Dear Mr. Fleming: In response to our conversation on August 21, 1997, I checked with our City Attorney's Office regarding the questions of witness fees. The City Attorney's Office informed me that any time an employee is required to be away from the job and called as a witness in a case, witness fees are required to be paid. The policy of the City of Carlsbad is that witness fees be paid prior to appearance or on the date of appearance in the amount of $1 50.00 per day. If when called and the employee is not required for a full day of testimony, you may request a refund of the unused portion of the fees. Regarding the records that you are requesting, as I told you during our conversation on August 21, 1997, our original records do not leave our offices. This has been directed by our City Attorney's Office. It is apparent that there are a number of stairways that do not meet the handrail requirement which was probably in effect when the project was first constructed. It would be advisable to install a handrail on those exterior stair which have more than three risers. This would assist tenants and guests in safely traversing the stairs, and may assist in limiting your liability as it relates to accidental falls. I have included the related Uniform Building Code Section (circa 1970) for your reference.
