This plan review is limited to the technical requirements contained in the California version of
the International Residential Code, International Building Code, Uniform Plumbing Code,
Uniform Mechanical Code, National Electrical Code and state laws regulating energy
conservation, noise attenuation and access for the disabled. This plan review is based on
regulations enforced by the Building Department. You may have other corrections based on
laws and ordinance by the Planning Department, Engineering Department, Fire Department or
other departments. Clearance from those departments may be required prior to the issuance of
a building permit.
Present California law mandates that construction comply with the 2010 edition of the California
Code of Regulations (Title 24), which adopts the following model codes: 2009 IRC, 2009 IBC,
2009 UPC, 2009 UMC and 2008 NEC.
The above regulations apply, regardless of the code editions adopted by ordinance.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 105.4 of
the 2009 International Building Code, the approval of the plans does not permit the violation of
any state, county or city law.
To speed UP the recheck process, please note on this list (or a copv) where each

2. All sheets of plans must be signed by the person responsible for their

structural portions signed and sealed by the California state licensed engineer or
architect responsible for their preparation, along with structural calculations.

5. Per city policy, a soils report is required for this project. Please provide.
6. Provide a letter from the soils engineer confirming that the foundation plan,
grading plan and specifications have been reviewed and that it has been
determined that the recommendations in the soils report are properly
incorporated into the construction documents (when required by the soil report).
7. Note on plans that surface water will drain away from building and show drainage
pattern. The grade shall fall a minimum of 6" within the first 10 feet. Section

8. You have chosen to use the conventional construction bracing
provisions outlined in the CRC for the garage. Provide documentation to show
that the plans comply with the Braced Wall provisions of Section R602.10.

Forms E-32 and E-33 help determine tlie appropriate Storm water pollution prevention plan which shall
comply with current requirements and provisions established by the San Diego Regional Water Quality
Control Board and City of Carisbad requirements. Once appropriate Tier level is determined, it must be

This correspondence is in response to a request to the owner by the City of Carlsbad to
provide a biological letter as part of your project processing of the residential project at 2233
Pamplona Way, Carlsbad, California.
1 made a site survey of the parcel on 18 June 2014 at 11AM. The site, located at the
northwestern corner of Pamplona and Alicante, had some limited clearing and deposition of a
few cubic yards of fill. Surrounding areas are landscaped, suburban residential parcels. The
vegetation on the eastern cut slope was an erosion control mixture of native scrub elements that,
in a natural and more extensive area, would constitute Diegan Coastal Sage Scrub. The habitat,
however is the result of erosion control seeding and is not a native habitat. The shrubs had been
pruned back. The south-facing, larger cut slope at the back of the parcel has a planting of exotic
shrubs and succulents. It appears that the adjacent neighbor to the north has been using this area
of planting of some fruit trees and sugar cane on the upper portion of the slope. A major growth
of Pampas Grass occurs at the base of the slope as well as massive Century (Agave) plants.
It is my opinion that the parcel, the result of grading for the original subdivision, did and
does not have any intact native vegetation since its creation as a legal parcel. It would be
considered as Disturbed Habitat for the purpose of any Habitat Loss calculations.

Background
The subject property is located at 2233 Pamplona Way in the La Costa area of the City of
Carlsbad, Califomia. The lot was developed in the late 1960's (Reference 3) as part of the master
La Costa Valley Unit No. 4 and occupies Lot 195. The lot is roughly rectangular in shape and
consists of a relatively level pad at the northeast comer of the intersection of Alicante Road and
Pamplona Way There is a variable height ascending slope from the pad up to Alicante Road to
the east and Lot 224 to the north. The slope daylights along Pamplona Way and increases in
height to roughly 18 feet below Lot 224 The gradient of the slope is roughly 1.5:1. We
imderstand that the lot has been undeveloped since the time of the mass grading of the Tract.

