Prior to commencement of any grading activity, the permittee shall submit a grading schedule which indicates that grading will be completed withi.n the permitted time frame designated in this condition and that any variation from the schedule shall be promptly reported to the Executive Director. C. All permanent runoff and erosion control devices shall be developed and installed prior to or concurrent with any on-site grading activities . D. All areas disturbed, but not completed, during the construction season, including graded pads, shall be stabilized in advance of the rainy season. The use of temporary erosion control measures, such as berms, interceptor ditches, sandbagging, filtered inlets, debris basins, and silt traps shall be utilized in conjunction with plantings to minimize soil loss from the construction site. Runoff shall be directed away from the hillside(s) where possible, and any runoff directed over the hillside(s) shall be retained and discharged at a non-erosive velocity (less than 6 cfs) and at lagoon level elevation (elevation +6) in order to protect the scenic resources and habitat values of the hillside(s) from degradation by scouring or concentrated runoff. 5. Assumption of Risk. Prior to the issuance of the coastal development permit, the applicant [and landowner] shall execute and record a deed restriction, in a form and content acceptable to the Executive Director, which shall provide: (a) that the applicant understands that the site may be subject to extraordinary hazard from flooding and from slope failure, and the (b) applicant hereby waives any future claims of liability against the Commission or its successors in interest for damage from such hazards. The document shall run with the land, binding all successors and assigns, and shall be recorded free of prior liens and any other encumbrances which the Executive Director determines may affect the interest being conveyed. 6. Exterior Treatment. Prior to the issuance of the coastal development permit, the applicant shall submit building plans for the review and approval in writing of the Executive Director, indicating the exterior materials and color scheme to be utilized in the construction of the proposed residence. Earth tones designed to minimize the project's contrast with the surrounding area shall be utilized. 7. Public Rights. By acceptance of this permit, the applicant acknowledges, on behalf of him/herself and his/her successors in interest, that issuance of the permit shall not constitute a waiver of any public rights which may exist on the property. P-1118 INTRODUCTION This report presents the results of our geotechnical investigation. ’ The purpose of this study was to evaluate the nature and characteristics of the earth materials underlying the property and their influence on the construction of the proposed single-family residence. SITE CONDITIONS The subject property is located north of Laguna Drive along the west side of Buena Vista Circle in the city of Carlsbad. The site is a rectangular lot with its western portion descending at an overall gradient of about 3.5:l for approximately 28 vertical feet to the Buena Vista Lagoon. Previous grading on the site has created a level pad area in the eastern portion of the lot. The site is bounded on the north and south by single-family res idence s. PROPOSED DEVELOPMENT Preliminary plans for the development of the site were prepared by Robert Royce, A.I.A. The plans indicate a single- and two- story residence with a central courtyard will be constructed on the level pad. The structure will be supported on conventional footings with slab-on-grade floors. August 24, 1989 W.O. P-1118 Page 3 SITE INVESTIGATION Three exploratory borings were excavated to a maximum depth of 8.5 feet with a portable auger drill at the site. An additional test trench was excavated with a tractor-mounted backhoe to a depth of 8.0 feet. Earth materials encountered were visually classified and logged by our field engineer. Undisturbed, representative samples of the earth materials were taken at selected intervals. Samples were obtained by driving a thin- walled steel sampler into the chosen strata. The samples were retained in brass rings of 2.50 inches inside diameter and 1.00 inches high. The central portion of the sample was retained in close-f itting, waterproof containers and transported to our laboratory for testing and analysis. LABORATORY TESTmG Classification The field classification was verified through laboratory exam- ination in accordance with the Unified Soil Classification System. The final classification is shown on the enclosed Boring Logs. Moistur e/Densi ty The field moisture content and dry unit weight were determined for each of the undisturbed soil samples. This information is August 24, 1989 Page 4 W.O. P-1118 useful in providing a gross pic-ure of ,he soil consistency or variation among exploratory excavations. The dry unit weight was determined in pounds per cubic foot. The field moisture was determined as a percentage of the dry unit weight. Both are shown on the enclosed Boring Logs. GEOTECHNICAL CONDITIONS Artificial Fill The upper 6.0 inches of the pad area is composed of very dense, brown silty sand. This material appears to have densified during the previous grading of the site and significantly reduces infiltration into the underlying terrace deposits. Terrace Deposits Underlying the fill cap, reddish-brown medium- and coarse-grained sandstone with cobbles was encountered. The upper 5.0 feet of this terrace deposit is moderately dense to dense and slightly moist. However, below 5.0 feet the moisture content increases and the cementation within the sandstone is absent. No groundwater was observed to the depth explored. CONCLUSIONS AND RECOMMENDATIONS The lack of cement and the increase in moisture content within the terrace deposits below 5.0 feet have probably resulted fscm August 24, 1989 Page 5 W.O. P-1118 fluctuations in the level of groundwater. Although groundwater is not expected to directly affect the construction of the residence, fluctuations in the level of groundwater may result in minor consolidation of the terrace deposits. Additional steel reinforcement in footings and slabs is recommended because of the po tent i a1 c ons o 1 id at ion . Foundations Footings for the proposed structure should be a minimum of 12 inches wide and founded a minimum of 18 inches into terrace deposits for one- and two-story structures. A 12-inch by 12-inch grade beam should be placed across the garage opening. Steel reinforcement should consist of two No. 4 bars top and bottom in accordance with Plate B, Footing/Slab Detail. Footings founded a minimum of 18 inches into competent sandstone may be designed for a bearing value of 1000 pounds per square foot. The bearing value indicated