DETERMINATION OF NONRESIDENTIAL BUILDING ENERGY EFFICIENCY
STANDARDS IN EFFECT FOR FIRST TENANT IMPROVEMENTS
Based upon the recommendations to the California Energy Co11111ission from the
New Building Energy Efficiency Standards Implementation Advisory Group and
the CALBO Advisory Committee, the following clarification applies regarding
which set of standards are in effect for first tenant improvements in non-
residential buildings:
If forms 1,2, and 3 or equivalent energy documentation
was submitted prior to January 1, 1987, · pursuant to a
structural permit for a conditioned use, the standards in
effec~ at the time of the documentation submittal apply
to the first tenant improvements until the space is fully
occupied.
The California Energy Commission staff considers an energy performance or
budget approach as "equivalent energy documentation" as that term is used
above.
Note that new nonresidential standards were adopted in January 1984, and
became effective in October 1985. These standards included the adoption of a
new set of Mandatory Features (Sections 2-5311 to 2-5319) which became
mandatory on the October 1985, effective date. Also, new standards for office
buildings (Sections 2-5341 to 2-5343) went into effect on that date and were
one compliance option from October 1985 to January 1987 when they became the
only applicable standards for office buildings.

The CF-1 is not necessarily a summary of compliance information for the
bui1ding although it may also serve such a purpose. The CF-1 ll the set of
requirements imposed on all futur~ alterations until compliance is redemons-
trated for the building as a whole.or until an entirely new set of regu-
lations supersedes the CF-1. The new standards are in effect standards for
whole buildings that allow tradeoffs in various aspects of building design.
for example, the designer may convince the building owner or her/his agent to
build an all glass daylight-designed envelope which requires daylighting
controls on all lights. All future tenants would be required to install
daylighting controls on all lights as specified in a CF-1 unless the whole
· building was shown to. comply with the standards. Because of this use of the
CF-1, the proposed entries are the same as the required entries for first
generation applications, since what has been designed and proposed will be
what is required for· alterations.-·

heat and cool air streams which are subsequently mixed for temperature control are prohibited
for buildings larger than 20,000 square feet of conditioned space. If used, the air leakage for
dampers utilized for the mixing of heating and cooling air shall be limited to a maximum leakage of
3% of the total air quantity handled by the dampers when operating at the maximum system

Several HVAC System types have special requirements or restrictions. In this section, the type of system used in the design

DUAL DUCT AND MULTIZONE SYSTEMS
Constant volume duct or multizone systems which utilize new energy to simultaneously heat and cool air streams which
are subsequently mixed for temperature control are prohibited for buildings larger than 20,000 square feet of conditioned
space. If used, the air leakage for dampers utilized for the mixing of heating and cooling air shall be limited to a maximum
leakage of 3% of the total air quantity handled by the dampers when operating at the maximum system pressure to which
the dampers will be subjected. Manufacturer's label or nameplate shall state leakage rates. -REFERENCE ________ _
Economizer Cycle -For each cooling fan system, for other than dual-duct or multizone systems, which serve zones having
total cooling capacity greater than 134,000 Btu/hr or more than 5,000 CFM must have an economizer cycle unless one of
the exceptions allowed is claimed.

Electric Resfstance Heating Systems .... These systems shall not be used unless the total installed electric resistance heat does
not exceed 10% (ten percent) of the annual heating energy requirement or_ a life cycle cost analysis, Form 8 (see Section 4.2