The site is currently vacant with a sparse growth of grasses and weeds on the pad and the
east slope which ascends to Alicante Road. There is a heavy growth of large succulent plants,
(i.e., cactus, etc) on the northem slope with scattered palm and other trees. There is also a
growth of phreatophyte type plants along the base of the westem portion of this slope.
Review of Reference 3 (Benton) indicates that the lot was graded with a cut/fill transition
across the lot in a roughly north/south direction. The westem, roughly three-quarters of the site is
shown as a planned cut underlain by in-place sandstone assigned to the Scripps Formation. The
remaining eastem portion of the site is shown as imderlain by fill derived from this (and other)
formations and consists predominantly of clayey sand. The majority of the ascending slopes are
fill slopes constmcted with this material. The westem portion of the northem slope is shown as a
cut into the formation material. The referenced report (3) is silent as to how the transition from
cut to fill was dealt with, if at all. As discussed below, the findings from our subsurface
exploration indicate that there is less fill on the site than that shown on the site plan included in
Reference 3.
Proposed Residence/Improvements
Based on our discussions with you and review of the enclosed site plan, we understand
that the proposed constmction will consist of developing a level building pad to accommodate a
manufactured home with a detached garage. We imderstand that the manufactured home will
have a raised floor with a perimeter concrete foundation and isolated interior pier footings. The
detached garage will have a conventional concrete slab-on-grade/foundation system.
Scope of Work
Based on the above information we performed the following scope of work which we felt
was necessary to properly characterize the site from a geotechnical perspective and to be able to
make the appropriate recommendations for the design and constraction of the proposed stracture
and appurtenances.
* Review of the above referenced plans/reports and in-house documents
* Subsurface exploration on Febmary 26,2014 consisting of 4 test pits excavated
with a backhoe. The pits ranged in depth from roughly 2 to 3 feet and were
logged by our project engineer. In-place and bulk samples of the soil/rock
materials encountered were retrieved for laboratory testing.

* Laboratory testing of the soil/rock samples retrieved to establish the
characteristics of the soil materials pertinent to the design/constraction of the
improvements. The testing included: in-place moisture density, consolidation,
grain size analyses and shear strength.
* Stability analyses of the ascending perimeter fill slopes.
* Review and analyses of the findings.
* Determination of the near source seismic factors per the current Califomia
Building Code
* Engineering analyses and formulation of design recommendations for the
foundation elements.
* Preparation of this report.
Findings
Surface Features
The most significant surface features from a geotechnical engineering perspective are the
vegetation cover on the north slope and a relatively shallow surface soil flow/slump along the
southem portion of the eastern slope.
As discussed above, the vegetation on the northem slope consists of a growth of large cacti
and other succulent/water absorbing type plants. This is a mature growth of plants that appears to
have thrived without the benefit of landscape irrigation. Extreme care should be taken if it is
desired to remove any/all of these plants. The root systems of these plants have provided, at the
very least, a stabilizing effect to the surficial stability of the slope. Removal of any of these
plants/root systems may destabilize localized areas of the near surface slope soils.
There is a relatively shallow soil flow/slump along the southern portion of the eastem slope
along Alicante Road. The slump is roughly 12 inches deep and roughly 10 feet wide. It does not
appear that this slope has been maintained with landscape/irrigation since the time of initial
constraction (i.e., 1966). That said, although the slope has performed relatively well in the past 48
years, this area of the slppe should be repaired as discussed below.

Subsurface Conditions:
Engineered Fill (Ef). The engineered fill placed as part of the mass tract development circa
1966 appears to be limited to the constraction of the eastern slope which ascends to Alicante Road
and the eastem, roughly one-half of the northern slope which ascends to Lot 224. These soils
consist predominantly of clayey sands which are damp to moist and medium dense where
encountered. The descriptive terms of this material is presented on the enclosed logs of the test
pits. Plates 2.1 through 2.4. The estimated limits of this material is shown on the enclosed Plate 1 -
Geotechnical Map.
Scripps Formation (Tsc). As discussed above, essentially the entire level portion of the lot
is cut into the underlying formation materials. The upper, roughly 8-inches of this material is very
weathered. The remaining portions of this material encountered is medium dense to dense with
depth. The in-place formational material encountered consists predominantiy of sandstone (i.e.,
sand) which is dense and damp to moist where encountered.
Landslides:
There are no known deep seated landslides in the immediate vicinity of the subject site, nor
were any detected during our investigation. Minor sloughing of the near surface soils on the eastem
slope were observed as discussed above.
Ground Water:
Ground water, as a zone of free water was not encountered in any of our exploratory
excavations.
Seismic Design Considerations:
In accordance with Section 1613A.5.5.1 of the 2010 CBC, the Site Classified is defined as
"D" (stiff soil profile). The following seismic design parameters are based on the results of our
interpretation of the noted charts and figures in the 2010 Califomia Building Code (based on the
2009 International Building Code) and ASCE/SEI 7-05. Additionally, the computer program
Seismic Hazard Curves and Uniform Response Spectra Version 5.1.0 by the United States
Geological Survey (USGS 2007) was utilized to refine the parameters.