above is for the total of dead and frequently applied live loads. This value may be increased by 33 percent for short durations of loading, including the effects of wind and seismic forces. August 24, 1989 Page 6 W.O. P-1118 Resistance to lateral load may be provided by friction acting at the base of foundations and by passive earth pressure. A coefficient of ‘friction of 0.30 may be used with dead-load forces. A passive earth pressure of 150 pounds per square foot, per foot of depth of sandstone penetrated to a maximum of 1000 pounds may be used in the design. Slabs On Grade Slabs on grade should be a minimum of 4.0 inches thick and reinforced in both directions with No. 3 bars placed 18 inches on center. The slab should be underlain by a minimum 4.0-inch sand blanket which incorporates a minimum 6.0-mil Visqueen or equivalent moisture barrier. Utility trenches underlying the slab may be backfilled with on-site granular materials. However, sufficiently compacting the backfill deposits may damage or break shallow utility lines. Minor, settlement of the backfill in the trenches is anticipated. To reduce the possibility of cracks occurring, the slab should be provided with additional reinforcement to bridge over trenches. Drainage Pad water should be directed away from foundations and around the residence to an approved location. Pad water should not be allowed to pond or flow over the rear slope. Inspections and Density Testing Structural footing excavations should be inspected by a representative of this firm prior to the placement of steel. Plan Review A copy of the final building plans should be submitted to this office for review prior to the initiation of construction. Additional recommendations may be necessary at that time. LIMITATIONS This report is presented with the provision that it is the responsibility of the owner or the owner's representative to bring the information and recommendations given herein to the attention of the project's architects and/or engineers so that they may be incorporated into plans. If conditions encountered during construction appear to differ from those described in this report, our office should be notified so that we may consider whether modifications are needed. REASON: Buena Vista Circle is in an older established neighborhood with an existing 40’ right of way. It carries very little traffic and there have been no traffic or circulation problems reported on the street in the last 5 to 6 years. Since many of the existing homes are already built within 12 to 15 feet of the existing right of way, Increasing the right of way width to City Standards would place these homes within 4 to 7 feet of the right of way which severely violates the City Zoning Ordinance regarding front yard setbacks. EXPLANATION: Buena Vista Circle was originally approved in 1948 as a 40' private access easement to serve an 18 lot subdivision. At some time in the past that private easement was dedicated to the public and accepted. Presently 16 of the lots have single family homes on them with 2 lots vacant. The street dead ends and the only traffic it cames is to serve the existing homes. The only increase in traffic would come from the construction of homes on the 2 vacant lots. This variance does not affect the standard curb to curb width of the street or eliminate the City sidewalk. Its only affect is to allow a greater front yard setback. Based on the following findings staff recommends approval of the Standards Variance: 1. The circumstances or conditions applicable to this situation are unusual. 2. No drainage problems will occur. 3. The proposed variance will not conflict with existing or future traffic, parking, pedestrian or bicycle demands. 4. It is not detrimental to the public welfare or injurious to private property rights. 5. The proposed variance will not adversely affect the comprehensive general plan. Property Owner shall not be required to make said improvements before December 1, 1990, or within such further period of time as is granted by City, provided, however, that upon the happening of either of the following occurrences said improvements may, at the sole election of City, be required to be made sooner than said date or such extended period of time which may have been granted by City: (a) When the City Council finds that the owners of 40% or more of the frontage, including the frontage of Property Owner, between intersecting streets on both sides of the street upon which the property herein described has frontage, have agreed with City to install street improvements to City specifications. (b) When owners of more than 50% of the frontage, between intersect- ing streets on both sides of the street upon which the property herein described has frontage, have petitioned the City to form an improvement district for the improvement of said streets. Said improvements shall be made without cost or expense to City. In the event same is not paid within thirty (30) days from completion, City may foreclose said lien as provided by law for the foreclosure of mortgages. (b) Direct the City Engineer to estimate the cost of necessary en- gineering, and the work required to install and construct said improvements, and foreclose said lien in said amount. (c) Pursue any remedy, legal or equitable (including those specifi- cally referred to herein), for the foreclosure of a lien, and the Property Owner, Property Owner’s successors, heirs, assigns and transferrees, shall be 1 i ab1 e for reasonable attorney’s fees as a cost in said proceedings. Section 4. Said City shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage happening or occurring to the work or improvements specified in this agreement prior to the completion and acceptance of the same, nor shall said City, nor any officer or employee thereof, be liable for any persons or property injured by reason of said work or improvements, but all of said liabilities shall be assumed by said Property Owner and Property Owner's successors, heirs, assigns or transferees, and they shall save the City harmless from, and indemnify the City against, any and all claims, suits and liabilities of or to any person or property injured or claiming to be injured as a result of said work or improvements. Said Property Owner, and Property Owner's successors, heirs, assigns or transferees, further agrees to protect said City and the officers and employees thereof from all liability or claim because of, or arising out of, the use of any patent or patented article in the construction of said improvement. Section 7. It is further agreed that said Property Owner will at all times up to the completion and acceptance.of said work and improvements by the City, give good and adequate warning to the traveling public of any dangerous or defective conditions of pub1 i c property.
