the materials were used revealed levels of approximately 5% of
the LEL for a moment with concentrations returning to normal in less than one minute. Again,
this process is one which is done relatively infrequently and levels are still well below those
considered to be safe.
It is obvious to me that you have a strong dedication to making your workplace safe. Having
worked with other Nellcor Puritan Bennett facilities, I am convinced of your corporate
commitment to not only meeting the requirements of the various codes, but also in going beyond
them. Such is evident in your program to replace some of your current solvents with 'less
hazardous materials. I will continue to work with you and other members of your staff to review
all of your current use of hazardous materials and-recommend alternative solvents which, at some
later date, may be able to be used to substitute for those currently used. While this is not required,
it is consistent with your past practices and your overall corporate commitment to safety.
I trust that this information will be useful to you. I am continuing to work on the gas blending
room project and will update you on this as soon as additional information is available. Please call

I am in receipt of two separate requests from Nelcor-Puritan. The first one appears to
be a deferral to the City to rule on the applicability of UBC Appendix Section 1207.
The appellant has pointed out quite astutely that the referenced appendix section
has not been adopted into the City Municipal Building Code. Hence, if they choose
not to follow that Code section, there is nothing to compel them to do so. I will make
that appendix part of the next adoptive ordinance. (Reference Plan Check CB 2002)
The second request is from TK&G to allow an exhaust fan to discharge into a return
air plenum. This is prohibited in the Uniform Mechanical Code Section 317 (1994).
This particular section of the Mechanical Code has been adopted into the Municipal
Code, Title 18.08. (Reference Plan Check Unknown).

I'm submitting this letter In response to the "Notlcen from Tim Phillips dated 4/10/97. ·This
'1notice" consists of eight items regarding accessibility issues at the Nellcor Puritan Bennett
Consolidation project. Items #2 though #7 on this notice are presently being incorporated into
the work on the project. We reviewed items #1 and 118 in our telephone conversation on
4/15/97 and discussed methods of providing a fully accessible building without undue burden
to the owners. The requests listed herein are based on my understanding of our telephone
conversation.
Item #1: This Item concerns the Toilet Rooms off the ·main lobby. The water closets in these
rooms do not meet the proscribed 18" min. distance from the side walls to be compliant as
accessible rooms. ·
Proposed Solution: . Per our phone conversation we are providing "equivalent facilitation" of
one set ( men's and women's) of existing accessible toilet rooms on each floor.· In these four
toilet rooms the grab bars at the rear of the accessible toilet stall will be replaced with a new
36" grab bar. These rooms will then be fully accessible.
Item #8: This item regards the handrail height at all interior stairs. Present code 1itle 24
(State) and ADA (Federal) mandate that the top of handrails must be located between 34"~38"
above the stair nosing. The existing stair handrails are located at 30" to center of rail, this was
acceptable under the 1988 UBC when the building W8$ built. The only acceptable action here
is to raise the handrails to the required height. These modifications will effect all four major
stairs within the bldg.

Proposed Solution; Our request is that this issue be separated from the present building
permit. This would allow Nellcor Puritan Bennett to modify one set of stairs at a time without
disrupting overall operations and provide closure for the Consolidation Project The provision
to this would be that the work on the handrail modifications will be pennitted separately and
must be accomplished in a specified time period of not more than two years.
It is my understanding that the incorporation of these solutions should resolve all items on the
4/10/97 "notice". Please review these requests and contact me to discuss our next course of