Due to the dense condition of the bedrock that underlies the site, liquefaction is not considered to
be a factor in the design of the proposed improvements.
Slope Stabilitv:
Utilizing the ultimate shear strength parameters for the existing fill and peak parameters for
the underlying bedrock as tested in our laboratory and the program GSTABL7 developed by
Gregory Geotechnical Software, deep seated/global stability analyses was performed for a
maximum height of an existing fill slope of 20 feet with a gradient of one and one-half to one
horizontal to one vertical (1.5:1). The resulting static factor of safety is 2.1 for this configuration.
The graphical output plot and output files are attached as Appendix B.
While the deep seated stability is not considered to be a factor in the design of the proposed
improvements, the surficial stability of the ascending perimeter fill slopes is an issue of interest
from a geotechnical perspective. As discussed above, there is a minor soil flow/slump feature
along the southem portion of the eastem slope. It is believed that this feature is the result of
weathering of the near surface fill soils and episodes of heavy rain events over the years. While this
is not a large feature, it needs to be addressed in the form of a repair to avoid enlargement of this
feature both horizontally and vertically. Fortunately, in this area there is a paved sidewalk and
street (Alicante) above this slope which does not allow for any build up of water that would lead to
a deep saturation of the near surface slope soils. The heavily vegetated state of the northem slope
has, most likely, helped in preventing distress to the near surface slope soils.
Included at the end of Appendix B is a calculation sheet for surficial slope stability. The
analyses indicate that at a depth of 2.5 feet of saturation the factor of safety against surficial
stability is on the order of 1.5. As discussed above it is not likely that the eastem slope will ever
experience that depth of saturation due to the paved surfaces immediately above the top of this
slope and the heavy vegetation on the northern slope would tend to prevent this type of saturation
depth as well.
CONCLUSIONS
The subject site is considered suitable for it's intended use from a geotechnical perspective
provided the recommendations presented herein are incorporated into the design and constraction
phases of the proposed development.

RECOMMENDATIONS
The following recommendations are based on our review of the referenced plans/reports,
observations, findings from our subsurface investigative work and results of our laboratory testing.
Foundation Design:
Based on our experience with similar soils and the reactions to the samples tested to
loading/water innundation, the formational materials underlying the site are classified as exhibiting
a very low expansion potential.
We underst£ind that the proposed residence stracture will have a raised floor beneath the
entire envelope and the detached garage will be a conventional concrete slab-on-grade foimdation
system.. Therefore, we recommend the following provisions be incorporated into the design of the
foundation elements.
Soil Bearing Pressure. We recommend an allowable soil bearing pressure of 2,000 pounds
per square foot (psf) for continuous footings at least 12 inches wide and 12-inches deep and for
isolated/pier footing that are at least 18-inches square and embedded at least 12-inches. A one
third increase for short term wind or seismic loads is allowed. Lateral loads against the stracture
may be resisted by friction between the footing bases and the supporting soil.
Footing Design. Exterior footings should be at least 12 inches deep and reinforced with
two No. 4 deformed steel reinforcing bars, one near the top and one near the bottom. All interior
footings should have an embedment depth of at least 12 inches.
Differential foundation settlements could, conceivably, be on the order of Vi -inch within
the building pad.
Slabs-on-Grade. Although the residence will have a raised floor, there will be other slabs-
on-grade associated with the driveway/garage, and other hardscape features. The driveway/garage
slabs-on-grade should be at least 4 inches thick and be reinforced with No. 4 deformed steel
reinforcing bars 18 inches on center each way. The reinforcing bars should be positioned at the
mid-height of the slab and be maintained during concrete placement. The slabs-on-grade should be
underlain at least four inches of clean moist sand.

