The City Attorney's Office has determined that because the pool is constructed on two separate, but adjoining, lots that both lots must provide adequate pool fencing to be in compliance; however because both lots share the pool, no fence would be required to separate the two properties. This office is in need of inspecting the fencing at 2210 Recodo Court, APN: 216-493-10, to verify that it meets the requirements of Carlsbad Municipal Code, Sections 18.28.020 and 18.28.030, copies enclosed.