If desired, the garage slab can be underlain by 10 mil plastic sheeting to provide a moisture
vapor barrier. If this is desired, the sheeting should be placed with at least one-inch of sand above
the sheeting. There should be at least two inches of clean moist sand or gravel beneath the plastic
sheeting. The intent of the sand and plastic sheeting beneath the slabs-on-grade is to provide a
capillary break for any moisture that may migrate beneath the slab. It is not intended as a
waterproofing system. If a waterproof system is desired, other design professionals will need to be
consulted for recommendations.
Presoaking. A thorough wetting of the exposed subgrade soils should be performed
immediately prior to the placement of the slab-on-grade underlayment elements (i.e., clean sand
and plastic sheeting).
Cement Type. From a geotechnical perspective. Type II cement may be utilized for all
concrete in contact with the subgrade soil provided that all provisions of ACI 318, Section 4.2
pertaining to water-cement ratio are satisfied.
Retaining Walls:
We are not aware of any plans for retaining walls as part of the proposed improvements.
Exterior Concrete Flatwork.
Concrete flatwork should be divided into as nearly square panels as possible. Frequent
joints should be provided to give articulation to the concrete panels. Landscaping and planters
adjacent to concrete flatwork should be designed in such a maimer as to direct drainage away from
concrete areas to approved outlets. The subgrade soils should be pre-moistened prior to placing
concrete.
Patios and walkways should have a 4-inch minimum thickness and be reinforced with No. 3
reinforcing bars spaced 18 inches on center, each way, placed and maintained at mid height
through the concrete placement.
Surface Drainage.
The performance of foundations is partly dependent upon maintaining adequate surface
drainage both during and after constraction. The ground surface around stractures should be graded
so the surface water will be carried quickly away from the building without ponding. The
minimum gradient within five feet of the building v^ll depend upon surface landscaping and
hardscape.

In general, we suggest that paved and landscaped areas have a minimum gradient of two percent.
Planters should be constmcted so that moisture is not allowed to seep into foundation areas or
beneath slabs and pavements.
Landscaping:
The impact of heavy irrigation can artificially raise existing ground water tables or create
perched water conditions. This may result in seepage or shallow ground water conditions where
previously none existed.
It appears as though the eastem slope of the subject property has either never been
subjected to landscape irrigation or at least not for a long period of time. Subsequent to the repairs
as discussed below, consultation with a qualified landscape architect should be considered if there
are any plans for landscaping any portion of this or the northem slope in the future.
Earthwork:
In general, all significant earthwork operations should be performed under the observation
and testing of a qualified geotechnical engineer. We understand that the current plans call for
predominantiy cut into the formational soil/rock and very little, if any fill is plaimed.
Slope Repair:
As discussed above there is an existing remnant of a soil flow/slump along the southem
portion of the eastem slope below Alicante Road. For continuity, this area should be repaired to
the pre-existing slope configuration. The appropriate repair for this section of slope vsall be to over-
excavate the exposed soils and reconstract the slope in a maimer such that it will be overbuilt and
trimmed back to a firm surface. The details of this type of repair are presented on the enclosed
Plate 3 - Slope Repair Details. This work will require the observation and testing of a qualified
geotechnical engineer.
All fill soils related to this work should be moisture conditioned to achieve at or above
optimum moisture conditions, placed in lose lifts, roughly 6 to 8-inches in thickness and be
mechanically compacted to 90 percent relative compaction based on ASTM Test Method D 1557.

LIMITATIONS
Geotechnical engineering is an inexact science and conditions encountered during our
subsurface exploration program have been extrapolated between exploratory points. Subsurface
conditions are not homogenous and our assumptions may not be accurate. The actual conditions
will not be known until the excavations for the development are undertaken.

SUPPORTING. DATA. PROCEDURES AND ANALYSIS
LABORATORY TESTING
General. The following sections describe the procedures for laboratory tests commonly
performed by Evans, Colbaugh & Associates, Inc. on soil and rock samples obtained during the
exploratory phase of our investigation. The selection of certain samples for laboratory testing is
based primarily on engineering judgement, and all laboratory tests described below have not
necessarily been performed on every sample obtained.
Moisture-Density. Field moisture content and in-place density were determined for each
sample of undisturbed soil material obtained. The field moisture content is determined according
to ASTM Test Method D 2216-98 by obtaining one-half the moisture sample from each end of the
tube. The in-place dry density of the sample is determined by using the net weight of the entire
sample.
At the same time the field moisture content and in-place density are determined, the soil
material at each end of the sleeve is classified according to the Unified Soil Classification System
and pocket penetrometer readings are made in the cohesive samples. The results of the field
moisture content and in-place density determinations are presented on the logs (Plates 2.1 through
2.4).
Consolidation/Expansion Test. The one-dimensional consolidation/expansion of in-place
samples of on-site soil/rock was evaluated. The procedure basically consists of performing a
loaded swell test on a sample one inch high and 2.625 inches in diameter. Several samples of the
underlying fill and colluvial soils were tested to determine the expansion/consolidation potential
when inundated with water. The samples were chosen from various depths and normal loads were
applied and allowed to stabilize prior to inundation.
The results of this test are presented in graphical from as Plates A-1
Grain Size Distribution. As part of the engineering classification of the on-site soils,
samples of the two major soil types (i.e., fill and sandstone) were tested to determine the
distribution of particle size. The distribution was determined in general accordance with ASTM
Test Method D 422. Particle size is first detennined by a wash sieving procedure using U S
Standard Sieve Size Nos. 3.4,4,10,20,40, 60, 100 and 200. The test results are summarized on
Plate A-2
Direct Shear Test. Direct shear tests were performed on relatively undisturbed samples of
the fill soil and formational soil/rock to obtain the drained peak and ultimate strength. The tests
were performed on cylindrical samples having a diameter of 2.625 inches and a height of one inch.
Prior to testing the samples are soaked in the consolidometer under the same normal stress to be
employed during the test to allow the sample to expand or consolidate and reach equilibrium imder
load. Soaking periods were at least one day. After consolidation, the sample is placed in the
direct shear box, the normal stress is reapplied through a loading frame and lever system, and the
sample is submerged. Prior to testing, cohesive samples are allowed to restablize. Vertical
movement is monitored electronically by a digital dial indicator. The samples were sheared at a
strain rate of 0.01 to 0.005 inches per minute. The shearing force is measured by means of an
electronic load cell. Horizontal displacement of the sample is monitored electronically by a digital
dial indicator. Shear force, normal force, and vertical movement of the sample are all
automatically recorded by computer link and stored in a unique data file. For peak and ultimate
strength, each sample is sheared to a displacement of approximately one-half inch. The results of
the direct shear tests are presented on Plate A-3.1 and 3.2

FEE REGULATIONS
Residential
Fees can be charged on any new square footage within the perimeter of a residential structure, excluding carports, walkways, garages, overhangs, patios,
enclosed patios, detached accessory structures, or similar structures (Govemment Code Section 65995 (b)(1)).
Fees on room additions are limited by the restrictions above. Additionally, fees on room additions cannot be assessed unless the increase in the assessable
square footage of the residence is more than five hundred (500) square feet. If the room addition creates a net increase of greater than five hundred (500)
square feet, the fee is charged on the entire net Increase in square footage (Education Code Section 17620 (a)(l)(c)(i)).
2. Commercial/Industrial Fees
Government Code Section 65995(b)(2) specifies the type of commercial/Industrial space that may be charged. Fees can be charged on covered and
enclosed space within the perimeter of the commercial/industrial structure, not including storage areas incidental to the principal use of the construction,
garages, parking structures, unenclosed walkways, or utility or disposal area.

purposes; (2) private full-time day schools as described in Education Code Section 48222; and (3) structures owned and occupied by a governmental agency.
Education Code Section 17626 and Govemment Code Section 66011 together prohibit charging fees on structures replacing those damaged or destn>yed by
a natural disaster. However, if the functioning, size, or use of the previous structure is changing, then the resulting increase or change in function, size or use
may subject all or part of the new structure to the applicable Fees.
4. Senior-Only Facilities
Although senior-only tecilities are residences. Government Code Section 65995.1(a) limits the fees on certain senior-only facilities to that of
Commercial/Industrial Fees. The Commercial/Industrial Fee applies to Senior housing, as described in Civil Code Section 51.3, Health and Safety Code
Sections 1S69.2(k) and Govemment Code Section 15432(d)(9), as well as mobile home parks where residency is limited to okJer persons, as provided by
Govemment Code Section 65995.2. Applicants will tie required to provide proof that their development satisfies the applicable code section bv brinoino in their
recorded Covenants Conditions &Restrictions or deed restriction.
5. Mitigation Payments
Mitigation Payments will only be refunded pursuant to the terms of the applicable Mitigation Agreement. None of the provisions herein related to expiration or
refund apply to payments made pursuant to a Mitigation Agreement.
NOTICE OF SCHOOL FEE APPEAL/PROTEST PROCEDURE
Pursuant to the Resolution adopting this COC, the following summarizes the District's School Fee Appeal/Protest Procedure for protesting
Commercial/Industrial Fees and ResWential Fees (collectively referred to as "School Fees") in order to provide a process that permits the Applteant an
opportunity for a hearing to appeal the imposition of School Fees ("Hearing") and to conskler the required notice of protest filed pursuant to Government Code
Section 66020:
a. Within ninety (90) calendar day of being notified of the School Fees to be Imposed or paying the School Fees, Applicant(s) shall file a written request:
1. By personal delivery, certified or registered mail or ovemight mail (i.e., FedEx or similar senrice) ("Allowable Method") for a Hearing.
2. That contains a statement that payment has been tendered or will be tendered when due, or that any conditions which have been imposed are
provided for or satisfied, under protest.
3. That contains a statement(s) informing the Goveming Board ("Board") of the factual elements of the dispute and the legal theory forming the basis
for the protest. The possible grounds for appeal include, but are not limited to:
a. For Commercial Fees - the inaccuracy of including the Project within the category pursuant to which the Commercial Fees are to be
imposed, or that the employee generation or pupil generation factor utilized under the applicable category are inaccurate as applied to
the Project. The Applicant appealing the imposition of Commercial Fees shall bear the burden of establishing that the Commercial
Fees are improper ("Commercial Grounds for Appeal").
b. For Residential Fees - the Inaccuracy of the pupil generation factors, land cost, development or square footage projections used. The
Applicant appealing the Imposition of Residential Fees shall bear the burden of establishing that the Residential Fees are improper
("Residential Grounds for Appeal") (Commercial Grounds for Appeal and Residential Grounds for Appeal collectively referred to as
"Grounds for Appeal.').
4. The written request shall be served on the Assistant Superintendent, Business Services, of the School District ("Assistant Superintendent").
b. Within ten (10) calendar days of receipt of the written request for a Hearing, the Assistant Superintendent, or designee, shall give notice in writing of the
date, place and time of the Hearing to Applicant(s). The Assistant Superintendent, or designee, shall schedule and conduct said Hearing within fifteen
(15) calendar days of receipt of the written request. The Assistant Superintendent, or designee, shall render a written decision within ten (10) calendar
days following the Hearing and serve it by an Allowable Method to Applicant's / Applicants' last known address.
c. Within ten (10) calendar days of receipt of the Assistant Superintendent or designee's written decision, Applicant(s) may appeal the Assistant
Superintendent or designee's decision to the Board. Applicant(s) shall state in the written appeal the Grounds for Appeal and said written appeal shall
be served by an Allowable Method on the Assistant Superintendent.
d. Within ten (10) calendar days of receipt of the written request for a Hearing, the Assistant Superintendent, or designee, shall give notice in writing of the
date, place and time of the Hearing to the Applicant(s). The Boanj shall schedule and conduct said Hearing at the next regular meeting of the Board,
provided that the Applicant(s) is given notice at least five (5) calendar days prior to the regular meeting of the Board. The Board shall render a written
decision within ten (10) calendar days following the Hearing on the Applicant's / Applicants' appeal and serve the decision by an allowable Method to the
Applicant's last known address.
REFUND POLICY
If construction does not commence as provided in Education Code Section 17624 and Govemment Code Section 65995, the amount of the Fees paid,
minus a Fifty and no/100 Dollar ($50.00) application charge, will be refunded to the Owner of the Project at the time this COC was issued. An authorized
written notice from the building department responsible for issuing the building permit declaring that the building permit has been cancelled and no
construction has commenced must be delivered to the District's Facilities Planning & Development Department. Refunds will be processed thirty (30)
days after receipt of notification.
